CALL TO ORDER: Chairman Donald Schmidt called to order the regular meeting of the Citizen Code Enforcement Board at 5:35 p.m., Thursday, January 18, 1996. ROLL CALL: Members present were Chairman Donald Schmidt, George Cowan, Frank Roberts, Maureen Bomer, Joan Strong, new member Dennis Vincenzi, and Tony Fowler. Also present were Beverly Kinney- Johnson, Code Enforcement Officer; Krista A. Storey, City Attorney; Mark P. Karet, Director of Community Development; and Liz McBride, Board Coordinator. APPROVAL OF MINUTES: Mr. Fowler moved to accept the minutes of November 16, 1995, seconded by Mrs. Strong. Motion CARRIED 7-0. SWEARING IN OF WITNESSES: Chairman Schmidt requested Beverly Kinney-Johnson, Code Enforcement Officer, and anyone else with statements or comments pertaining to any of the cases, stand and be sworn in. Ms. Johnson was sworn in at this time. CASES IN COMPLIANCE/CONTINUED/WITHDRA WN: * 95-CE-0323, Cherie L. Gonzales, withdrawn UNFINISHED BUSINESS: Case #95-CE-0041 - Fleet Finance & Mortgage, Inc. Krista A. Storey, City Attorney, referred to a memorandum addressed to the Code Enforcement Board dated January 3, 1996, in regard to receiving payment ofa fine of $700. Ms. Storey requested the Board acknowledge receipt of the payment and authorize the Chairman to execute the Satisfaction of Lien. Mr. Roberts so moved, seconded by Mrs. Bomer. Motion CARRIED 7-0. .... ........ ...., Citizen Code Enforcement Board Minutes - January 18, 1996 Page -2- NEW BUSINESS: Case #95-CE-0300 - Curtis & Patricia Williams, Sr. Not connected to City water distribution system due to failure to pay water bill. Section 19-11(a). On September 20, 1995, the Finance Department requested code enforcement action against Mr. Williams due to the violation. Code Enforcement Officer Beverly Kinney-Johnson reported the City disconnected the connection to the water distribution system because Mr. Williams had failed to pay his water/sewer bill, of$2,260.67, since August 3, 1990. She said a notice of violation was sent September 21, 1995, setting October 23, 1995 as the date for compliance. On October 25, 1995, Ms. Johnson said she asked Finance Director Fred Munoz if any corrective action had been taken, and the reply was no. She stated the notice of violation hearing was returned unclaimed on November 16, 1995, so the property was posted. Ms. Johnson stated Mr. Williams came into the office to inquire why the property was posted. She then reported that as of close of business January 18, 1996, no corrective action had been taken, and recommended the Violator be given until February 29, 1996 to correct the violation or a fine of$50.00 per day be imposed. Mrs. Bomer, after hearing the testimony presented and the recommendation of staff, moved in reference to Case Number 95-CE-0300 that a violation of Section 19-11(a) of the Edgewater Code of Ordinances does exist and the alleged Violator has committed the violation. After considering the gravity of the violation, any actions taken by the Violator to correct the violation, and any previous violations committed by the Violator, further moved that the Violator be given until February 15, 1996 to correct the violation and that a fine of$50.00 be imposed for each day the violation continues past that date, seconded by Mr. Roberts. Motion CARRIED 7-0. Case #95-CE-0340 - Clint Hawley dba Clint's Auto Repair. Operating a business with no occupational license. Section 11-2. Code Enforcement Officer Beverly Kinney-Johnson reported she first observed the violation on August 23, 1995, and was to be corrected by August 28, 1995. She stated Mr. Hawley picked up an occupational license application on August 24, 1995, but as of January 18, 1996, had failed to provide the required Department of Agriculture Certification. Photographs, showing the business open for operation, were presented to the Board for their review. Ms. Johnson concluded by recommending the Violator be given until February 1, 1996 to correct the violation or a fine of$50.00 per day be imposed. Mr. Cowan, after hearing the testimony presented and the recommendation of staff, moved in reference to Case Number 95-CE-0340 that a violation of Section 11-2 of the Edgewater Code of Ordinances does exist and the alleged Violator has committed the violation. After considering the gravity of the violation, any actions taken by the Violator to correct the violation, and any previous violations committed by the Violator, further moved that the Violator be given until February 1, 1996 to correct the violation and that a fine of$50.00 be imposed for each day the violation continues past that date, seconded by Mrs. Bomer. Motion CARRIED 7-0. Case #95-CE-0352 - Surrey Ridge, Inc. Surreys in disrepair. Section 717.03. Code Enforcement Officer Beverly Kinney-Johnson reported she first observed the violation on October 30, 1995, and was to be corrected by November 13, 1995. She referenced a letter received from Perry Barrett of Surrey Ridge, Inc. on November 22, 1995, stating the surreys had been painted and requesting a .- '-" .....", Citizen Code Enforcement Board Minutes - January 18, 1996 Page -3- reinspection. Upon reinspections on November 27, 1995 and January 18, 1996, Ms. Johnson found the surreys were still in disrepair. Photographs were presented to the Board for review. Ms. Johnson then recommended the Violator be given until February 1, 1996 to correct the violation or a fine of $30.00 per day be imposed. Mr. Roberts, after hearing the testimony presented and the recommendation of staff, moved in reference to Case Number 95-CE-0352 that a violation of Section 717.03 of the Edgewater Zoning Ordinance does exist and the alleged Violator has committed the violation. After considering the gravity of the violation, any actions taken by the Violator to correct the violation, and any previous violations committed by the Violator, further moved that the Violator be given until February 1, 1996 to correct the violation and that a fine of$30.00 be imposed for each day the violation continues past that date, seconded by Mrs. Strong. Motion CARRIED 7-0. DISCUSSION ITEMS: Chairman Schmidt, along with the other members, welcomed Dennis Vincenzi to the Board. CODE ENFORCEMENT COMMENTS: None at this time.
