CITIZEN CODE ENFORCEMENT BOARD
REGULAR MEETING MINUTES
THURSDAY, JANUARY 20,1994
COMMUNITY CENTER
7:00 P.M.
CALL TO ORDER:
Vice Chairman Donald Schmidt called to order the regular meeting of the Citizen Code
Enforcement Board at 7:02 p.m., Thursday, January 20, 1994.
ROLL CALL:
Members present were Vice Chairman Schmidt, Mr. Roberts, Mrs. Bomer, Ms. Sterl and Mr.
Lange. Also present were Beverly Kinney-Johnson, Code Enforcement Officer, Mark P. Karet,
Director of Community Development, Krista A. Storey, City Attorney and Liz McBride,
Secretary. Chairman Cowan and Mrs. Planson were absent.
APPROVAL OF MINUTES:
None at this time.
SWEARING IN OF WITNESSES:
Vice Chairman Schmidt requested Beverly Kinney-Johnson, Code Enforcement Officer and
anyone else with statements or comments pertaining to any of the cases stand and be sworn in.
Mrs. Johnson and Bill Gleason, 526 Live Oak Place, Edgewater, Florida, were sworn in at this
time.
CASES IN COMPLIANCEIWITHDRAWN:
Beverly Kinney-Johnson, Code Enforcement Officer, reported the following cases in compliance
or withdrawn:

UNFINISHED BUSINESS:
None at this time
NEW BUSINESS:
Case #93-CE-0474 - Estate of Donald & Alicia Albertson c/o Joseph P. Smyth. Weeds in excess
of two (2') feet. Section 10-43. Code Enforcement Officer Beverly Kinney-Johnson reported the
violation was first observed on July 14, 1993 and was to be corrected August 6, 1993. In a letter
received August 5, 1993 from Mr. Smyth, an attorney, it was stated the only contact he has had
from a surviving relative was a letter from Mrs. Albertson's mother which written in Spanish.
Photographs were presented to the Board for review. Upon reinspection of the property on
December 20, 1993, Mrs. Johnson found that no corrective action had been taken and
recommended that the Violators be given until February 1, 1994 to correct the violation or a fine
of twenty-five dollars ($25.00) per day be imposed.
Mrs. Bomer, after hearing the testimony presented and the recommendation of Staff, moved in
reference to Case Number 93-CE-0474 that a violation of Section 10-43 of the Edgewater Code
of Ordinances does exist and the alleged violator has committed the violation. After considering
the gravity of the violation, any actions taken by the violator to correct the violation, and any
previous violations committed by the violator, further moved that the violator be given until
February 1, 1994 to correct the violation and that a fine of $25.00 be imposed for each day the
violation continues past that date. Seconded by Ms. Sterl. Motion CARRIED 4-1. Mr. Roberts
voted No.
Case #93-CE-0674 - Perry BarrettIPonderosa Homes. Repeat violation. Signage not permitted.
Section 602.03(f). Code Enforcement Officer Beverly Kinney-Johnson reported the violation was
observed on November 18, 1993 and was to be corrected December 19, 1993. It was also
determined at that time that a repeat violation existed. Photographs were presented to the Board
for review. Upon reinspection of the property on January 20, 1994, Mrs. Johnson found that no
corrective action had been taken and recommended that the Violator be given until February 1,
1994 to correct the violation or a fine of sixty dollars ($60.00) per day be imposed.
Bill Gleason, 526 Live Oak Place, Edgewater, Florida, representing Perry BarrettIPonderosa
Homes, displayed the sign in question and presented a letter from a purchaser of Meadow Lake
lots to the Board. Mr. Gleason said the ordinance seems a little unfair and needs to be rewritten.
Krista A. Storey, City Attorney, pointed out to the Board that the issue is whether the ordinance,
as currently written, has been violated.
Mr. Gleason implied Ponderosa Homes is being singled out, and that through out Edgewater there
are builder's signs with there names, phone numbers and office addresses on them, and many of
the office addresses are not in the same subdivision that their signs are placed. Mr. Gleason also
stated that the City of Edgewater should be supporting the businesses within the community.

NEW BUSINESS CON'T:
Discussion followed regarding the sign ordinance, relating to bus stop signs.
Mr. Lange, after hearing the testimony presented and the recommendation of Staff, moved in
reference to Case Number 93-CE-0674 that a repeat violation of Section 602.03(t) of the
Edgewater Zoning Ordinance has occurred and the alleged violator has committed the violation.
After considering the gravity of the violation, any actions taken by the violator to correct the
violation, and any previous violations committed by the violator, further moved that a fine of
$60.00 be imposed for each day the violation continues past February 1, 1994. Seconded by Mrs.
Bomer. Motion CARRIED 4-1. Mr. Roberts voted No.
DISCUSSION ITEMS:

ADJOURNMENT:
There being no further business to come before the Board, a motion was made and accepted to
adjourn. The meeting adjourned at 7:30 p.m.
