ITEM DESCRIPTION:
Ann McFall, Supervisor of Elections, will be making a presentation regarding concerns that have
been brought about due to the 2005 Legislative changes/requirements relating to City Elections.
BACKGROUND:
Since our City elections are held in odd numbered years along with 16 other V olusia County
cities it was a challenge to hold our October and November 2007 City elections. Ms. McFall has
expressed that with the changes becoming effective on July 1, 2008 it will be nearly impossible
to hold our elections in 2009.
STAFF RECOMMENDATION:
Former City Clerk Susan Wadsworth recommended the City Council look into Scenario #3,
which would put our City elections back in even numbered years. This change would require
City Council to ask the Legislature for an appeal of Chapter 95-462, which placed our elections
in odd numbered years. Scenario #3 also states that the only cost to the City would be if a
recount would be required and/or if additional ballot pages would be needed, both of which
would be at minimal cost to the City. If Council decides to go with Scenario #3, there would be
a significant cost savings. The total cost for the 2007 Elections was $22,503.56, excluding legal
advertisements, which are the City's responsibility.
If City Council decides to repeal Chapter 95-462, they will be required to make appropriate
changes to the Charter. There are a number of sections that will be affected if Council goes with
Scenario #3. Former City Clerk Wadsworth suggested that the Charter Review Committee be re-
established as soon as possible, bringing their recommendations back to Council in a timely
manner.
ACTION REQUESTED:
Motion to approve Scenario #3 and to re-establish the Charter Review Committee to suggest
appropriate changes that would need to be made to the Charter, bringing back their
recommendations to Council in a timely manner.

Chapter 95-462 (As Amended by Chap. 98-506)
As promised at the Municipal Elections meeting that was held at my office on January 14,2008, I
would like to offer the following information so that you may share with your elected body.
The Department of Elections will no longer be able to offer Elections 28 days apart beginning
with the 2009 Election Year. While 2007 proved to be difficult because of increased security,
ballot ordering the day after the first election, 10 day contest of election, early voting
requirements, etc., it will be impossible due to increased requirements from the State Division of
Elections. There is a change effective July 1, 2008. Per F.S. 101.591, an audit of each election
will be required. Although the specifics are still being developed by the State, it is becoming
apparent that each canvassing board will be required to perform an audit of at least 1 % and not
more than 2% of precincts chosen at random. This is not one audit of the election. It is 16 audits if
all cities have an election. And, it has to be completed for each election. The audit for October,
2009 must be completed before the November, 2009 election. The canvassing board must be
present when the audit is performed.
There are several scenarios to address the issue of odd number year elections.
· SCENARIO #1: Have the first election the same as in even numbered years, per F.S. 100.061;
"... A primary election for nomination of candidates shall be held on the Tuesday 9 weeks prior to
the general election."
· SCENARIO #2: Schedule Elections in even numbered years. Per 95-462, Sec. 7:A
municipality may, by ordinance and without referendum, exempt itself from the provisions of this
act provided, however, that the ordinance effecting such exemption be approved prior to March I
of any given year.
· SCENARIO #3: Have the first election the same as in even numbered years, per F.S. 100.061,
and assign the canvassing activity to the County Canvassing Board. This will recognize the
election as I election for auditing purposes instead of 16 elections on one day.
As a result of the Municipal Elections meeting, the following ideas were offered:
· SCENARIO #4: Continue to hold elections in odd numbered years and amend each city
charter to use the County Canvassing Board to canvass. As was mentioned in Scenario #3, this
would be considered 1 election instead of 16 individual elections.
· SCENARIO #5: Lengthen the time between elections in odd numbered years. The suggestion
was 60 days between elections.

