It was a victory for the Florida Home Builders Association, which worked in last year's session to place reasonable windload and windborne debris requirements into the code, and this year fine-tuned key provisions involving product approval, code-compliance training, and builder liability. FHBA was also successful in preserving workers' compensation exemptions for 120,000 corporate owners and independent contractors in Florida's construction industry. Under fire from the Division of Workers' Compensation and organizations comprised of large business owners, exemptions would have been eliminated entirely in a Senate bill and limited (to two corporate officers with a minimum of 10 percent ownership each) in a House bill. "Our members flooded their legislators with phone calls, faxes and e-mails in the final two days of the session on the exemption issue," said FHBA Legislative Counsel Richard Gentry. "That was the key to our success in seeing the exemptions survive." The Senate and House ran out of time without resolving two other housing-related issues—growth management reform and changes to the Administrative Procedures Act(APA), which would have limited third- party challenges to development approvals. The Senate passed a growth management bill that contained broad-based funding for new school construction in the form of removing the referendum requirement(allowing a super-majority vote of the school board) on adoption of a half-penny sales tax. The House leadership remained opposed to funding proposals. FHBA President Ron Coppenbarger, who was in Tallahassee for the final days of the session along with First Vice President Barbara Revels and Governmental Affairs Chair Walter Williams, spoke by phone to Governor Jeb Bush on the last day of the session in an effort to break the logjam on growth management. but the Senate and House never came together on the issue. "I feel like we were on the five yard line when time ran out," said Coppenbarger. "The Governor indicated he wants to continue the dialogue with us to achieve a workable growth management plan." Coppenbarger said FHBA remained consistent in its growth management message that was conveyed early in the session when members produced and delivered 16,000 2X4s to Tallahassee with the theme: "Fund Florida's Future...Schools for Our Children." "We stayed true to our commitment to our members that broad-based, bondable funding was the key to an effective growth management bill,"said Coppenbarger. "I hope our members understand that sometimes the best legislative sessions are produced when bad bills don't pass," said Revels. "The growth management and workers' compensation bills, as written, presented serious threats to our industry. It was through our grass-roots lobbying efforts—with members contacting their legislators—that we were able to avoid the problems those bills would have caused us." Williams gives additional credit to FHBA's experienced lobbying team, comprised of Gentry, Governmental Affairs Director Doug Buck, General Counsel Keith Hetrick and Political Affairs Director Wayne Bertsch. "We have the best lobbyists in the business," said Williams. "They have earned the respect and confidence of the key players in the legislative arena here in Tallahassee." Coppenbarger was also quick to praise the many legislators who supported FHBA positions during the session. including Senators Jim Horne (R-Jacksonville), Ken Pruitt(R-Port St. Lucie) and Tom Lee (R-Tampa), who fought for growth management funding; and Reps. Tindall's term on the Construction Regulation Board (CRB) expired. Mr. Tindall had originally said he would not seek re-appointment. BACKGROUND. The CRB by-laws require that two (2) of the members be chosen from the following Florida licensed contractors: electrical, plumbing, and air conditioning. Mr. Tindall who is a Florida licensed plumber held one (1) of these positions, and the other required position is held by a Florida licensed electrician. On May 29, 2001 the Board reviewed two (2) applications from electrical contractors to fill the position being vacated by Mr. Tindall. It was the consensus of the Board to try to locate a licensed plumber or air conditioning contractor within the City of Edgewater since the CRB already has a member who is a licensed electrician. Two (2) more applications have been received from contractors who meet these requirements. They are: Jeffrey Knight, Florida licensed plumber; and Larry Lovingood, Florida licensed air conditioning contractor. Staff has also spoken to Mr. Tindall and he has agreed to serve another term if needed. Copies of the new applications and ballots were sent to Board members for their review and recommendation. The Board's first choice is to re-appoint Mr. Tindall for another term. The Board's second choice is to appoint Mr. Lovingood.
