COMMUNITY CENTER MINUTES CALL TO ORDER Chairman Ben Wagner called the regular meeting of the Code Enforcement Board to order at 2:04 PM in the Community Center. ROLL CALL Members present: Ben Wagner, Ed Corn, Glenn Barnhill, Gail Anderson, Alice Haldeman and Sherry Lester. Also present were Code Officer Mike McGrath, Code Officer Dan Koehler, and Board Coordinator Shontella Jackson. APPROVAL OF MINUTES The Minutes for the special meeting of May 9, 2013 were presented to the Board for approval. The regular meeting minutes were not included in the packet therefore they will be mailed with the July l la' agenda. MOTION by Ed Corn. SECOND by Alice Haldeman to adopt the minutes of Special Citizen Code Enforcement Board on May 9. 2013 as written. MOTION CARRIED UNANIMOUSLY, SWEARING IN OF WITNESSES: Code Officer Mike McGrath and Code Officer Dan Koehler were sworn in. Hammond— 1429 Queen Palm Dr. Violation of Section— 10-215 (Pool enclosures). Ms. Haldeman also noted that items (r) & (s) had the same citation numbers. Officer McGrath researched the citation numbers and stated the correct citation number for item (s) is 3246. Chairman Ben Wagner concluded with it appears after reviewing these cases no one was present for any of the cases mentioned above. Pursuant to Section 10-348 and 10-345 subparagraph C of the Code of Ordinance and the statement that appears on the respected citation issued that failure to appear at this hearing the alleged violator has waived any right to contest the violation and that an order can be made against for the maximum applicable penalties that include but not limited to administrative costs, fines, daily fines and liens however we have the benefit of the staff recommendations, motion and actions to be taken by the Board. Code Enforcement Board Minutes June 13,2013 Page 4 Case 9 2013-CE 107373 (Repeat) Citation 9 3122 (Koehler) David W. Brown–2831 Unity Tree Dr. Violation of Section– 10-98 (Property Maintenance . Code Officer Dan Koehler presented the case summary to the Board. Code Officer Dan Koehler presented staff's recommendation to find David W. Brown in repeat violation of Section 10-98 of the Code of Ordinances assessing a citation fine of$150.00 and an additional fine of$100.00 per day per violation that continues to exist past June 14, 2013 and for a lien to be placed on the property if not satisfied by June 19, 2013. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass if the violation is not corrected by June 14, 2013 and that a lien is placed on the property. Code Officer Dan Koehler testified that the lawn in the front and rear was not in compliance. No one was present for this case. Mr. Wagner asked if they could cut the rear yard. Officer McGrath stated this is an old case with approximately $1600.00 in fines outstanding and to get access to the rear of the property has been a problem due to lose animals and access. MOTION by Alice Haldeman. SECOND by Gail Anderson that the Board finds David W. Brown in repeat violation of Section 10-98 of the Code of Ordinances assessing the citation fine of 150.00 and additional fine of 5100.00 per day for each day the violation exists past June 14. 2013 and that a lien is placed on the property of not satisfied by June 19. 2013. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass if the violation is not corrected by June 14. 2013 and that a lien is placed on the property. MOTION CARRIED UNANIMOUSLY 6-0. Case 92013-CE-107331 (Repeat) Citation 93239 (McGrath) Daren E. & Kari M. Hammond– 1429 Queen Palm Dr. Violation of Section– 10-215 (Pool enclosures). Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff's recommendation to find Daren E. & Kari M. Hammond in repeat violation of Section 10-215 of the Code of Ordinances assessing a citation fine of$300.00 and a cost of$150.00 for Leisure Service securing the pool and for a lien to be placed on the property if not satisfied by June 19, 2013. No one was present for this case. Officer McGrath stated the pool has been secured by city staff and this is a continuous problem due to the landscape company not securing the property. Mr. Corn suggested draining the pool or placing signage on the fence for the landscapers. MOTION by Ed Corn. SECOND by Glenn Barnhill that the Board finds Daren E- & Kari M. Hammond in repeat violation of Section 10-215 of the Code of Ordinances assessing the citation fine of 5300.00 and a cost of$150.00 for Leisure Service to secure the pool also for a lien is placed on the property if not satisfied by June 19. 2013. MOTION CARRIED UNANIMOUSLY 6-0. OTHER BUSINESS: None. CODE COMPLIANCE REPORT: Due to the absent of Code Supervisor Jeff Lariscy there is no compliance report this month.
