CALL TO ORDER: Chairman George Cowan called to order the regular meeting of the Citizen Code Enforcement Board at 7:00 p.m., Thursday, June 17, 1993. ROLL CALL: Members present were Chairman George Cowan, Mr. Roberts, Mr. Schmidt, Mrs. Strong, Ms. Sterl and Mrs. Bomer. Also present were Beverly Kinney-Johnson, Code Enforcement Officer, Mark P. Karet, Director of Community Development, Krista A. Storey, City Attorney and Liz McBride, Secretary. APPROVAL OF MINUTES: Mr. Schmidt made a motion to accept the minutes of May 20, 1993. Seconded by Mrs. Strong. Motion CARRIED 4-0. Ms. Sterl, a new Board member, abstained as this was her first meeting. Mrs. Bomer abstained as she was absent from the May 20, 1993 meeting. SWEARING IN OF WITNESSES: Chairman Cowan requested Beverly Kinney-Johnson, Code Enforcement Officer and anyone else with statements or comments pertaining to any of the cases stand and be sworn in. Mrs. Johnson and Curtis Williams, Sr., 157 Wildwood Avenue, Edgewater, Florida were sworn in at this time. CASES IN COMPLIANCEIWITHDRAWN: Beverly Kinney-Johnson, Code Enforcement Officer, reported the following cases in compliance or withdrawn: * 93-CE-0310, Jeffrey Harris - In Compliance 1 . , ~ ..., UNFINISHED BUSINESS: Foreclosure Authorization - Curtis and Patricia Williams, Sr. In a memorandum dated June 14, 1993 from Beverly Kinney-Johnson, Code Enforcement Officer, to the Citizen Code Enforcement Board, history review for Case Numbers 92-CE-0270, 92-CE-0431 (A) and 92-CE-0431 (B) was outlined. Mrs. Johnson's memorandum summarized the Board's previous findings and the dates she had contact with Mr. Williams and his son Scott. Previously reviewed photographs were presented to the Board. Mrs. Johnson stated, if the Board believes that Mr. Williams was not physically in charge of the property and was unaware of the code violations, she would then recommend that Mr. William's fine be reduced to $1,000 in lieu of the previous $42,810. Curtis Williams, Sr., 157 Wildwood Avenue, Edgewater, Florida, stated he was not aware of any previous correspondence and cannot remember the dates or conversations with Mrs. Johnson, and further summarized his grievance of being "singled out". Mr. William's also stated that his son Scott had been living at the residence during the time of the violations. The Board questioned Mr. Williams and examined the information presented to them. Krista A. Storey, City Attorney, offered guidance to the Board in their consideration of the possible reduction of fine, and that the Board must establish what the special circumstances are which would allow the Board to reduce the fine. Mr. Schmidt, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 92-CE-0270, Case Number 92-CE-0431(A) and (B) of the Edgewater Code of Ordinances does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that since the violator has corrected the violations, that a reduced fine of $750 be imposed for the violations that did occur. Motion FAILED due to no Second. Mrs. Bomer, after hearing the testimony presented and the recommendation of Staff, moved in reference to Cases Number 92-CE-0270, 92-CE-0431(A) and (B) that the existing conditions have been cleared up and after considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, recommended a $5,000 fine be imposed instead of the $42,000 fine. Seconded by Mrs. Strong. Motion CARRIED 6-0. NEW BUSINESS: Case #93-CE-0338 - Hardee's Restaurant. No permit obtained for changeable copy sign. Section 3-5(a)(I)-(7)(b). Signage to be no closer than 50 feet to any other sign. 3-7(a)(2)a. Code Enforcement Officer Beverly Kinney-Johnson reported the violations were first observed on May 14, 1993 and were to be corrected May 24, 1993. A photograph was presented to the Board for review. Upon reinspection of the property on May 24, 1993 and again on June 17, 1993, Mrs. 2 . , ...... ~ Johnson found that no corrective action had been taken and recommended that the Violator be given until July 1, 1993 to correct the violation or a fine of thirty dollars ($30.00) per day be imposed. Mr Schmidt, after hearing the testimony presented and the recommendation of Staff, moved in reference to Case Number 93-CE-0338 that a violation of Sections 3-5(a)(I)-(7)(b) and 3-7(a)(2)a of the Edgewater Code of Ordinances does exist and the alleged violator has committed the violation. After considering the gravity of the violation, any actions taken by the violator to correct the violation, and any previous violations committed by the violator, further moved that the violator be given until July 1, 1993 to correct the violation and that a fine of $30.00 be imposed for each day the violation continues past that date. Seconded by Mrs. Bomer. Motion CARRIED 6-0. ELECTION OF OFFICERS 1) Chairman. - Mrs. Strong motioned to nominate George Cowan. Seconded by Mrs. Bomer. There being no further nominations, motion CARRIED 6-0. 2) Vice Chairman - Mrs. Bomer motioned to nominate Don Schmidt. Seconded by Mrs. Strong. There being no further nominations, motion CARRIED 6-0. DISCUSSION ITEMS: None at this time. CODE ENFORCEMENT COMMENTS: None at this time.
