CALL TO ORDER
Chairperson Linda Johnson called the regular meeting of the Code Enforcement Board
to order at 2:02 PM in the Community Center.
ROLL CALL
Members present: Linda Johnson, Ed Corn, Glenn Barnhill, Gail Anderson, Ben
Wagner, Alice Haldeman and Sherry Lester. Also present were Code Officer Mike
McGrath, Code Officer Dan Koehler, Code Supervisor Jeff Lariscy, Board Attorney
Corey Brown and Board Coordinator Shontella Jackson.
APPROVAL OF MINUTES
The Minutes for the regular meeting of February 14, 2013 were presented to the Board
for approval. MOTION by Ed Corn, SECOND by Glenn Barnhill to adopt the
minutes of Regular Citizen Code Enforcement Board on February 14, 2013 as

NEW BUSINESS:
Code Supervisor Jeff Lariscy stated the following case will not be hear and is in
compliance: Case #2012-CE-105760, 236 N. Old County Rd., Edgewater, Florida; PC

Chairwoman Linda Johnson asked for clarification on some of the violation sections of
varies cases. A short review of definitions and examples on the following sections:
10-174 vacant/uninhabitable structure, 10-198 vacant/land structure, 21-54.02
installation standards and 10-171 unfit for human occupancy was provided by staff Mr.
Corn requested to hear the following cases: Case #2013-CE-106813 A & B, and Case
#2013-CE-106908. The Board had no objection to Mr. Corn requested.
Case #2013-CE-106813 A, 3012 Travelers Palm Dr., Edgewater, Florida; Nancee
Michaux Est, Violation of Section 10-174 (Vacant/uninhabitable structure)
Code Officer Mike McGrath presented the case summary to the Board. Code Officer
Mike McGrath presented staffs recommendation to find Nancee Michaux Est. in
violation of Section 10-174 of the Code of Ordinances accessing a$75.00 citation fine
and an additional fee of$50.00 per day for each day the violation exist past March 15,
2013; also for a lien to be placed on the property if not satisfied by March 20, 2013.

MOTION by Ed Corn, SECOND by Alice Haldeman that the Board finds Nancee
Michaux Est. in violation of Section 10-174 of the Code of Ordinances accessing a
$75.00 citation fine and an additional fee of$50.00 per day for each day the
violation exist past March 15, 2013; also for a lien to be placed on the property if
not satisfied by March 20,2013. NNOTION CARRIED 7-0.

Code Officer Dan Koehler presented the case summary to the Board. Code Officer Dan
Koehler presented staffs recommendation to find Christopher Dwayne McCay &
Valerie Townsend in violation of Section 10-171 of the Code of Ordinances accessing a
$75.00 citation fine and an additional fee of$250.00 per day for each day the violation
exist past March 15, 2013; also for a lien to be placed on the property if not satisfied by
March 20, 2013. Photographs of the property were shown.
MOTION by Alice Haldeman, SECOND by Sherry Lester that the Board finds
Christopher Dwayne McCay& Valerie Townsend in violation of Section 10-171 of
the Code of Ordinances accessing a $75.00 citation fine and an additional fee of

Chairperson Linda Johnson concluded with it appears after reviewing these cases no one
was present for any of the cases mentioned above. Pursuant to Section 10-348 and 10-
345 subparagraph C of the Code of Ordinance and the statement that appears on the
respected citation issued that failure to appear at this hearing the alleged violator has
waived any right to contest the violation and that an order can be made against for the
maximum applicable penalties that include but not limited to administrative costs, fines,
daily fines and liens however we have the benefit of the staff recommendations, motion
and actions to be taken by the Board. MOTION by Ben Wagner, SECOND by Ed
Corn to accept the findings and staff recommendation. MOTION CARRIED
UNANIMOUSLY.

CODE COMPLIANCE REPORT:
Code Supervisor Jeff Lariscy states the Code Enforcement Division has worked 106
code cases for the month of February.
