COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Code Compliance Board to order at 2:11 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Glenn Barnhill, Ben Wagner, Sherry Lester, Gail Anderson, and Alice Haldeman. Also present were Fire Marshal Jeff Lariscy, Code Officer Mike McGrath, and Board Coordinator Shontella Jackson. Absent and excused: Ed Corn. APPROVAL OF MINUTES The Minutes for the regular meeting of April 14, 2011 were presented to the Board for approval. MOTION by Alice Haldeman, SECOND by Gail Anderson to adopt the minutes of the Regular Code Compliance Board meeting on April 14, 2011, as written. MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Roger M. Inskip of 218 N. Ridgewood Ave., Edgewater, FL; Code Officer Mike McGrath and Fire Marshal Jeff Lariscy were sworn in. CASE(S) IN COMPLIANCE: None. Code Enforcement Board Minutes May 12,2011 Page 1 The Board approved an amendment to the agenda to move Case #2011-CE-103946 A & B up on the agenda to item #1 and 2. The Board members had no objections to the agenda amendment. NEW BUSINESS: Case #2011-CE-103946, (A) 218 N. Ridgewood Ave., Edgewater Florida; Roger & Mary Inskip, Violation of Section 11-2 (Business Tax). Code Supervisor Jeff Lariscy presented the case summary to the Board. Code Supervisor Jeff Lariscy presented staff's recommendation to find Roger & Mary Inskip in violation of Section 11-2 of the Code of Ordinance assessing a citation fine of $150.00 and for a lien to be placed on the property if not satisfied by June 1, 2011. Mr. Roger Inskip stated he owns the property and has made improvements to the property. Mr. Inskip stated he was not aware that the property owner would be liable for their tenants and requested the Board to waive the lien on the property. Mr. Inskip stated he understood he was responsible for garbage, signage but not license issues for his tenants. The Board had a brief discussion. MOTION by Sherry Lester, SECOND by Gail Anderson that the Board finds Roger & Mary Inskip in violation of Section 11-2 of the Code of Ordinance assessing the citation fine of $150.00 and for a lien to be placed on the property if not satisfied by une 1. 2011. MOTION CARRIED 4-2, Case #2011-CE-103946, (B) 218 N. Ridgewood Ave., Edgewater Florida; Roger & Mary Inskip, Violation of Section 11-9 (Certificate of use). Code Supervisor Jeff Lariscy presented the case summary to the Board. Code Supervisor Jeff Lariscy presented staff's recommendation to find Roger & Mary Inskip in violation of Section 11-9 of the Code of Ordinance assessing a citation fine of $150.00 and for a lien to be placed on the property if not satisfied by May 18, 2011. Mr. Inskip was presented and asked the Board to waive the liens on the property. The Board had a brief discussion. MOTION by Ben Wagner, SECOND by Glenn Barnhill that the Board finds Roger & Mary Inskip in violation of Section 11-9 of the Code of Ordinance waiving the citation fine of $150.00. MOTION CARRIED 5-1, Case #2011-CE-104071, 2310 Yule Tree Dr., Edgewater Florida; Bayview Loan Servicing LLC, Violation of Section 10-4 (Nuisance generally). Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff's recommendation to find John & Caren Stogsdill in repeat violation of Section 10-98 of the Code of Ordinance assessing a citation fine of $150.00 and an additional fine of $100.00 per day for each day the violation exists past May 13, 2011 also for a lien to be placed on the property if not satisfied by June 1, 2011. Code Supervisor Jeff Lariscy stated someone took care of the other violations such as drainage, erosion and tree issues. The aircraft is the only violation open at this time and Mr. Wiederhold owns the property and aircraft. No one was present for this case. MOTION CARRIED UNANIMOUSLY, OTHER BUSINESS: None at this time. CODE COMPLIANCE REPORT: Code Supervisor Jeff Lariscy gave a brief compliance report. Supervisor Lariscy states that the Code Enforcement Division currently has three volunteers, with our newest volunteer Faye Caddell performing the administrative duties. In comparison, the Code Enforcement Division stats for April 2010 of 25 notices of Code Enforcement Board Minutes May 12,2011 Page 7 violation and 10 citations compared to April 2011 with 81 notices of violation and 11 citations were issued. Supervisor Lariscy states that the next step will be issuing courtesy notices for occupied dwellings on a case by case scenario. PUBLIC COMMENT: BOARD DISCUSSION: Mr. Wagner announced that he would not be available for next month meeting.