Please review the attached letter from Ann McFal~ Supervisor of Election expressing concerns that have been
brought about due to 2005 legislative changeslrequirements. As outlined in her letter since our City elections are held in
odd numbered years along with 16 other Volusia County cities it was a challenge to hold our October and November,
2007 city elections but we got through them. Ms. McFall has expressed that with the changes becoming effective on
July 1,2008 it will be nearly impossible for us to hold our elections in 2009.
She has included the challenges that she bas fuced and still facing due to the Legislative changes and
requirements of2oo5. Ms. McFall has listed 3 different scenarios addressing these issues. I have reviewed all of the
scenarios and would recommend that the City Council look into scenario #3 which would put our City elections back in
even numbered years. This change would require the City Council to ask the Legislature to repeal Chapter 95-462 which
placed our election in odd numbered years. Scenario #3 also states the only cost to the city would be ifwe would require
a recount and lor ifadditionaI ballot pages would be needed both of which would be minimal cost to the city. If the
Council decides to go with scenario #3 there would be a significant cost saving. The cost of our October 2007 and
November 2007 election was $22,503.56 excluding election legal advertisements, which cost are the city's
responsibility.
Ms. McFall has staled that she is willing to attend a City Council meeting to make a presentation and answer
any qUeslion you may have on this important issue.
The City will be required to make appropriate changes to the Charter if you decide to repeal 95-462. They're a
number of sections in the Charter that will be affected if you elect to choose scenario #3. I would suggest that the
Charter Review committee be re-established as soon as possible. The Committee will need to review all the sections that
will be affected by this repeal and bring back their recommended revisions to the City Council in a timely manner. The
Council in turn would need to hold required public hearings and hopefully, a Special election could be called and held in
conjunction with the 2008 full elections were the revisions could be presented to voters.
Please keep in mind the importance of keeping the citizens infonned of this process.

Dear Susan:
Now that the 2007 election season is complete, I believe it is time to further discuss the issue of.
elections being scheduled 28 days apart per F.S. Chapter 95-462 (as amended by Chapter 98-506).
At the City Clerks initial meeting held on January 5, 2007 it was brought to everyone's attention
that it was going to be difficult for the Department of Elections to provide services to 16 cities
because of legislative changes/requirements since 2005. Among those challenges mentioned were as
follows:
1. Increased .security Requirements. '
2. Chal1ges in Provisional& Absentee Ballot Requirements
3. The' 10 day contest of electiol1does not begin: until AFTER the city
commission/council meets to certify the Election. Consequently, all memory cards,
security bags, etc. are secured and locked until after the 10 day contest of
elections expires. The equipment cannot be re used or re programmed for the next
election.
4. Logic and Accuracy (100%) testing now takes a week for each election, with double
the equipment compared to 2005.
5. Ballot ordering for the first election is done the last day of qualifying. Ballot
ordering for the next election is done the day after the first election.
6. All poll workers MUST have training before each Election (this includes up to 1,000
poll workers).
While 2007 proved to be difficult, 2009 will be next to impossible. There is a change effective July
1, 2008. Per F.S. 101.591, an audit of each election will be required. Although the rule is still being
developed by the State, it is becoming apparent that each canvassing board will be required to
perform an audit, of at least 1'7'0 and' not more than 2'7'0 of precincts chosen at random. Let me be
clear. This is not one audit of the election. It is 16 audits if all cities have an election.

This has to be completed no later than 11:59 pm on the 7th day following certification and it has to
be done by the canvassing board. This will require the canvassing board to come back to the
Department of Elections to complete this process.
There are several scenarios to address the issue of odd numbered year elections.
Scenario #1:
Have the first Election in 2009 according to the guidelines for elections in even numbered years.
F.S. 100.061 calls for the first election to be 10 weeks prior to the general election. The general
election in even numbered years is the first Tuesday after the first Monday in November. This
would require changing the qualifying period for all candidates.
Scenario #2:
Have the first Election in 2009 8 weeks prior to the general election. This will give the municipal
canvassing boards and the Department of Elections more time to address the audit requirement.
This would require changing the qualifying period for all candidates.
Scenario #3:
No Election will be held in odd numbered years. This could be accomplished by asking the
Legislature to repeal Chapter 95-462 and/or each municipality makes a charter change. All
elections could be held according to Florida Statute 97-106. The canvassing of the election will be
done by the county canvassing board as compared to 16 individual canvassing boards. The only cost
to your city would be if there is a recount, or if the city election causes an extra page ballot to be
created.
In conclusion, I enjoyed working with you during the 2007 Election cycle. Your professionalism was
greatly appreciated by all of us at the Department of Elections. If you would like me to attend a

