02-18-1993 J ....... ..""" CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD REGULAR MEETING THURSDAY, .FEBRUARY 18, 1993 COMMUNITY CENTER 7:00 P.M. CALL TO ORDER: Chairman George Cowan called to order the regular meeting of the Citizen Code Enforcement Board at 7:00 p.m., Thursday February 18, 1993. ROLL CALL: Members present were Chairman George Cowan, Mrs. Delnigro, Mr. Roberts, Mr. Schmidt, Mrs. Strong, Mrs. Borner, and Mrs. Cucanich. Also present were Beverly Kinney-Johnson, Code Enforcement Officer, Krista A. Storey, City Attorney, and Tonya Elliott, Secretary. APPROVAL OF MINUTES: Mrs. Strong made a motion to accept the minutes of January 21, 1993. Seconded by Mrs. Cucanich. Motion CARRIED 7-0. SWEARING IN OF WITNESSES: Chairman Cowan requested Beverly Kinney-Johnson, Code Enforcement Officer and anyone else with statements or comments pertaining to any of the cases stand and be sworn in. Mrs. Johnson was sworn in at this time. CASES IN COMPLIANCE/WITHDRAWN: Beverly Kinney-Johnson, Code Enforcement Officer, reported the following cases in compliance or withdrawn: * 92-CE-0847, B & B Insulation/Tom Bartholomew - In Compliance * 93-CE-0031(A), James A. Rives - In Compliance * 93-CE-0031(B), Legends Restaurant - In Compliance UNFINISHED BUSINESS: None at this time. 1 .... ,...., NEW BUSINESS: CASE #92-CE-0784 - Mary Lyn Johnson - Weeds in excess of two (2) feet. Section 10-43. Code Enforcement Officer Beverly Kinney- Johnson reported the violation was first observed on September 22, 1992 and was to be corrected by October 13, 1992. Attempts to notify property owner failed, therefore, Legal Ads were placed in the Daytona News Journal. Photographs were presented to the Board for review. Upon reinspect ion of the property on February 18, 1993, Mrs. Johnson found that no correction had been taken and recommended that the violator be given until March 1, 1993 to correct the violation or a fine of twenty-five dollars ($25.00) per day be imposed. Mrs. Strong moved to drop this case because some things in the City aren't kept up by the City themselves, there own property, so I can't see doing this to someone else. Krista Storey, City Attorney, interjected that Mrs. Strong's comment of the lack of enforcement or severity of enforcement against other property is not relevant and the motion must be based on the facts. Mrs. Strong's motion stood. CARRIED 4-3. Seconded by Mrs. Delnigro. Motion CASE #93-CE-0002 - Daniel C. and Michelle W. Troian - Uncontained trash in and around garbage/trash enclosure. Code Enforcement Officer Beverly Kinney-Johnson reported the violation was first observed on January 4, 1993 and was to be corrected by January 14, 1993. Photographs were presented to the Board for review. Upon reinspections of the property on January 14, 1993, February 16, 1993 and February 18, 1993, Mrs. Johnson observed that no corrective action had been taken and recommended that the violators be given until March 1, 1993 to correct the violation or a fine of thirty dollars ($30.00) per day be imposed. Mr. Schmidt, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 93-CE- 0002 that a violation of Section 717.02 of the Edgewater Code of Ordinances does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until March 1, 1993 to correct the violation and that a fine of $30.00 per day be imposed for each day the violation continues past that date. Seconded by Mrs. Borner. Motion CARRIED 7-0. 2 'W' .."" DISCUSSION ITEMS: None at this time. CODE ENFORCEMENT COMMENTS: None at this time.
