CALL TO ORDER Chairman Vopelak called to order the Regular Meeting of the Planning and Zoning Board at 6:30 p.m., December 14, 2005 in the Community Center, 102 N. Riverside Drive, Edgewater, Florida. 2. ROLL CALL Members present were Edwin Vopelak, Pat Card, Robert Garthwaite, Todd Fuhrmann, Sandy Jones and John Weiss. Charlene Zeese was excused. Also present were Development Services Director Darren Lear, Paralegal Robin Matusick, and Planning Technician Bonnie Wenzel. 3. APPROVAL OF MINUTES MOTION bv Mr. Garthwaite. second bv Mr. Card to approve the minutes of November 9.2005 as presented. MOTION CARRIED 6-0 PUBLIC HEARING Chairman Vopelak stated that three (3) items on the agenda are being tabled to the January 11, 2006 meeting. MOTION bv Ms. Jones. second b Mr. Garthwaite to continue items AN-0514. AN-0515. and VA-0514 to the January 11. 2006 meeting. MOTION CARRIED 6-0 4. OLD BUSINESS a. RZ-0510 - Scott Tobin, requesting an amendment to the Official Zoning Map to include 30.0H acres of land located north of Jones Fish Camp Road and east of US Highway 1 as RPUD (Residential Planned Unit Development). Chairman Vopelak opened the public hearing and stated the workshop held on November 14, 2005 would be included in the discussion by reference. Mr. Lear provided background information on this request. Glenn Storch, 420 S. Nova Road, Daytona Beach, provided a power point presentation of the proposed development. Mr. Storch stated this development was designed with Smart Growth in mind, and that 80% of the site would be left natural. He added that the view of the condominiums would be minimal. The development is being clustered to preserve natural habitats and vegetation. Mr. Storch added that condominiums generally use less roads, and City services due to the majority of residents being part time. He added that there will also be conservation easement on the open space in the property that will not allow any further development. Mr. Card went over the six (6) criteria for Smart Growth and determined that the development did not meet all criteria. Mr. Storch stated the condominiums were a better alternative to 360 townhouse units throughout the entire property. He added that commercial projects would follow the residential projects. He stated that the density is there for the project; it is just a matter of how the property will be used. Joanne Heeb. 115 N. Riverside Drive. questioned the use of clustering, the amount of wetlands on site, the removal of trees and how quickly the developer feels they will sell out. 12-14-05 p&Z Minutes ~ CITY OF EDGEWATER """" Planning and Zoning Board Regular tWeeting Wednesday, December 14, 2005 6:30 p.m. Mr. Storch responded by saying that the only area of wetlands is in the northeast corner of the property, which will not be impacted, and there would only be one (1) access road to the site. David Hood responded that they plan to sell out the units rather quickly. The following residents spoke against the development due to concerns with the added number of residents, traffic, schools, drainage, wildlife/environmental impacts, concerns for Boston Whaler and use of the land: Andy Anderson, 1730 Pine Tree Drive Carol Stoughton, 2740 Evergreen Drive Mike Schmidt, 2063 Porto Blvd., New Smyrna Beach Yvonne Bice, 210 N. Riverside Drive John Cordeiro, 1515 Pine Tree Drive Dot Carlson, 1714 Edgewater Drive Barbara Sanchez, 408 Central Mariners Drive Mr. Storch responded to each concern. He stated that a preliminary environmental impact analysis has been done and a more in depth study will follow. Mr. Tobin stated that studies show very few children live in condominiums, so the impact to schools should be minimal. Mr. Storch stated the impact on Boston Whaler would be minimal due to the placement of the buildings. He added that a weeklong study was completed to test for odors and none were found on-site. The following residents spoke in favor of the development: John Russell. 3045 Woodland Drive Ralph Richardson, 151 Ariel Road, stated he did not have a problem with the development, but would like to see it fenced. Mr. Fuhrmann stated that the City is changing and he is proud to be a part of a growing community. Mr. Fuhrman added that he has spoken to the president of Boston Whaler and was assured they are not planning to move out of Edgewater. Mr. Fuhrmann asked approximately how many more sites are suitable for condos. Mr. Lear stated possibly only one (1) or two (2) more. There being no further discussion Chairman Vopelak closed the public hearing. Mr. Lear provided background information. There being no questions or comments Chairman Vopelak closed the public hearing. MOTION CARRIED 6-0 b. DA-0501 - Coral Trace Associates requesting an amendment to the RPUD Agreement for the Coral Trace Subdivision. Chairman Vopelak opened the public hearing. Mr. Lear provided background information. Chairman Vopelak asked if the density would remain the same. Mr. Lear stated the density would not exceed the 3.5 units per acre in the existing RPUD Agreement. Mr. Card asked how the improvements along Becks Grove Road were going. Mr. Lear stated that the road has been realigned and they were working on the ditch. Matthew Markofsky, Coral Trace Associates, stated the road has been cleared and the work on the ditch has begun. SD-0505 - Coral Trace Associates requesting replat approval of the Coral Trace subdivision, adding 22 lots to be known as Coral Trace Phase II. Chairman V opelak opened the public hearing and stated the previous discussion would be incorporated with this request. There being no further discussion Chairman V opelak closed the public hearing. MOTIONbv Mr. Garthwaite. second bv Mr. Card to send a favorable recommendation to City Council for the replat of Coral Trace Phase II. addine: 22 lots. MOTION CARRIED 6-0 d. VA-0515 - James Morris, Esq., requesting a variance from Articles IV and V of the City of Edgewater Land Development Code to allow the construction of a single-family residence on property located at 1505 S. Riverside Drive. Chairman Vopelak opened the public hearing. Mr. Lear provided background information. Mr. Lear stated that the TRC reviewed the request and voted to recommend denial to the Planning and Zoning Board. Jim Morris, 420 S. Nova Road, Daytona Beach stated they are asking for a variance to the mean high water line because the existing house is no longer functional. He stated the owner would like to keep the new house in line with the neighboring homes. He added that the property has an existing vertical seawall and has been filled and sodded. Mr. Morris further stated that the location of the new house will not have a negative impact on the environment. There was much discussion regarding what reasonable use was defined as. Mr. Garthwaite asked why the TRC recommended denial of the request. Mr. Lear stated it was because they did not feel the request met the requirements of the granting of a variance. Chairman Vopelak stated the owners could have reasonable use without the variance. Ferd Heeb, 115 N. Riverside Drive, spoke in favor of the request. Yvonne Bice, 217 N. Riverside Drive also spoke in favor of the request. There being no further discussion Chairman Vopelak closed the public hearing. MOTION bv Mr. Card. second by Mr. Fuhrmann to approve the variance reauest from the Citvof Ede:ewater Land Development Code Section 21-41.04(a) and Section 21-50.02 (Table V-I) to allow a minimum setback of 20-feet a the closest point in lieu of the reauired minimum buffer of 50-feet from 12-14-05 p&Z Minutes 4 ........