CHAPTER 95-462.

Section 1. Legislative intent.--It is the intent of the Legislature to provide for
uniform filing and election dates for all municipal elections to elect municipal officers in
V olusia County. It is not the intent of the Legislature to determine the length of terms of
municipal officers.
Section 2.
(1) Any election relating to a municipal office shall be held in each odd-numbered year as
follows:
(a) The first election designated for a municipality shall be held 28 days prior to the first
Tuesday after the first Monday in November of each odd-numbered year.
(b) The second election designated for a municipality shall be held the first Tuesday after
the first Monday in November of each odd-numbered year.
(2) Municipalities which require annual elections for officers of their governing bodies may
also hold their elections as follows:
(a) In each odd-numbered year, the first election designated for the municipality shall be
held on a date that would be established by the Florida Election Code for the first primary
if it were in an even-numbered year.
(b) In each odd-numbered year, the second election designated for a municipality shall be
held 28 days prior to the first Tuesday after the first Monday in November of each odd-
numbered year.
(c) In even-numbered years, the first election designated for a municipality shall be held on
the date established by the Florida Election Code for the first primary.
(d) In even-numbered years, the second election designated for the municipality shall be
held on the date established by the Florida Election Code for the second primary.
(3) For purposes of this section, when a primary and general election are provided for they
shall be the first and second elections, respectively. When a general and runoff election are
provided for they shall be the first and second elections, respectively. Any other required
or permitted municipal election shall be scheduled in accordance with law.
However, the Supervisor of Elections, after consultation with the affected municipalities,
may change any election date in order to avoid a conflict with a religious holiday.

Section 3.
(1) Candidates for an elected municipal office in Volusia County to be elected under the
schedule provided in section 2(1) shall file such papers and pay such fees as may be
required by law with the applicable municipal clerk during normal business hours between
9 a.m. on the 71st day and 12 noon on the 61st day prior to the first Tuesday after the first
Monday in November of each odd-numbered year.
(2) Candidates for an elected municipal office in V olusia County to be elected under the
schedule provided in section 2(2)(a) and (b), shall file such papers and pay such fees as may
be required by law with the applicable municipal clerk during an ll-day period ending
simultaneously with the time period established by the Florida Election Code for qualifying
for the general election if it were an even-numbered year.
(3) Candidates for an elected municipal office in V olusia County to be elected under the
schedule provided in section 2(2)(c) and (d), shall file such papers and pay such fees as may
be required by law with the applicable municipal clerk during an ll-day period ending
simultaneously with the time period established by the Florida Election Code for qualifying
for the general election.
(4) The names of all candidates and the offices for which they have filed shall be received
by the Supervisor of Elections from the municipal clerks by 5 p.m. on the next business day
after the close of qualifying.
Section 4. M;unicipal officers elected pursuant to this act shall take office no later
than the second Tuesday after the first Monday in January.
Section 5. Initially, any officer whose term of office expires in an odd-numbered
year shall stand fo~ reelection in that year. Initially, any officer whose term of office
expires in an even-numbered year before March 1 shall stand for reelection in the
preceding year, and any officer whose term of office expires in an even-numbered year on
or after March 1 shall stand for reelection in the following year. Officers who sit on
governing bodies with overlapping terms shall stand for reelection in the year in which
their term expires. The provisions of this section shall apply only to the first election for
each office to be held under the provisions of the act. Thereafter, the length of terms of all
municipal offices shall correspond to the length set by the municipal charter. However, the
commencement and expiration of terms of office shall be at times consistent with the dates
provided pursuant to this act.
Section 6. Unless otherwise provided in accordance with this section, the Florida
Election Code shall apply to the administration of absentee ballots for municipal elections.
The Supervisor of Elections shall administer absentee ballots for a municipality which so
requests. A municipality may adopt by ordinance and administer its own procedures for
absentee ballots. If a municipality administers absentee ballots, the municipal clerk shall
fulfill the functions assigned the Supervisor of Elections by the Florida Election Code.

