Chairman Hellsten called to order a regular meeting of the Land
Development and Regulatory Agency at 6:30 p.m., Thursday, May 15,
1992, in the Community Center of City Hall.
ROLL CALL:
Members present were Mr. Masso, Mr. Ewing, Mr. Fazzone, Mr.
Garthwaite, Mr. Klein, Mr. Hildenbrand and Chairman Hellsten. Also
present were Mark P. Karet, Director of Community Development,
Krista Storey, City Attorney and Sondra Meager-pengov, Secretary.
APPROVAL OF MINUTES:
Mr. Fazzone moved to approve the minutes of April 9, 1992 as
presented, seconded by Mr. Masso. Motion CARRIED 7-0.
NEW BUSINESS:
MSD-9201 - Minor Subdivision - Darwin A. Rathbun - Darwin Rathbun
requested approval for a minor subdivision, located at 131 Highland
Avenue.
Mr. Karet reviewed the request for the board, explaining the lot
will be increased in width from 50 feet to 80 feet. Mr. Karet
said, based on the findings outlined, the Department of Community
Development supports the applicant's request.
Mr. Garthwaite moved to approve the minor subdivision, seconded by
Mr. Masso. Motion CARRIED 7-0.
VA-0592 - Variance to Allow an Addition - Darwin Rathbun requested
a variance from the required setback to allow an addition to an
existing home, located at 131 Highland Avenue.

Mr. Karet reviewed the five criteria that must be met before a
variance can be granted. Mr. Karet said the Department of
Community Development finds that none of the five criteria have
been meet. As a result, the department does not support the
applicants request.
Mr. Rathbun explained his needs for the variance and provided a
petition signed by his surrounding neighbors that said they have
no problem with the variance request.
Chairman Hellsten opened the discussion to the board and the
public.
After the discussion from the board, Chairman Hellsten asked the
board to review the individual five criteria required for approval
of a variance. The board, after discussion, voted on the five
criteria and found one of the five criteria had not been met.
Mr. Garthwaite moved to deny the variance request, seconded by Mr.
Fazzone. Motion CARRIED 5-2. Mr. Klein and Mr. Ewing voted no.

been continued for a second meeting, he entertained a motion to
deny the request.
Mr. Masso moved to deny the request, seconded by Mr. Garthwaite.
Motion CARRIED 7-0.
Review of DRAFT for Fence Heights
Mr. Karet reviewed the draft on the fence standards necessary to
regulate the use of fences. There was considerable discussion from
the board and the public. Mr. Karet stated he will make the
recommended changes and provide the fence standards at a future
LDRA meeting.

Discussion of Buildinq Codes for Properties Located on the East
Side of Riverside Drive
Chairman Hellsten said he requested putting this on the agenda due
to the comments he has had from various citizens regarding
buildable lots on the east side of Riverside Drive.
Mr. Karet referred to the material he provided to the board,
(Statutory and Constitutional Considerations Relating to Local
Planning Agencies). Mr. Karet then reviewed the document. This
document gives the sort of questions that will need to be answered
if any substantial restrictions are put on the use of peoples
property.
Mr. Klein expressed his concerns with possible stormwater problems
on the east side of Riverside Drive.
Mr. Fazzone stated his dissatisfaction with "The Harris House" on
S. Riverside Drive, stating we need to come up with criteria on
what is a buildable lot and what is not.
Doris Hill, Lincoln Road - Mrs. Hill also made reference to "The
Harris House", saying she was under the impression that the Harris
property was not a buildable lot. She also expressed her concerns
with the three lots south of the Riverview Apartments. She would
like the board to take these into consideration when preparing the
regulations for the comprehensive plan.
Chairman Hellsten suggested the land development regulations need
to be addressed very carefully throughout the City, because they
are so broad, that there really are no guidelines for the intensity
that can possibly be developed. Chairman Hellsten also asked Mr.
Karet to provide Council's opinion and the arguments presented on
the variance for "The Harris House".
After additional discussion, Chairman Hellsten suggested having a
special meeting to discuss this issue further.

Chairman's Report
Chairman Hellsten passed a "position Paper" to the board. He
explained he would like to present this to the Council, as he has
been notified that Glen and Cindy Jones of 346 N. Riverside Drive,
are appealing to City Council, the LDRA's stipulation of a second
story addition.
Mr. Fazzone moved to have Chairman Hellsten present the "position
Paper" to the City Council, seconded by Mr. Garthwaite. Motion
CARRIED 7-0.

ADJOURNMENT:
There being no additional business to come before the agency, a
motion was made and approved to adjourn. The meeting adjourned at
9:50 p.m.
