09-10-1992 t I 'w" ...., CITY OF EDGEWATER CITIZENS CODE ENFORCEMENT BOARD REGULAR MEETING THURSDA Y, SEPTEMBER 10, 1992 COMMUNITY CENTER 7:00 P.M. CALL TO ORDER: Chairman George Cowan called to order the regular meeting of the Citizens Code Enforcement Board at 7:00 p.m., Thursday September 10, 1992. ROLL CALL: Members present were Chairman George Cowan, Mrs. Borner, Mr. Schmidt, and Mrs. Delnigro. Also present were Code Enforcement Officer Beverly Kinney-Johnson, Mark P. Karet, Director of Community Development, Krista Storey, City Attorney, and Tonya Elliott, Secretary. Dr. Mason, Mrs. Strong, and Mrs. Cucanich were absent. APPROVAL OF MINUTES: Maureen Borner made a motion to accept the minutes of August 20, 1992. Seconded by Mr. Schmidt. Motion CARRIED 3-1. Chairman Cowan voted no as he was absent from the August 20, 1992 meeting. SWEARING IN OF WITNESSES: Chairman Cowan requested Beverly Kinney-Johnson, Code Enforcement Officer, and anyone else with statements or comments pertaining to any of the cases stand and be sworn in. There were no other witnesses. CASES IN COMPLIANCE: Beverly Kinney-Johnson, Code Enforcement Officer, reported the following cases in compliance or withdrawn: * 92-CE-0645 - Joseph D. Bellamy - In Compliance * 92-CE-0658 - Tony and Hope Pawlak - In Compliance * 92-CE-0678 - Elwood and Frances Sides, Jr. - In Compliance * 92-CE-0679 - Elwood and Frances Sides, Jr. - In Compliance * 92-CE-0680 - Elwood and Frances Sides, Jr. - In Compliance UNFINISHED BUSINESS: CASE #92-CE-0558 - Kenneth and Peggy Shultz - Signage on door of small building - not permitted in the R-1A Single-Family Residential District. Section 602.02(F). 'w' .."", Boxes and other items on property. Section 717.03. PVC pipe on property. Section 714.00. Code Enforcement Officer Bevelry Kinney- Johnson reported that on August 20, 1992, the Board issued an Order giving the violator until August 24, 1992 to abate the violations. Mrs. Johnson stated that Mr. Shultz submitted a letter requesting a 45 day extension to comply with the Board's Order. Mrs. Johnson recommended that the extension be denied since Mr. Shultz was given ample time to comply prior to the August 20, 1992 meeting. Mr. Schmidt, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 92-CE-0558 that a violation of the Edgewater Zoning Ordinance does exist and the alleged violator has committed the violation. After considering the gravity of the violation, and any action taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator not be given an extension to correct the violation. Seconded by Mrs. Borner. Motion CARRIED 3-1. Mrs. Delnigro voted no. NEW BUSINESS: CASE #92-CE-0668 - Pheobe Pyevac Lambert and Zora Pyevac - Weeds in excess of two (2) feet. Section 10-43. Repeat Violation. Code Enforcement Officer Beverly Kinney-Johnson reported that the violation was first observed on July 29, 1992. Mrs. Johnson stated that on January 16, 1992, the violators were found in violation of Section 10-43 on the same property. Mrs. Johnson reported that on July 31, 1992, a Notice of Repeat Violation and Hearing was issued. Upon reinspection of the property on September 10, 1992, Mrs. Johnson found that no corrective action had been taken. Mrs. Johnson recommended the violators be given until September 20, 1992 to correct the violation or a fine of thirty dollars ($30.00) per day be imposed. Mr. Schmidt, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 92-CE-0668 that a repeat violation of Section 10- 43 of the Edgewater Code of Ordinances has occurred and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and the previous violations committed by the violator, further moved that a fine of twenty dollars ($20.00) be imposed for each day the violation continues past September 10, 1992. Seconded by Mrs. Borner. Motion CARRIED 4-0. CASE #92-CE-0734 - Jimmy Owens - Weeds in excess of two (2) feet. Section 10- 43. Repeat violation. Code Enforcement Officer Beverly Kinney-Johnson reported that the violation was first observed on August 20, 1992. Mrs. Johnson stated that on March 19, 1992, the violator was found in violation of Section 10-43 on the same property. Mrs. Johnson reported that on August 25, 1992 a Notice of Repeat Violation and Hearing was hand delivered to Jimmy Owens, Jr. Upon reinspection of the property on September 10, 1992, Mrs. Johnson found that no corrective action had been taken. Mrs. Johnson recommended the violator be given until September 20, 1992 to correct the violation or a fine of thirty dollars ($30.00) per day be imposed. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and the previous violations committed by the violator, further moved that a fine of thirty dollars ($30.00) be imposed for each day the violation continues past September 20, 1992. Seconded by Mr. Schmidt. Motion CARRIED 4-0. DISCUSSION ITEMS: None at this time. CODE ENFORCEMENT COMMENTS: None at this time.