Section 7. The provisions of this act shall supersede any conflicting municipal
charter provisions to the extent of any conflict; however, the governing body of any
municipality may exempt itself from the provisions of this act by adopting an ordinance
declaring its exemption with 60 days after the effective date of this act or within 60 days
after the effective date of its charter. Also the governing body of any municipality may, by
ordinance and without referendum, amend its municipal charter to conform with the
provisions of this act. A municipality may, by ordinance and without referendum, exempt
itself from the provisions of this act provided, however, that the ordinance effecting such
exemption must be approved prior to March 1 of any given year.
Section 8. This act shall take effect May 15, 1995, or upon becoming a law,
whichever occurs later.

OF UNIFORM DATES
· In 1994 SOE set up a meeting with City clerks, managers,
and attorneys and tossed out the idea of a uniform
schedule of elections. The current system was a mess and
the DOE was forever having to deal with January through
December elections.
· Initial reaction was a bit negative-they all wanted their
own special date.
· Began meeting monthly to discuss the idea. SOE also met
with the editorial boards.
· It took close to a year of meetings until an agreement was
reached. The longest was figuring out what dates would be
the best.
· One of the trickiest parts in initiating the change was to
make sure the change-over to the new schedule did not cut
any city commissioner's term short. In almost all cases, it
lengthened terms of sitting commissioners...some as much
as a year.

· The legislative delegation sponsored a local bill to
get the special act approved. It mandated that all city
charters would automatically be changed to reflect
the change in election dates...UNLESS the city opted

· Though every city sent a letter of support for the bill
to the legislature, some did so with the
understanding that they would opt out to begin with,
to see how things went.
· The act also made it possible for cities to opt out in
the future, as long as they did so by March of any
given year (this was so that the ones left in could
know how much to budget for elections).
· This idea started with 4 cities, but over a two year
period, the rest came aboard.

Section 1. Legislative intent.--It is the intent of the Legislature to provide for
uniform filing and election dates for all municipal elections to elect municipal
officers in Volusia County. It is not the intent of the Legislature to determine
the length of terms of municipal officers.
Section 2.
(1) Any election relating to a municipal office shall be held in each odd-
numbered year as follows:
(a) The first election designated for a municipality shall be held 28 days prior to
the first Tuesday after the first Monday in November of each odd-numbered
year.
(b) The second election designated for a municipality shall be held the first
Tuesday after the first Monday in November of each odd-numbered year.
(2) Municipalities which require annual elections for officers of their governing
bodies may also hold their elections as follows:
(a) In each odd-numbered year, the first election designated for the
municipality shall be held on a date that would be established by the Florida
Election Code for the first primary if it were in an even-numbered year.
(b) In each odd-numbered year, the second election designated for a
municipality shall be held 28 days prior to the first Tuesday after the first
Monday in November of each odd-numbered year.
(c) In even-numbered years, the first election designated for a municipality
shall be held on the date established by the Florida Election Code for the first
primary.
(d) In even-numbered years, the second election designated for the
municipality shall be held on the date established by the Florida Election Code

· (3) For purposes of this section, when a primary and
general election are provided for they shall be the
first and second elections, respectively. When a
general and runoff election are provided for they

Any other required or permitted municipal election

· However, the Supervisor of Elections, after
consultation with the affected municipalities, may
change any election date in order to avoid a conflict
with a religious holiday.

