Chairman Garthwaite called to order the regular meeting of the Planning and Zoning Board at
6:30 p.m., November 14, 2001 in the Community Center, 102 N. Riverside Drive, Edgewater,
Florida.
ROLL CALL
Members present were Mr. Masso, Ms. Pluscec, Mr. Mullen, Mr. Vopelak, Chairman
Garthwaite, Mr. Heeb, and Mrs. Zeese. Also present were Darren Lear, Chief Planner and Pat
Drosten, Board Coordinator.
APPROVAL OF MINUTES
Mr. Masso made a motion to approve the minutes of September 9, 2001 as read. Mr. Mullen
seconded. Motion PASSED 7-0. Chairman Garthwaite made an announcement that item V A-
0110 would be tabled until the December 12, 2001 meeting at the request of the authorized
agent. Mr. Garthwaite asked the Board if they wished to continue receiving draft ordinances in
the agenda packets. After some discussion, the consensus of the Board was that they did not
wish to receive the draft ordinances in the future.
OLD BUSINESS
1. CPA-OI04 (a) thru CPA-OI04 (I) - Amend the City's Comprehensive Plan Future
Land Use Map by designating future land use classifications for the following small
scale amendments:
a. Barry property (SR 442) 10 acres -from County Urban Low Intensity to City
Commercial. Mr. Heeb asked ifwhat they were voting on tonight was simply to
change the Land Use from a County designation to a city designation due to the
annexation of these properties. Mr. Lear indicated that was correct. Chairman
Garthwaite summarized the staff report and opened the public hearing. Mr. Heeb
asked if any improvements have been made to this property. Mary Hanson, of
Storch, Hanson, and Morris, representing the Barry's stated that the front portion
of the property has been cleared and that her clients were in support of the
proposed land use designation. Chairman Garthwaite closed the public hearing.
Mr. Mullen made a motion to send a favorable recommendation to Council for
CPA-OI04 (a). Mr. Heeb seconded. Motion PASSED 7-0.
b. Johnson-Heybum property (Flying M Court) 1.72 acres - from County
Rural to City Low Density Transition. Chairman Garthwaite summarized the
staff report and opened the public hearing. No questions from the Board or from
the public. Chairman Garthwaite closed the public hearing. Mr. Masso made a
motion to send a favorable recommendation to Council for CPA-0104 (b). Mr.
Mullen seconded. Motion PASSED 7-0.

c. South Volusia Properties (U.S. 1, S. of Silver Circle) 5.50 acres - from
County Commercial to City Commercial Chairman Garthwaite summarized
the staff report and opened the public hearing. No questions from the Board or
from the public. Chairman Garthwaite closed the public hearing. Mr. Vopelak
made a motion to send a favorable recommendation to Council for CPA-OI04(c).
Mr. Mullen seconded. Motion PASSED 7-0.
d. Gentry (San Remo-Swordfish Lane) .34 acre - from County Urban Low
Intensity to City Low Density Residential Chairman Garthwaite summarized
the staff report and opened the public hearing. No questions from the Board or
from the public. Chairman Garthwaite closed the public hearing. Mr. Mullen
made a motion to send a favorable recommendation to Council for CPA-OI04 (d).
Ms. Pluscec seconded. Motion PASSED 7-0.
e. O'Dwyer (2576 S. Ridgewood) .90 acre - from County Commercial and
Urban Low Intensity to City Commercial Chairman Garthwaite summarized
the staff report and opened the public hearing. No questions from the Board or
from the public. Chairman Garthwaite closed the public hearing. Mr. Heeb made
a motion to send a favorable recommendation to Council for CPA-OI04 (e). Mr.
V opelak seconded. Motion PASSED 7-0.
f. Carson (2751 Alamanda) 2.71 acres - from County Urban Low Intensity to
City Low Density Residential. Chairman Garthwaite summarized the staff report
and opened the public hearing. No questions from the Board or from the public.
Chairman Garthwaite closed the public hearing. Mr. Masso made a motion to
send a favorable recommendation to Council for CPA-OI04 (t). Mr. Mullen
seconded. Motion PASSED 7-0.
g. Beckwith (2753 Alamanda) 2.21 acres - from County Urban Low Intensity to
City Low Density Residential Chairman Garthwaite summarized the staff report
and opened the public hearing. No questions from the Board or from the public.
Chairman Garthwaite closed the public hearing. Mr. Masso made a motion to
send a favorable recommendation to Council for CPA-OI04 (g). Mr. Mullen
seconded. Motion PASSED 7-0.
h. Moore (2759 Alamanda) .50 acre - from County Urban Low Intensity to City
Low Density Residential Chairman Garthwaite summarized the staff report and
opened the public hearing. No questions from the Board or from the public.
Chairman Garthwaite closed the public hearing. Mr. Masso made a motion to
send a favorable recommendation to Council for CPA-OI04 (h). Mr. Mullen
seconded. Motion PASSED 7-0.

