CALL TO ORDER Chairman Vopelak called to order the Regular Meeting of the Planning and Zoning Board at 6:30 p.m., January 12,2005 in the Community Center, located at 102 N. Riverside Drive, Edgewater, Florida. 2. ROLL CALL Members present were Edwin Vopelak, Todd Fuhrmann, Charlene Zeese, Pat Card, Sandy Jones, Robert Garthwaite and Kristine Pluscec. Also present were Chief Planner Darren Lear, Paralegal Robin Matusick, and Planning Technician Bonnie Wenzel. 3 . APPROVAL OF MINUTES MOTION by Mr. Card. second by Mrs. Pluscec to approve the minutes of December 8. 2004 as presented. MOTION CARRIED 6-0 - Mr. Garthwaite abstained from votinl! as he was not at the December meetinl!. PUBLIC HEARING 4. OLD BUSINESS None at this time. 5. NEW BUSINESS PUBLIC HEARING a. FP-0403 - City of Edgewater requesting Final Plat approval for the Parktowne Industrial Center. Chairman Vopelak opened the public hearing. Mr. Lear provided background information and staffs recommendation. Chairman V opelak closed the public hearing. Motion by Mrs. Zeese. second by Ms. Jones to send a favorable recommendation to City Council for Final Plat approval of the ParkTowne Industrial Center. MOTION CARRIED 7-0 b. RZ-O 1 00 - City of Edgewater requesting an amendment to the Official Zoning Map to include 45::1: acres of land located at 3315 W. Indian River Boulevard as P/SP (Public/Semi-Public). Chairman Vopelak opened the public hearing. Mr. Lear provided background information and staffs recommendation. Mr. Lear further stated that agenda items b-m are all related to the Comprehensive Plan Future Land Use Map amendments that were completed in 2001, these amendments were being completed to bring the Official Zoning Map into compliance with the Future Land Use Map. MOTION CARRIED 7-0 n. AN-0416 - Marcia Barnett requesting annexation of 2.33::l:: acres of land located south of 3171 S. Ridgewood Avenue. Chairman Vopelak opened the public hearing. Mr. Lear provided a synopsis of the request, as well as the staff recommendation. Mr. Lear stated there were no proposed changes to the use of the property at this time; the applicant was only seeking annexation of the parcel. Fred Dunam, 106 S. Cory Drive, spoke against the proposed development. Mary Dunam, 106 S. Cory Drive, spoke against the proposed development. Ken Klise, 143 S. Cory Drive, spoke against the entrance on Cory Drive. Mr. Ashton, 152 S. Cory Drive, spoke against the entrance on Cory Drive. There was discussion regarding the proposed use of the property and its ownership, Mr. Lear reminded everyone that the Diocese of Orlando owned this piece and there were no proposals to develop the property at this time. The applicant was requesting annexation only. Chairman Vopelak stated that everyone's objections were duly noted and closed the public hearing. Ridgewood Avenue and the vacant parcel to the east. Chairman V opelak opened the public hearing. Mr. Lear provided background information on the request, as well as the proposed development of the site. Discussion ensued regarding the proposed location of the driveway and whether or not that was the most logical location. Luis Geil, 2305 S. Ridgewood Avenue, spoke about the proposed development. Mr. Lear stated there might be a variance request before them in the future for this site. Chairman Vopelak closed the public hearing. MOTION by Mr. Fuhrmann. second by Ms. Jones to send a favorable recommendation to City Council for the annexation of 1.03::1: acres of land located at and east of 3301 S. Ride:ewood Avenue. Chairman V opelak stated the discussion from the annexation request would be included by reference. Discussion ensued regarding the proposed development and current zoning of the property. There was further discussion concerning the proposed driveway location. Amy Berg spoke about the proposed businesses to be located at this location. Mr. Lear stated the site plan would not come before the Planning and Zoning Board or City Council, it would be reviewed by the Technical Review Committee. Mr. Card then stated this would be their only opportunity to make recommendations on how the site should look. Fred Dunam, 106 S. Cory Drive asked if the Cory Drive property owners had any representation from the County regarding this annexation request. Mr. Lear stated that the County has been notified of the request and had no opposition. Marcia Barnett, 124 Flamingo Road spoke of the proposed development. Mrs. Zeese asked if the Board could require a traffic study be completed. Mr. Lear stated that could be a recommendation to Council. Mary Dunam, 106 Cory Drive spoke in opposition to the development. Sign Agreement between the City of Edgewater and Patrick and Tanya Girvan to bring the existing sign located at 2001 S. Ridgewood Avenue into compliance with the City of Edgewater Land Development Code. Chairman V opelak opened the public hearing. Mr. Lear provided background information and staff recommendation. Discussion ensued regarding the length of the agreement and whether six (6) months was an excessive amount of time to remove or bring the sign into compliance. Mr. Lear stated there were other issues associated with this site and they were all negotiated at the same time, and he did not think the time was exceSSIve. David Ross, 2803 Needle Palm Drive spoke about the agreement. John Cordero, 1515 Pine Tree Drive spoke about the agreement. Mr. Lear stated there was a provision in the Land Development Code for Sign Agreements. Robin Matusick, City of Edgewater Paralegal stated the agreement was negotiated with the owners while they were going through the Code Compliance process. She added that there will be more agreements coming before them in the future. Chairman V opelak closed the public hearing. MOTION by Mr. Garthwaite, second by Ms. Jones to send a favorable recommendation to City Council to allow the City to enter into a "Sie:n Ae:reement" with Patrick J. Girvan and Tanya Belinda Girvan. Planning Director's Report Mr. Lear stated that the variance for lot size on Travelers Palm Drive will be revised and back before the Board in February. b. Chairman's Report None at this time. c.
