REGULAR MEETING MINUTES
March 19,1998

CALL TO ORDER:
Chairman Anthony Fowler called to order the regular meeting of the Citizen Code Enforcement
Board at 5:33 p.m., Thursday, March 19, 1998.
ROLL CALL:
Members present were Chairman Anthony Fowler, Linda Johnson, Frank Roberts, and Joan Strong.
Also present were Beverly Kinney-Johnson, Code Enforcement Officer; Lynne Plaskett, Acting
Director of Community Development; and Liz McBride, Board Coordinator. Maureen Bomer and
Dennis Vincenzi were excused. Donald Schmidt had submitted his resignation.
APPROVAL OF MINUTES:
There being no changes, Mr. Roberts moved to accept the minutes of February 19, 1998, as
presented, seconded by Mrs. Strong. Since Ms. Johnson was not present at the February 19, 1998
meeting, she did not vote. Motion CARRIED 3-1.
SWEARING IN OF WITNESSES:
Chairman Fowler requested Beverly Kinney-Johnson, Code Enforcement Officer, and anyone else
with statements or comments pertaining to any of the cases, stand and be sworn in. Ms. Johnson;
Jean and Ben DelNigro, 3130 Tamarind Drive, Edgewater; and Paul and Jeff Jenkins, 2029 Willow
Oak Drive, Edgewater, were sworn in at this time.

Case # 98-CE-OOI8 - Paul Jenkins &
Case # 98-CE-OOI8lA) - George & Virginia Shillingsburg. Untagged vehicle(s) on property,
Section 712.00. Code Enforcement Officer Beverly Kinney-Johnson reported she first observed the
violation on January 22, 1998, at which time she left a business card asking Paul Jenkins, the tenant,
to contact our office. Mr. Jenkins was notified numerous times and given ample time to correct the
violation. On January 29, 1998, Ms. Johnson left a Courtesy Notice at the property giving until
February 9, 1998 to correct the violation. Since no corrective action had taken place on that date,
a Courtesy Notice of Violation was sent to Mr. Jenkins and a copy to George and Virginia
Shillingsburg, the property owners, setting February 19, 1998 as the date of compliance. After
inspecting the property on February 19, 1998, Ms. Kinney-Johnson found the violation had not been
corrected. On February 24, 1998, a Notice of Violation was issued, setting March 4, 1998 as the date
for compliance. Upon reinspection of the property on March 4, 1998, the Code Enforcement Officer
observed no corrective action had taken place. Photographs were presented to the Board for their
review. Ms. Kinney-Johnson said she had numerous conversations with Mr. Jenkins regarding the
untagged vehicles and a bus. She referred to a News Journal article in which Mr. Jenkins admitted
to keeping an untagged bus and other untagged vehicles stored in his backyard. Ms. Kinney-Johnson
then recommended both Paul Jenkins and the Shillingsburgs be given until April 1, 1998, to correct
the violation or a fine of $50 each be imposed for every day the violation continues past that date.
Paul Jenkins, 2029 Willow Oak Drive, Edgewater, asked the Code Enforcement Officer to go back
to an October 1997 complaint, and recite the scenario. Ms. Kinney-Johnson said that was a separate
case which had been closed. Mr. Jenkins stated it was the same complaint. Chairman Fowler told
Mr. Jenkins the closed case was not before the Board, but the violation dated as being first observed
January 22, 1998, was the issue being addressed. Mr. Jenkins said the other case was relevant to this
case. He said, since appeals were restricted to what was before the Board, he insisted on his rights
to bring up the closed case. Chairman Fowler said the Board was at a disadvantage, and he felt
uncomfortable without having legal counsel present. The Chairman reported the City Attorney
wasn't present because she was ill. Mr. Jenkins said the Board might want to continue the case until
the next meeting. Chairman Fowler asked for the Board's suggestions. Ms. Johnson agreed that the
case should be continued.
Mrs. Strong moved to postpone the case until the Board's next month meeting so that the City
Attorney would be present, seconded by Mr. Roberts. Motion CARRIED 4-0.
DISCUSSION ITEMS:
Chairman Fowler welcomed new Board member Linda Johnson.

There being no further business to come before the Board, a motion was made and accepted to
adjourn. The meeting adjourned at 5:45 p.m.