to City Low Density Residential Chairman Garthwaite summarized the staff
report and opened the public hearing. No questions from the Board or from the

motion to send a favorable recommendation to Council for CPA-0104 (i). Mr.

J. Seymour Smith property (U.S. 1, S. of 28th St.) 3.56:1:: acres - from County
Commercial and Urban Low Intensity to City Commercial. Chairman
Garthwaite summarized the staff report and opened the public hearing. Mr. Buck
Walker, 174 Bianca Lane, asked if this property would take in Bianca Lane. Mr.
Lear stated that the properties on either side of Bianca land had been annexed into
the City, however, the property to the west of the Smith/Storch properties was still
in the County. Mr. Walker stated that that was his property and he just wanted to
make sure that his access would not be affected. Mr. Lear stated it would not.
Chairman Garthwaite closed the public hearing. Mr. Mullen made a motion to
send a favorable recommendation to Council for CPA-OI04 0). Mr. Vopelak
seconded. Motion PASSED 7-0.
k. Bella Vista Baptist Church (3232 S. Ridgewood) 4.98 acres - from County
Commercial and Urban Low Intensity to City Public/Semi-Public. Chairman
Garthwaite summarized the staff report and opened the public hearing. No
questions from the Board or from the public. Chairman Garthwaite closed the
public hearing. Mr. Heeb made a motion to send a favorable recommendation to
Council for CPA-OI04 (k). Mr. Mullen seconded. Motion PASSED 7-0.
1. Lynne Storch property (U.S. 1, S. of 28th St.) 2.10:1:: acres - from County
Commercial and Urban Low Intensity to City Commercial. Chairman
Garthwaite summarized the staff report and opened the public hearing. No
questions from the Board or from the public. Chairman Garthwaite closed the
public hearing. Mr. Masso made a motion to send a favorable recommendation to
Council for CP A-0104 (1). Mr. V opelak seconded. Motion PASSED 7-0.
2. RZ-0104 (a) thru RZ-0104 (I) - Rezoning of property associated with the
Comprehensive Plan Amendments (CPA-OI04a-h).
a. Barry property (SR 442) 10 acres - from County RC (Resource Corridor) to
City B-3 (Highway Commercial). Chairman Garthwaite summarized the staff
report and opened the public hearing. Ms. Pluscec asked for clarification of lot
dimension requirements when changing zoning designations from County to City.
Mr. Lear explained that each property has been reviewed individually and that
they meet the minimum lot dimensions required by the Land Development Code
for the requesting zoning designation. Chairman Garthwaite closed the public
hearing. Mr. Mullen made a motion to send a favorable recommendation to
Council for RZ-OI04 (a). Mrs. Zeese seconded. Motion PASSED 7-0.

(Transitional Agricultural) to City RT (Rural Transitional) Chairman
Garthwaite summarized the staff report and opened the public hearing. No

to Council for RZ-OI04 (b). Mr. Mullen seconded. Motion PASSED 7-0.

