A RESOLUTION OF THE CITY OF EDGEWATER,
FLORIDA, AUTHORIZING THE EXECUTION AND
SUBMITTAL OF AN APPLICATION TO THE FLORIDA
DEPARTMENT OF ENVIRONMENTAL PROTECTION
(FDEP) TO REDUCE THE PERMIT APPLICATION FEES
FOR THE TRANSFER STATION OPERATING PERMIT
RENEWAL FOR THE 2012 FISCAL YEAR; REPEALING
RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING
FOR SEVERABILITY AND APPLICABILITY AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, pursuant to the requirements contained in Chapter 218, Florida Statutes,
the City of Edgewater is hereby authorizing Staff to request and submit a reduction in permit
application fees for the Transfer Station Operation Permit Renewal for the fiscal year 2012 with
the Florida Department of Environmental Protection ("FDEP"), and;
WHEREAS, City Council authorizes the City Manager to execute all application
documents for the permit renewal; and
WHEREAS, upon review by FDEP and approval, the permit fee which is normally
$1,000.00 can be reduced to $100.00.
NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater,
Florida:
Section 1. The City Council hereby authorizes and directs the City Manager to
execute and submit the Request to Reduce Permit Application Fees for the Transfer Station
Operating Permit Renewal and any associated documents to the Florida Department of
Environmental Protection("FDEP"). A copy of the Request is hereby attached and incorporated
herein as Exhibit"A".

Section 2. Conflicting Provisions. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
Section 3. Severability. If any portion of this resolution is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining
portions of this resolution. If this resolution or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such holding shall not affect its
applicability to any other person, property or circumstance.
Section 4. Adoption and Effective Date. This resolution shall take effect upon
adoption.

The undersigned hereby certifies that the above local government meets the population requirements of
Section 218.075, F.S., and:
® Is the applicant for a public purpose project for which this fee reduction is sought; and
® Qualifies for permit processing fee reduction for the 2012 fiscal year due to one or more of the
following factor(s):
® The per capita taxable value is less than the statewide average for the current fiscal year;
❑ The percentage of assessed property value that is exempt from ad valorem taxation is higher
than the statewide average for the current fiscal year;
❑ A condition specified in Section 218.503, F.S.,that determines a state of financial
emergency;
n Ad valorem operating millage rate for the current fiscal year is greater than 8 mills; or
❑ A financial condition that is documented in annual financial statements at the end of the
current fiscal year and indicates an inability to pay the permit processing fee during that
fiscal year.
The above factors are supported by one of the following :
® A copy of an official resolution by the governing body of the county or municipality, or
❑ A copy of the official minutes of the governing body of the county or municipality in which
the above factors have been affirmed.
Based on this certification,the ®Department of Environmental Protection❑Northwest Florida Water
Management District is hereby requested to reduce the permit application fee for the above public purpose
project to$100 per permit,or, if the application fee is less than$100,to waive the fee.