Section 3.
(1) Candidates for an elected municipal office in Volusia County to be elected under the
schedule provided in section 2(1) shall file such papers and pay such fees as may be
required by law with the applicable municipal clerk during normal business hours
between 9 a.m. on the 71st day and 12 noon on the 61st day prior to the first Tuesday
after the first Monday in November of each odd-numbered year.
(2) Candidates for an elected municipal office in Vol usia County to be elected under the
schedule provided in section 2(2)(a) and (b), shall file such papers and pay such fees
as may be required by law with the applicable municipal clerk during an 11-day period
ending simultaneously with the time period established by the Florida Election Code
for qualifying for the general election if it were an even-numbered year.
(3) Candidates for an elected municipal office in Vol usia County to be elected under the
schedule provided in section 2(2)(c) and (d), shall file such papers and pay such fees
as may be required by law with the applicable municipal clerk during an 11-day period
ending simultaneously with the time period established by the Florida Election Code
for qualifying for the general election.
(4) Municipal officers elected pursuant to this act shall take office no later than
the second Tuesday after the first Monday in January.

Section 5. Initially, any officer whose term of office expires in an odd-
numbered year shall stand for reelection in that year. Initially, any officer
whose term of office expires in an even-numbered year before March 1 shall
stand for reelection in the preceding year, and any officer whose term of office
expires in an even-numbered year on or after March 1 shall stand for reelection
in the following year. Officers who sit on governing bodies with overlapping
terms shall stand for reelection in the year in which their term expires. The
provisions of this section shall apply only to the first election for each office to
be held under the provisions of the act. Thereafter, the length of terms of all
municipal offices shall correspond to the length set by the municipal charter.
However, the commencement and expiration of terms of office shall be at times
consistent with the dates provided pursuant to this act.
Section 6. Unless otherwise provided in accordance with this section, the
Florida Election Code shall apply to the administration of absentee ballots for
municipal elections. The Su~rvisor of Elections shall administer absentee
ballots for a municipality which so requests. A municipality may adopt by
ordinance and administer its own procedures for absentee ballots. If a
municipality administers absentee ballots, the municipal clerk shall fulfill the
functions assigned the Supervisor of Elections by the Florida Election Code

Section 7. The provisions of this act shall supersede any conflicting municipal
charter provisions to the extent of any conflict; however, the governing body of
any municipality may exempt itself from the provisions of this act by adopting
an ordinance declarmg its exemption within 60 days after the effective date of
this act or within 60 days after the effective date of its charter. Also the
governing body of any municipality may, by ordinance and without referendum,
amend its municipal charter to conform with the provisions of this act. A
municipality may, by ordinance and without referendum, exempt itself from the
provisions of this act provided, however, that the ordinance effecting such
exemption must be approved prior to March 1 of any given year.
Section 8. This act shall take effect May 15,1995, or upon becoming a law,
whichever occurs later.

· The 10 day contest of election does not begin until AFTER
the city commission/council meets and certifies the
Election.
· All memory cards, security bags, etc. are secured and
locked until after the 10 day contest of elections expires.
This equipment cannot be re used or re programmed for
the November Election per security procedures.
· Logic and Accuracy (1000/0) testing now takes several
days, with double the equipment the DOE had compared to
the testing of 2005.
· Ballot ordering for the November Election must be made
the day after the October Election in order to receive the
ballots in time for Early Voting. Ballot ordering, includes an
audio ballot for the touch screen units.
· All poll workers must come in for a 3 hour training update
during this 28 day time period.
· Overtime must be paid for by the municipalities.

