MINUTES
CALL TO ORDER
Chairperson Linda Johnson called the regular meeting of the Code Enforcement
Board to order at 2:04 PM in the Community Center.
ROLL CALL
Members present: Linda Johnson, Ed Corn, Glenn Barnhill, Gail Anderson, Ben
Wagner, Alice Haldeman and Sherry Lester. Also present were Code Supervisor
Jeff Lariscy, Code Officer Mike McGrath, Board Attorney Ty Harris and Board
Coordinator Shontella Jackson.
APPROVAL OF MINUTES
The Minutes for the regular meeting of July 12, 2012 were presented to the
Board for approval. MOTION by Ed Corn, SECOND by Glenn Barnhill to
adopt the minutes of Regular Citizen Code Enforcement Board on July
The meeting was proponed for a few minutes due to technical problems. The
meeting was called back to order by Chairwoman Linda Johnson.

Code Supervisor Jeff Lariscy stated the following cases will not be hear and are

A. Hamilton, Violation of Section 7-1 (Fla. Bldg. Code Permits) and Sec. 21-36.02
(General regulation) Code Officer Mike McGrath presented the case summary to
the Board. Code Officer Mike McGrath presented staff's recommendation to find
William A. Hamilton in violation of Section 7-1 of the Code of Ordinances
assessing the citation fine of $75.00 and for a lien to be placed on the property if
not satisfied by August 15, 2012. Code Officer Mike McGrath stated that Mr.
Hamilton has moved the shed and is in compliance with the Building Department
setbacks and requesting the citation fine only. Mr. Hamilton states he moved the
shed to comply with the Building Department.
MOTION by Ben Wagner, SECOND by Gail Anderson that the Board
finds William A. Hamilton in violation of Section 7-1 of the Code of
Ordinances assess the citation fine of$75.00 and for a lien to be placed
on the property if not satisfied by August 15, 2012. NOTION CARRIED

(B) Code Officer Mike McGrath presented the case summary to the Board. Code
Officer Mike McGrath presented staff's recommendation to find William A.
Hamilton in violation of Section 21-36.02 of the City of Edgewater Code of
Ordinances assess the citation fine of $75.00 and for a lien to be placed on the
property if not satisfied by August 15, 2012.
MOTION by Ed Corn, SECOND by Sherry Lester that the Board finds
William A. Hamilton in violation of Section 21-36.02 of the Code of
Ordinances waiving the citation fine of$75.00. NOTION CARRIED 6-1.
The Board requested a short recess. Chairwoman Linda Johnson called the
meeting back to order.

Chairwoman Linda Johnson concluded with the following note: that no one was
present for any of the cases mentioned above. Pursuant to Section 10-348 and
10-345 sub paragraph 11 of the Code of Ordinance and the statement that
appears on the respected citation issued that failure to appear at this hearing the
alleged violator has waived any right to contest the violation and that an order
can be made against for the maximum applicable penalties that include but not
limited to administrative costs, fines, daily fines and liens however we have the
benefit of the staff recommended; motion and actions to be taken by the Board.
MOTION by Ben Wagner, SECOND by Ed Corn to approve the findings in
violation and approve the staff recommendation. NOTION CARRIED
UNANIMOUSLY.
OTHER BUSINESS:
Chairwoman Linda Johnson thanked Mr. Harris and staff for the training
luncheon and the educational exchange which was beneficial for all.
CODE COMPLIANCE REPORT:
Code Supervisor Jeff Lariscy reminded the Board of the August 23, 2012 Code
Board Meeting. Mr. Harris would like to discuss the public records preservation
as a Code Board body for the next session in September 2012.
