11-17-2004 '-' CITY OF EDGEW A TER ~ Planning and Zoning Board Regular Meeting Wednesday, November 17,2004 6:30 p.m. 1. CALL TO ORDER Chairman Vopelak called to order the Regular Meeting of the Planning and Zoning Board at 6:30 p.m., November 17, 2004 in the Community Center, located at 102 N. Riverside Drive, Edgewater, Florida. 2. ROLL CALL Members present were Edwin Vopelak, Sandy Jones, Todd Fuhrmann, Robert Garthwaite, Charlene Zeese and Pat Card. Kristine Pluscec was absent. Also present were Chief Planner Darren Lear, Paralegal Robin Matusick, and Planning Technician Pat Drosten. 3. APPROVAL OF MINUTES MOTION bv Mr. Garthwaite. second bv Ms. Jones to approve the minutes of October 13, 2004 as presented. MOTION CARRIED 6-0 PUBLIC HEARiNG 4. OLD BUSINESS None at this time. 5. NEW BUSINESS PUBLIC HEARING a. V A-0406 _ Joseph T. Wagner, owner requesting variances from Section 21-50.02 (Table V-I) of the City of Edgewater Land Development Code for a proposed lot split for property located at 2530 Travelers Palm Drive. Chairman Vopelak opened the public hearing. Mr. Lear provided a summary of the request. Mr. Wagner spoke regarding the reasons for his request. Mrs. Wagner spoke in favor of the request. Much discussion ensued regarding the request including various options and the possibility of setting precedent for non-conforming lots if the variance is granted. Chairman Vopelak closed the public hearing. MOTION bv Ms. Zeese. second bv Mr. Card to deny the variance from Section 21-50.02. Table V-I minimum lot s uare foota e and width to allow the creation of an 8 442 s uare foot lot in the R-2 zonin~ district in lieu of the reauired 10.000 sauare feet. MOTION CARRIED 4-2 b. AN-0403 _ Mr. Robert Jalbert, Sr., requesting the annexation of 12::1: acres ofland located at 2203 and 2295 Cow Creek Road. Chairman Vopelak opened the public hearing. Mr. Lear provided a summary of the request. Discussion ensued regarding the current land use and zoning of the property. Mr. Lear stated that the Board would hear a request for a Comprehensive Plan amendment, rezoning and possible redevelopment of the property in the future. MOTION CARRIED 6-0 c. AN-0404 - Mr. Robert Jalbert Sr., requesting the annexation of one and one-half (1 ~ acres) of land located at 3208 Eels Grove Road. Chairman Vopelak opened the public hearing and Mr. Lear provided background information. Chairman V opelak closed the public hearing. MOTION bv Mr. Garthwaite. second bv Ms. Zeese to send a favorable recommendation to City Council for the annexation of approximatelv 1.15 acres of land located at 3208 Eels Grove Road. 6.
