COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Code Enforcement Board to order at 2:00 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Ed Corn, Glenn Barnhill, Gail Anderson, Ben Wagner, Alice Haldeman and Sherry Lester. Also present were Code Officer Mike McGrath, Code Officer Dan Koehler, Code Supervisor Jeff Lariscy, Board Attorney Corey Brown and Board Coordinator Shontella Jackson. APPROVAL OF MINUTES The Minutes for the regular meeting of January 10, 2013 were presented to the Board for approval. MOTION by Ed Corn, SECOND by Glenn Barnhill to adopt the minutes of Regular Citizen Code Enforcement Board on January 10, 2013 as written. MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Steve Holmes of Holmes Auto Works 423 N. Ridgewood Ave., Edgewater, FL; Code Officer Mike McGrath, Code Officer Dan Koehler and Code Supervisor Jeff Lariscy were sworn in. Code Enforcement Board Minutes February 14,2013 Page 1 NEW BUSINESS: Code Supervisor Jeff Lariscy stated the following case will not be hear and is in compliance: Case #2013-CE-106731 (Repeat), 2924 Vista Palm Dr., Edgewater, Florida; Tanya Maria Sievert, Violation of Section 10-98 (Property maintenance) The Board approved an amendment to the agenda to move Case #2013-CE-105761 on the agenda to item#1. The Board members had no objections to the agenda amendment. Case#2013-CE-106879, 423 N. Ridgewood Ave., Edgewater, Florida; Anthony Lagano, Violation of Section 12-67 (c) (Service charges) Code Supervisor Jeff Lariscy presented the case summary to the Board. Code Supervisor Jeff Lariscy presented staff's recommendation to find Anthony Lagano tenant Holmes Auto Works in violation of Section 12-67 of the Code of Ordinances. Code Supervisor Jeff Lariscy stated that there were numerous false alarm calls to the above address. Code Supervisor Jeff Lariscy stated we received a letter from Mr. Holmes requesting a hearing for the violation. Steve Holmes owner of Holmes Auto Works stated that the initial alarm occurred after a mini storm in the area. Mr. Holmes stated he notified the alarm company. They came out and made some adjustments to the system. Mr. Holmes also stated that bike week caused the alarms to sound due to the noise/vibration of the bikes. Mr. Holmes stated his reason for asking for a waiver of fees is due to an act of nature. Since October 30`" no alarm problems have occurred and the issues have been resolved. Pursuant to Section 10-348 and 10- 345 subparagraph C of the Code of Ordinance and the statement that appears on the respected citation issued that failure to appear at this hearing the alleged violator has waived any right to contest the violation and that an order can be made against for the maximum applicable penalties that include but not limited to administrative costs, fines, daily fines and liens however we have the benefit of the staff recommendations, motion and actions to be taken by the Board. MOTION by Sherry Lester, SECOND by Gail Anderson to accept the findings and staff recommendation. MOTION CARRIED UNANIMOUSLY. OTHER BUSINESS: None. CODE COMPLIANCE REPORT: Code Supervisor Jeff Lariscy states the Code Enforcement Division has worked 107 code cases for the month of January. Code Supervisor Jeff Lariscy announced to the Board that Code Officer Dan Koehler is the new code officer and we will be having coverage seven days a week. PUBLIC COMMENT: None. BOARD DISCUSSION: Chairwoman Linda Johnson thanked Mr. Brown for his services on the Code Board.