Mr. Heeb asked about the wording in the staff report concerning environmental
issues. Mr. Lear stated that there are no known environmental issues associated
with this property. Mr. Vopelak asked that in the future the staff reports be
worded in such a way as to not cause this confusion. Mr. Heeb also asked about
zoning on adjacent properties. Mr. Lear explained the adjacent zoning. Chairman
Garthwaite closed the public hearing. Mr. Heeb made a motion to send a
favorable recommendation to Council for RZ-OI04 (c). Mr. Vopelak seconded.
Motion PASSED 7-0.
d. Gentry (San Remo-Swordfish Lane) .34 acre - from County R-3 (Urban
Single Family Residential) to City R-2 (Single Family Residential). Chairman
Garthwaite summarized the staff report and opened the public hearing. Mr. Heeb
asked if the ownership of this property has changed. Mr. Lear stated that San
Remo properties had purchased the property and the change in ownership would
be reflected when sent to Council. Chairman Garthwaite closed the public
hearing. Mr. Mullen made a motion to send a favorable recommendation to
Council for RZ-OI04 (d). Mrs. Zeese seconded. Motion PASSED 7-0.
e. O'Dwyer (2576 S. Ridgewood) .90 acre - from County B-4 (General
Commercial) and MH-5 (Urban Mobile Home) to City B-3 (Highway
Commercial). Chairman Garthwaite summarized the staff report and opened the
public hearing. Mr. Heeb as if the existing Mobile Home on this property was
permitted. Mr. Lear stated that it would be a non-conforming structure under the
proposed zoning designation and that if it were removed or destroyed, the
property would be subject to the code in effect at that time. Chairman Garthwaite
closed the public hearing. Mr. Vopelak made a motion to send a favorable
recommendation to Council for RZ-OI04 (e). Mr. Masso seconded. Motion
PASSED 7-0.
f. Carson (2751 Alamanda) 2.71 acres - from County R-3 (Urban Single Family
Residential) to City R-1 (Single Family Residential). Chairman Garthwaite
summarized the staff report and opened the public hearing. Mr. Heeb asked for
information about the properties adjoining this property (i.e., location and access).
Chairman Garthwaite and Mr. Lear gave some background on these properties.
Chairman Garthwaite closed the public hearing. Mr. Mullen made a motion to
send a favorable recommendation to Council for RZ-OI04 (t). Mr. Heeb
seconded. Motion PASSED 7-0.

3. AN-0118 - City Wellfield - Chairman Garthwaite read the staff report and asked
about the proposed use of the property. Mr. Lear stated that the City has plans for
future wells; however, it was not needed for capacity at the present time. Chairman
Garthwaite opened the public hearing. No questions or comments from the public or
the Board. Chairman Garthwaite closed the public hearing. Mr. V opelak made a
motion to send a favorable recommendation to Council for AN-0118. Mr. Mullen
seconded. Motion PASSED 7-0.
4. V A-OllO - Luis Geil, authorized agent for Shiny Brite Carwash. Tabled until
12/12/01 meting at the request of the authorized agent.
5. V A-0111 - Carol Grasso, owner. Chairman Garthwaite read the staff report and
opened the public hearing. Mr. Heeb asked how long the current owner had owned
the property. Mr. Lear informed him since July. No questions or comments from the
public. Chairman Garthwaite closed the public hearing. Mr. Garthwaite went over

the criteria (findings of fact) and the consensus of the Board was that the request met
the criteria. Mr. Mullen made a motion to send a favorable recommendation to
Council for VA-DIll. Mrs. Zeese seconded. Motion PASSED 7-0.
DISCUSSION ITEMS
1. Planning Director' Report
No report at this time. Mr. Lear stated that he was looking forward to working with the
Board.
2. Chairman's Report
Chairman Garthwaite reminded everyone that Board elections would be held at the
January meeting.
3. Agency Member's Report
None at this time
