REGULAR MEETING MINUTES

CALL TO ORDER:
Chairman Donald Schmidt called to order the regular meeting of the Citizen Code Enforcement
Board at 7:00 p.m., Thursday, June 15, 1995.
ROLL CALL:
Members present were Chairman Schmidt, Mr. Cowan, Mr. Roberts, Mrs. Borner, Mrs. Strong, Mrs.
Planson, and Mr. Fowler. Also present were Beverly Kinney-Johnson, Code Enforcement Officer;
Krista A. Storey, City Attorney; Mark P. Karet, Director of Community Development; and Liz
McBride, Board Coordinator.
APPROVAL OF MINUTES:
Mr. Roberts moved to accept the minutes of May 18, 1995, seconded by Mr. Cowan. Motion
CARRIED 6-0. Mrs. Borner did not vote, as she was not at the May 18, 1995 meeting.
SWEARING IN OF WITNESSES:
Chairman Schmidt requested Beverly Kinney-Johnson, Code Enforcement Officer, and anyone else
with statements or comments pertaining to any of the cases, stand and be sworn in. Mrs. Johnson
was sworn in at this time.
CASES IN COMPLIANCE/CONTINUEDIWITHDRAWN:
None at this time.
UNFINISHED BUSINESS:
Cases 92-CE-0402(B) and 93-CE-0475 - Associates of Meadow Lake, Inc. C/o Perry Barrett.
Krista A. Storey, City Attorney, asked the Board to acknowledge receipt of payment in the amount
of$5,453.50, which resulted due to the closing of a parcel in Meadow Lake. She also requested the
Board authorized the Chairman to execute the Satisfaction of two Liens.
Mrs. Strong moved for the Chairman to execute the Satisfaction of Liens, seconded by Mr. Cowan.
Motion CARRIED 7-0.

Unfinished Business:
Ms. Storey commented that from 1992 to June 8, 1995, the City had collected a total of $35,992
through the lien process.
NEW BUSINESS:
Case # 95-CE-0020lA)&lB) - Eastern Shores Mobile Village (A) & Don Lewis (B). Fence
erected with no permit. Code Enforcement Officer Beverly Kinney-Johnson reported she first
observed the violation on February 2, 1995 and was to be corrected by February 16, 1995. She said
Don Lewis, authorized agent for Eastern Shores Mobile Village, had submitted a fence permit
application on March 18, 1994. She also said Mr. Lewis was notified that same day that the permit
was approved and ready for pick up. Mrs. Johnson said Mr. Lewis called her office requesting an
extension of time, and she agreed to give him until March 16, 1995 to comply. After checking with
the Building Division on March 23, 1995, Mrs. Johnson was informed that the required fence permit
had not been obtained. Photographs were presented to the Board for review. Upon reinspection
of the property June 15, 1995, Mrs. Johnson observed that no corrective action had been taken, and
recommended the Violators be given until July 1, 1995 to correct the violation or a fine of$15.00 per
day be imposed.
Mrs. Borner, after hearing the testimony presented and the recommendation of staff, moved in
reference to Case Numbers 95-CE-0020(A)&(B) that a violation of Section( s) 104.1 of the Standard
Building Code and 702.02(F) of the Land Development Code does exist and the alleged violator has
committed the violation. After considering the gravity of the violation, any actions taken by the
violator to correct the violation, and any previous violations committed by the violator, further moved
that the Violator be given until July 1, 1995 to correct the violation and that a fine of $25.00 be
imposed for each day the violation continues past that date, seconded by Mr. Cowan. Motion
CARRIED 7-0.

None at this time.
ADJOURNMENT:
There being no further business to come before the Board, a motion was made and accepted to
adjourn. The meeting adjourned at 7: 13 p.m.