· By 5:00 pm on the last day of qualifying, I send to the city
clerk a ballot proof. He/she sends it back that evening. I
then send the order to the vendor that evening or by 8:00
am the next morning.
· For the general/run off election in November, I need to
send the ballot proof to the city clerk the day after the
October election and he/she sends it back that same day.
NOTE:
It's bound to happen. A close October race and we don't
know who should be on the ballot for November. This is
one ballot order being sent for all cities.
With qualifying so close to the election, I have to schedule
poll workers for all municipal precincts BEFORE qualifying
ends.
35 DAY RULE

· Within 35 days after the date of a municipal
election or runoff, whichever occurs later, a
presidential preference primary, or a
general election, the supervisor of elections
shall file with the Department of State
precinct-level election results for that
election cycle, including any primary
elections. Precinct-level election results

ballots cast at the precinct location to which
have been added the returns of absentee
and early ballots cast by voters registered in
the precinct.

A. Shawn Collins - Ghyabi & Associates, will present a summary of the recently completed South East V olusia
Regional Transportation Study.
Mr. Collins will review the following areas:
. Population and employment projections (2015 and 2025),
. The existing plus committed roadway network (the 2015 and 2025 roadway needs plan),
. The 2015 and 2025 list of roadway improvements (the actual regional plan).
BACKGROUND
In 2006, the Cities of Edgewater, Port Orange, New Smyrna Beach and V olusia County agreed to partner and
complete a regional transportation study, identifying deficiencies and developing a "fair-share" funding
program.
The study area of this travel demand forecasting model is limited to the north by State Road 400 (Beville
Road), east to the Atlantic Ocean, south to Ariel Road and west to State Road 415.
Ghyabi & Associates, Inc. has been contracted to work closely with the study partners of the City of
Edgewater, the City of Port Orange, City of New Smyrna Beach, Volusia County, the Volusia County
Metropolitan Planning Organization (MPO) and the Florida Department of Transportation (FDOT) to complete
the Southeast Volusia Regional Transportation Study.
The study partners have collectively met with Ghyabi & Associates, Inc. ten (10) times to discuss the level
of analysis, the land use data and the schedule. The study partners and Ghyabi & Associates, Inc. met on
December 18,2007 to review the final Alternative Analysis (Scenario "I") of the study.

BACKGROUND:
The Florida Department of Law Enforcement, Office of Criminal Justice Grants is awarding the
Edgewater Police Department this grant to fund the project entitled, "Police and City Security".
A Duplex ID Card Printer and Fingerprint Capture machine will provide the ability to identifY
employees and control facility access in the case of an emergency.
The Streamlight Stinger LED Flashlight with AC & DC chargers will provide Officers with a
reliable light source when needed. This flasWight will last a lifetime and offers multiple lighting
modes, including strobe.
STAFF RECOMMENDATION:

There is no efficient method of identifying the personnel that need access to secure facilities.
The officers do not have lightweight, reliable, and powerful flashlights that provide high quality light
with extended runtime.
Project Summary
We will purchase an ID Card Printer and Fingerprint Capture machine. This machine will be used,
initially, to provide identification cards to Police Officers and personnel of the Police Department.
This will ensure that only Police personnel are allowed to access secure areas. Additionally, this
will provide positive identification, through finger print technology, of all Law Enforcement Officers.
We will purchase approximately 35 flashlights with chargers to provide officers with a flashlight that
provides excellent performance, reliability, light quality and runtime. These flashlights will replace
the out-dated, bulky Mag lights that the officers are currently utilizing. This will ensure that the
officer has a reliable light source that can be worn on their belt.

STAFF RECOMMENDATION
The Technical Review Committee has reviewed the application and recommends approval of the
special activities permit to allow Earthquake Magoon's to have an Annual Bike Week Oyster
Roast to be held March 7,2008, based on the following conditions:
1. Access must remain readily accessible to the rear of the building to allow emergency
vehicle access;
2. The occupant load of the assembly area may never be exceeded;
3. Daily fire, life safety and code inspections will be conducted throughout the duration of
the permit;
4. The applicant fully complies with Section 21-37 (Special Activity Requirements) of the
Land Development Code and Ordinance 2002-0-04 (Noise Ordinance);
5. No parking is permitted in public right-of-ways or in the site visibility triangle.

