REGULAR MEETING MINUTES
THURSDAY, FEBRUARY 17, 1994

CALL TO ORDER:
Chairman George Cowan called to order the regular meeting of the Citizen Code Enforcement
Board at 7:00 p.m., Thursday, February 17, 1994.
ROLL CALL:
Members present were Chairman George Cowan, Mr. Schmidt, Mr. Roberts, Mrs. Planson and
Mr. Lange. Also present were Beverly Kinney-Johnson, Code Enforcement Officer, Krista A.
Storey, City Attorney and Liz McBride, Secretary. Mrs. Bomer and Ms. Sterl were absent.
APPROVAL OF MINUTES:
Mr. Lange moved to accept the minutes of December 16, 1993. Seconded by Mr. Schmidt.
Motion CARRIED 5-0.
Mr. Schmidt moved to accept the minutes of January 20, 1994. Seconded by Mr. Roberts.
Motion CARRIED 5-0.
SWEARING IN OF WITNESSES:
Chairman Cowan requested Beverly Kinney-Johnson, Code Enforcement Officer and anyone else
with statements or comments pertaining to any of the cases stand and be sworn in. Mrs. Johnson
was sworn in at this time.
CASES IN COMPLIANCEIWITHDRAWN:
Beverly Kinney-Johnson, Code Enforcement Officer, reported the following cases in compliance
or withdrawn:

NEW BUSINESS:
1) Case #94-CE-0002 - Harry L. Griswold, Jr. and John E. Griswold. No house number
visible on property. Section 15-1(b). Code Enforcement Officer Beverly Kinney-Johnson
reported the violation was first observed on December 27, 1993 and was to be corrected January
10, 1994. Photographs were presented to the Board for review. Upon reinspection of the
property on January 10, 1994 and again on February 17, 1994, Mrs. Johnson found that no
corrective action had been taken and recommended that the Violators be given until March 1,
1994 to correct the violation or a fine of fifteen dollars ($15.00) per day be imposed.
Mr. Schmidt, after hearing the testimony presented and the recommendation of Staff, moved in
reference to Case Number 94-CE-0002 that a violation of Section 15-1(b) of the Edgewater Code
of Ordinances does exist and the alleged violator has committed the violation. After considering
the gravity of the violation, any actions taken by the violator to correct the violation, and any
previous violations committed by the violator, further moved that the violator be given until
March 1, 1994 to correct the violation and that a fine of $15.00 be imposed for each day the
violation continues past that date. Seconded by Mrs. Planson. Motion CARRIED 5-0.
2) Case #94-CE-0007 - Hardees Restaurant. Repeat Violation. Changeable copy signage
to be no closer than fifty (5011) feet to any other sign. Section 3-7(a)(2)a. Code Enforcement
Officer Beverly Kinney-Johnson reported the violation was observed on January 20, 1994, and
since it was a repeat violation, was not obligated to give the Violator a reasonable time to correct
the violation before setting it for hearing. Photographs were presented to the Board for review.
Upon reinspection of the property February 17, 1994, Mrs. Johnson found that no corrective
action had been taken and recommended that the Violator be given until March 12, 1994 to
correct the violation or a fine of one hundred dollars ($100.00) per day be imposed. Mrs.
Johnson also recommended that if the signage is not moved by March 1, 1994, a fine of one
hundred dollars ($100.00) per day beginning January 20, 1994.
Mrs. Planson, after hearing the testimony presented and the recommendation of Staff, moved in
reference to Case Number 94-CE-0007 that a violation of Section 3-7(a)(2)a of the Edgewater
Code of Ordinances does exist and the alleged violator has committed the violation. After
considering the gravity of the violation, any actions taken by the violator to correct the violation,
and any previous violations committed by the violator, further moved that the violator be given
until March 1, 1994 to correct the violation and that a fine of $100.00 be imposed for each day
the violation continues past that date, and that fine to be retroactive to January 20, 1994 if not
in compliance by March 1, 1994. Seconded by Mr. Schmidt. Motion CARRIED 5-0.
3) Lien Satisfaction - Case #92-CE-0694 - Resolution Trust Company. In a memorandum
dated February 10, 1994 from Krista A. Storey, City Attorney, to the Citizen Code Enforcement
Board, it was stated that the Board issued an Order on October 8, 1992 assessing a fine of $25.00
per day beginning October 18, 1992. The memorandum also stated the property was determined
to be in compliance January 8, 1993, and during the interim period, a fine of $2,050.00 accrued.
On February 9, 1994, a check in the full amount of $2,050.00 was received, which would satisfy

the lien against the property. Ms. Storey recommended the Board acknowledge receipt of the
payment, and authorize the Chairman to execute the Satisfaction of Lien.
Mr. Lange moved in reference to Case #92-CE-0694, that the Board authorized the Chairman to
issue a Satisfaction of Lien. Seconded by Mr. Schmidt. Motion CARRIED 5-0.

ADJOURNMENT:
There being no further business to come before the Board, a motion was made and accepted to
adjourn. The meeting adjourned at 7:25 p.m.
