SPECIAL MEETING MINUTES
May 28,1997

5:00 p.M.
CALL TO ORDER:
Chairman Anthony Fowler called to order a special meeting of the Citizen Code Enforcement Board
at 5:07 p.m., Wednesday, May 28, 1997.
ROLL CALL:
Members present were Chairman Anthony Fowler, George Cowan, Frank Roberts and Donald
Schmidt. Also present were Beverly Kinney-Johnson, Code Enforcement Officer; Krista A. Storey,
City Attorney; Mark P. Karet, Director of Community Development; and Liz McBride, Board
Coordinator. Maureen Bomer, Joan Strong and Dennis Vincenzi were recorded absent.
SWEARING IN OF WITNESSES:
Chairman Fowler requested Beverly Kinney-Johnson, Code Enforcement Officer, and anyone else
with statements or comments pertaining to the case, stand and be sworn in. Mrs. Johnson and Ray
Fisher, 2030 Hibiscus Drive, Edgewater, Florida, were sworn in at this time.
UNFINISHED BUSINESS:
1) 96-CE-0578 - Ray and Burma Fisher. Request by Mr. Fisher to address the Board
regarding the assessed fine. Since Mr. Fisher felt the violation was over a minor matter, he requested
the Board waive the entire fine. He said the Code Enforcement office had been called to say the
infraction had been taken care of Mr. Fisher felt the problem was because he didn't answer a letter
sent to him after the violation was abated.
Code Enforcement Officer Beverly Kinney-Johnson reviewed the case starting from her first visit to
the property on September 17, 1996. She said the Board originally heard this case at its November
21, 1996 meeting, at which time the Violators were given until December 1, 1996 to correct the
violation or a fine of $1 00 per day until in compliance. Ms. Johnson said the notification of lien sent
to the Fishers stated to contact Code Enforcement as soon as the violation was abated to arrange for
inspection of the property. The lien was discovered when the Fishers were attempting to sell one of
their properties. Ms. Johnson said when Chris Fisher, Ray Fisher's son, contacted the office, it was
explained to him the fine had accumulated to $13,300. She said a letter requesting reconsideration
of the fine was received on April 14, 1997, and on April 15, 1997, a reinspection of the property was
made and found to be in compliance. Ms. Johnson recommended the fine be reduced to $448 to
cover costs incurred by the City.

Mr. Roberts, after hearing the testimony presented and the recommendation of staff, moved in
reference to Case Number 96-CE-0578 that the fine shall be reduced to $448 for the costs incurred
by the City, seconded by Mr. Cowan. Motion CARRIED 4-0.
DISCUSSION ITEMS:
Chairman Fowler polled the members to see if the June 19, 1997 regular meeting could be held on
June 17, 1997. Since many of the members would be on vacation that week, the June meeting was
canceled all together.
CODE ENFORCEMENT COMMENTS: None at this time.
ADJOURNMENT:
There being no further business to come before the Board, the Chairman moved the meeting
adjourned. The meeting adjourned at 5: 18 p.m.