This letter is being submitted in reference to several matt~rs relevant to securing a Special
Activities Permit for our Biketoberfest Oyster Roast:
1) Earthquake Magoons Bar will supply any necessary personnel to facilitate parking during
the event and if Police Officers are required, we request their assistance from 6:00PM to
9:00PM Friday March 7th, 2008. If such police assistance occurs, we understand that we
will be billed for their services as we were during Bike Week 2006 and agree to pay the
fees.
2) All live music will be contained inside the building premises for the whole event.
3) I have this date a letter to the Park Plaza Homeowners's Association for their
consideration/action as to approval by all unit owners relating to our closing the easterly
sections of the parking lot immediately in front of and in the rear of our units. As soon as
such letter is returned signed, I will deliver it to your office.
4) I have this date hand carried the 500' Radius search request to the County with payment
and requested that search results to E-mailed to you directly.
5) I have contacted Brown & Brown Insurance and requested that a Certificate of Liability
Insurance indemnifying th4e City of Edgewater be faxed to you at 386-424-2439.
6) Please accept this letter as our agreement that should any additional services be provided
by the City of Edgewater (none having ever been previously necessary), to accommodate
our annual Bikeweek 2008 Oyster Roast, that the costs of those services will be

BACKGROUND:
Jamie Young's term on the Edgewater Animal Control Board expired on January 26,2008.
Jamie is willing to continue to serve on the Animal Control Board for an additional 3 years. Her
new term will run through January 26, 2011.
STAFF RECOMMENDATION:
Staff recommends the City re-appoint Jamie Young to the Animal Control Board.

Appointment to Oversight Committee for Public School Facility Planning.
BACKGROUND
The First Amendment to the Interlocal Agreement (ILA) for Public School Facility Planning was
executed on July 1, 2007. Per the lLA each municipality must appoint a citizen member to serve on
an Oversight Committee. The Committee shall monitor the implementation of the ILA, including the
school concurrency system. The Committee shall meet at least annually.
RECOMMENDATION
Staff recommends appointing Gigi Bennington to the Public Schools Facility Planning Oversight
Committee.

ITEM DESCRIPTION:
Animal Shelter Facility-
Rejecting all proposals submitted for the Public Safety Boulevard site
and authorization for Requests for Proposals on the Mango Tree
Drive site and for Requests for Proposals for the new Wastewater
Collections building.
BACKGROUND:
Advertisements for Invitation for Request for Proposal (#08-AS-Ol) City of Edgewater Animal
Shelter, located on Public Safety Boulevard were placed in the Orlando Sentinel and Daytona News-
Journal on October 28,2007 with responses due by December 4,2007. The Committee reviewed
the submitted Proposals and determined that McMahon Construction and Hall Construction were
the two firms for final negotiations.
Pursuant to Council action during the January 28,2008 Council meeting and the determination for
a new site on Mango Tree Drive, staff needs to reject all proposals currently submitted for the Public
Safety Boulevard and re-advertise for Requests for Proposals for the new location and additional
Requests for Proposals for the new Wastewater Collections building.
STAFF RECOMMENDATION:
Staff recommends rejection of all proposals submitted for the Animal Shelter Facility located on
Public Safety Boulevard and authorization for Requests for Proposals on the Mango Tree Drive site
and proposals for the new Wastewater Collections building.
ACTION REOUESTED:
Motion to approve the rejection of all proposals submitted on the Public Safety Boulevard site (#08-
AS-O 1) and authorize staff to prepare new Requests for Proposals for the Animal Shelter to be
located at the Mango Tree Drive site and Requests for Proposals on the new Wastewater Collections
building.
