08-18-1994 l r i1 / I 4 CITY OF EDGEWATER �✓ BUILDING TRADES REGULATORY AND APPEALS BOARD SPECIAL MEETING AUGUST 18, 1994 7 :00 P.M. Chairman Gary Butt called to order the Special Meeting of the Building Trades Regulatory and Appeals Board on Thursday, August 18, 1994, at 7 :00 p.m. in the City Hall Conference Room. ROLL CALL: Members present were Chairman Gary Butt, John Ciaffoni, Michael Nelson, Robert Howard, Les Ogram, and Lester Yarnell. Douglas Cole was absent. Also present were Robert Dunn, Building Official and Tonya Elliott, Recording Secretary. APPROVAL OF MINUTES: Chairman Butt asked if there were any additions or corrections to the minutes of July 21, 1994 . Being none, Mr. Howard made a motion to approve the minutes of July 21, 1994. Seconded by Mr. Ogram. Motion CARRIED 6-0. UNFINISHED BUSINESS: 1) Construction Regulation Board (CRB) Draft Review - Chairman Butt asked Mr. Howard for his comments. Mr. Howard said he was uncomfortable with the draft as presented. He has found in his previous experience serving on a Building Trades Board that it is easier to do something than to undo, and if the Board was to approve the draft it will come back to haunt them. Mr. Howard continued by saying he would like to see the Board request a workshop with City Council and the City Manager, that he did know the City Manager was receptive to this idea, and is also receptive to exploring the expansion of the duties of the Board, and several of the Council are amenable to a workshop session to outline the Boards duties. Chairman Butt asked Mr. Howard if his main fault with the draft was it was not broad enough. Mr. Howard said yes in general, and that it reduces the scope of the responsibilities and limits the actions of the Board by increasing the involvement of the Fire Department. There was a lengthy discussion on how a combined Building/Fire Board would limit the Boards duties. Mr. Dunn brought to the Boards attention Paragraph A, Creation, Powers and Functions, which he said outlines the Boards duties and is very broad, giving the Board several functions. He also said that staff was not trying to limit the Boards activities. Chairman Butt said possibly the problem was with the wording. Mr. Ciaffoni agreed saying he felt the intent was good. The Board had a discussion on the wording of different sections of the draft. Mr. Nelson asked were the wording came from. Mr. Dunn said the City of Deland, which was a recommendation from this Board. Building Trades Regulatory and Appeals Board August 18, 1994 Page -02- Chairman Butt said he understood their concerns, however, he did not feel the draft was that restrictive. Mr. Ogram said he felt it was extremely restrictive, and would also like a workshop with Council. Mr. Dunn explained that most of the other City's Boards strictly hear appeals, and that the CRB will be given many powers and functions, and by working together as a team, recommendations could be brought to the Board relating to code matters, problems with contractors, and various other items. Mr. Howard agreed that working together was the idea, but he still would like to hear from Council which direction they would like the Board to go. Chairman Butt asked if it would require something as formal as a workshop, or if a letter would be acceptable. Mr. Howard said it could be a letter, but he feels personally from what he is hearing, Council would like to hear from the Board members. Chairman Butt asked Mr, Howard if he would like to make that in the form of a motion. Mr. Howard moved that the proposed CRB Draft Review recommendation from the Board be postponed until the Board has an opportunity to have a workshop session with the City Council and Staff. Seconded by Mr. Yarnell. After discussion, motion CARRIED 6-0. 2) Election of Vice-Chairman - Chairman Butt explained at the July 21, 1994 meeting an error was made in the election of officers, and opened the nominations for Vice-Chairman. Mr. Ogram nominated Mr. Howard. Seconded by Mr. Yarnell. Motion CARRIED 6-0. NEW BUSINESS: 1) Local discipline and registration pursuant to Chapter 489.117 (2) , Chapter 489.131(7) and Board Rule 61G4-20.001. - Chairman Butt asked Mr. Dunn if he would please explain. Mr. Dunn said he had contact the Department of Business and Professional Regulation (DPR) and, basically registered contractors within the State of Florida who work in Volusia County or the City will no longer be disciplined by DPR. Therefore, one of the expanded roles of the Board he is recommending will be to discipline registered contractors who violate City Ordinance or State Code. Mr. Dunn further explained what the Boards role would be, and what actions taken by registered contractors would require discipline by the Board. The Board discussed the process and how violations by registered contractors are currently handled. Being none, he said he would like to discuss changing the meeting night because Thursday was difficult for him to make. The Board discussed which night would be suitable for everyone. Mr. Ciaffoni moved to change the meeting from Thursday night to Tuesday night. Seconded by Mr. Nelson. Motion CARRIED 6-0. There being no other business to come before the Board, a motion to adjourn was made and seconded.
