10-17-1996 a. y\~_)..c...)"[.c\ ...,., ....., CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD REGULAR MEETING MINUTES October 17, 1996 COMMUNITY CENTER 5:30 P.M CALL TO ORDER: Chairman Anthony Fowler called to order the regular meeting of the Citizen Code Enforcement Board at 5:32 p.m., Thursday, October 17,1996. ROLL CALL: Members present were Chairman Anthony Fowler, George Cowan, Maureen Bomer, and Joan Strong. Also present were Beverly Kinney-Johnson, Code Enforcement Officer; Krista A. Storey, City Attorney; Mark P. Karet, Director of Community Development; and Liz McBride, Board Coordinator. Frank Roberts, Dennis Vincenzi, and Donald Schmidt were recorded absent. APPROVAL OF MINUTES: Mrs. Strong moved to accept the minutes of September 19, 1996, seconded by Mrs Bomer. Motion CARRIED 4-0. SWEARING IN OF WITNESSES: Chairman Fowler requested Beverly Kinney-Johnson, Code Enforcement Officer, and anyone else with statements or comments pertaining to any of the cases, stand and be sworn in. Mrs. Johnson was sworn in at this time. CASES IN COMPLIANCE/CONTINUED/WITHDRA WN: * 96-CE-0537, A Storage King, Inc., in compliance * 96-CE-0479, William & Maria C. Cutrone, withdrawn UNFINISHED BUSINESS: None at this time. NEW BUSINESS: 1. Case #96-CE-0357 - Jimmy D. Owens, Trustee. Weeds in excess of twelve (12") inches on property, repeat violation of Section 10-91. Code Enforcement Officer Beverly Kinney-Johnson reported the violation was first observed on July 2, 1996. She stated the Violator was found in violation for grass and weeds April 7, 1992, and on September 10, 1992, the Board found the Violator to be a repeat violator. Ms. Johnson said since the notice of hearing was returned on September 16, 1996 "unclaimed", the property and City Hall were posted. A photograph was presented to the Board for review. Ms. Johnson reinspected the property October, 17, 1996, and found no corrective action had been taken, and recommended the Violator be imposed a $50.00 fine for every day the violation continued past October 25, 1996. Citizen Code Enforcement Board Minutes - October 17, 1996 Page -2- Mrs. Strong, after hearing the testimony presented and the recommendation of staff, moved in reference to Case Number 96-CE-03 5 7 that a violation of Section 10-91 of the Edgewater Code of Ordinances has occurred and the alleged Violator has committed the violation. After considering the gravity of the violation, and the previous violations committed by the Violator, further moved that a repeat violation is found to have occurred and the Violator be given until October 15, 1996 to correct the violation and that a fine of $1 00.00 be imposed for each day the violation continues past that date, seconded by Mrs. Bomer. Motion CARRIED 4-0. 2. Case #96-CE-0455 - Halifax Court Condominium Association, Inc. Uncontained trash on property, Section 717.03. Dumpster enclosure in disrepair, Section 706.00. Code Enforcement Officer Beverly Kinney-Johnson reported she first observed the violations August 8, 1996, and were to be corrected August 30, 1996. Upon inspection of the property on August 30, 1996, she found no corrective action had been taken. Since the notice of hearing was returned on September 25, 1996 "unclaimed", she said the property and City Hall were posted. Photographs were presented to the Board for review. After reinspecting the property on October 17, 1996, Ms. Johnson found no corrective had taken place. Ms. Johnson then recommended a fine of$50.00 for each violation be imposed for every day the violations continued past November 1, 1996. Mr. Cowan, after hearing the testimony presented and the recommendations of staff, moved in reference to Case Number 96-CE-0455 that a violation of Sections 717.03 and 706.00 of the Edgewater Zoning Ordinance does exist and the alleged Violator has committed the violations. After considering the gravity of the violations, and any actions taken by the Violator to correct the violation, and any previous violations committed by the Violator, further moved that the Violator be given until November 1, 1996 to correct the violation and that a fine of$50.00 be imposed for each day the violations continue past that date. Motion FAILED for lack of a second. Mr. Cowan, after hearing the testimony presented and the recommendations of staff, moved in reference to Case Number 96-CE-0455 that a violation of Sections 717.03 and 706.00 of the Edgewater Zoning of Ordinance does exist and the alleged Violator has committed the violations. After considering the gravity of the violations, and any actions taken by the Violator to correct the violation, and any previous violations committed by the Violator, further moved that the Violator be given until November 1,1996 to correct the violation and that a fine of$50.00 for each violation be imposed for each day the violations continue past that date. Motion CARRIED 3-1. Chairman Fowler voted no. DISCUSSION ITEMS: Chairman Fowler asked the Board to consider canceling the December regular meeting due to the holidays. Mrs. Strong moved to cancel the December meeting, seconded by Mrs. Bomer. Motion CARRIED 4-0. Mrs. Bomer said she wanted to thank the City for the fantastic job that was done after the tornado.
