1. CALL TO ORDER
Chairman Vopelak called to order the Regular Meeting of the Planning and Zoning Board at 6:30
p.m., September 17,2003 in the Community Center, 102 N. Riverside Drive, Edgewater, Florida.
2. ROLL CALL
Members present were Chairman Edwin V opelak, Robert Garthwaite, Kristine Pluscec, Donald
Masso and Anton Heeb and Charlene Zeese. Also present were Chief Planner Darren Lear and
Planning Technician Bonnie Wenzel.
3. OLD BUSINESS
PUBLIC HEARING
1. CU-0304- Charlie Lyons, authorized agent for AB Price Inc., and AB Price and Roswitha Maverty
requesting the Board amend their conditions placed on approval of a Conditional Use Permit to allow
outdoor storage in the B-2 (Neighborhood Business) zoning district at property located at India Palm
Drive and 31 st Street.
Mr. Lyons addressed the Board and stated he would prefer chain link fencing with slats along the rear of
the property. .
MOTION bv Mr. Garthwaite. SECOND bv Mr. Masso to remove the reouirement for a masonrY
wall facin~ the railroad tracks and allowin~ the installation of a chain link fence with slattin~.
MOTION PASSED 6-0
4. NEW BUSINESS
PUBLIC HEARING
1. AN-0303 - Dupuis and Jacobs at Edgewater LLC, owners requesting annexation of 6.82:1: acres of
property located east of US Highway 1, south ofCanaI Drive.
Rob Merrill, Cobb & Cole, stated he was representing the applicant and explained to the Board the
development proposed.
Robert Sheldrup, 107 Canal Drive, stated the vehicular headlights from this development will go straight
into his house, and that he felt Canal Drive could not handle the extra traffic the development will create.
Tadd Kasbeer, Zev Cohen & Associates, Engineer of record, described the development to the Board.
Mr. Robert Ritter stated he was interested in purchasing the property located at 3725 US Highway 1 and
had some questions regarding the area. Mr. Lear suggested Mr. Ritter come to the Planning Department
to discuss his issues.

Land Use Map amendment from Volusia County Urban Medium Density to City Low Density
Residential with Conservation Overlay for 6.85:1:: acres of property located east of US Highway 1 and
south of Canal Drive.
MOTION bv Mr. Heeb. SECOND hv Mrs. Pluscec to send a favorahle recommendation to City
Council to amend the Future Land Use man from Yolusia County Urhan Medium Densitv to City
Low Densitv Residential with Conservation Overlav for 6.85:1:: acres of nrooertv located east of US
Hig-hwav1 and south of Canal Drive.
MOTION CARRIED 6-0.
3. RZ-0308 - Dupuis and Jacobs LLC, owners requesting an Official Zoning Map amendment from
Volusia County R-4W (Urban Single Family Residential) and B-4W (General Commercial) to City
RPUD (Residential Planned Unit Development) for 6.85:1:: acres of property located east of US
Highway 1 and south of Canal Drive.
MOTION hv Mrs. Zeese. SECOND bv:Mr. Masso to send a favorable recommendation to City
Council to rezone 6.85:1:: acres of nrooe{1v located east of US Hig-hwav 1 and south of Canal Drive
from Yolusia County R-4W (Urhan Sing-Ie Familv Residential) and B-4W (General Commercial) to
City RPIID (R.eside~tial Planned Unit ~evelonment).
Mr. Garthwaite stated he does not agree with the RPUD designation for this area and would discuss the
reasons at a later time.
4. AN-0302- Dupuis and Jacobs at Edgewater LLC, authorized agent for Greg and Rose Hoffman,
owners, requesting annexation of 1.46:1:: acres of property located 3725 US Highway 1.
Rose Hoffman, owner, addressed the Board regarding this site.
MOTION hv Mr. Garthwaite. SECOND hv Mrs. Pluscec to send a favorahle recommendation to
City Council to annex 1.46:1:: acres of nronertv located at 3725 US Hiphwav 1.

Mr. Garth~aite spoke about how he did not necessarily agree with the way the City does PUD's.
Discussion ensued regarding development of PUD's. Mr. Heeb also voiced his opinion on the
subject, as did Mr. Vopelak.
