ANIMAL CONTROL BOARD
January 16, 2002

MINUTES
CALL TO ORDER
The regular meeting was called to order by co-chairperson, Donna Wagner, at
7:00 PM in the City Hall Conference Room.
ROLL CALL
Members present were: Donna Wagner, Liz Scavarda, Dr. D. Vanis, and Debrah
Brazzell. Also present were: Legal Assistant Robin Matusick, Animal Control
Officer David Castetter, Captain Jill Landerville, Councilman Brown, Officer W.
Yeomans, Charles Tiedemann, Angela Nolan, and Board Secretary Sue Griffiths.
Members absent were: Robin Hendricks
APPROVAL OF MINUTES
Motion to approve the minutes of the October 17, 2001 and December 06, 2001
meetings was made by Debrah Brazzell, seconded by Liz Scavarda. Motion
unanimous.
OLD BUSINESS
DOQ Park
Captain Jill Landerville advised the board members that upon discussion with
parks and recreation supervisor Jack Corder it was decided that none of the City
of Edgewater's Parks would be appropriate for a dog section. Capt. Landerville
stated that to have a unleashed dog park you needed to fence and double gate
the entrance and if this was attempted at Rotary Park, the park previously
choosen as a possible site, it would be a very small area which would be similar
to a back yard. Capt. Landerville continued that Animal Control Officer David
Castetter has been gathering information on other Dog Parks and they have
found that there is one located in Sanford and it is a location for dogs only.
They have been checking into finding grant money for the financing for the dog

only park and also will be checking into finding a location within the city to create
the park.
Councilman Brown suggested the Capt. Landerville meet with Mr. Hooper to
discuss the possibility of using land in the new industrial park. Donna Wagner
suggested the old city landfill on Air Park Road as another possible location.
Capt. Landerville advised that she would take the suggestions and advise the
board at the next meeting what she has found.
Danaerous Doa
Update
Animal Control Officer David Castetter advised the board members on the
current situation with dogs deemed dangerous by the board. Mr. Castetter
advised that Wesley, Sampson, and Luckey were all euthanized by the owners.
He stated that Dakota and Cheyenne, the most recently deemed, have been split
up by the owner giving one of the dogs to a friend resulting in no further
problems. Mylow is currently doing well at his residence, his owners are
following all the dangerous dog stipulations and there have been no complaints
from the neighbors. Mr. Castetter advised that the owners of Torque have not
complied and were present tonight to discuss their current situation with the
board.
Toraue
Angela Nolan stated that she knows Robin Hendricks and has recently discussed
her situation with her. She advised that Ms. Hendricks stated she should come
to the board meeting and get the decision revoked. Ms. Nolan advised that Ms.
Hendricks has been to her house and did not find the dog to be dangerous but
very friendly and loving. Ms. Nolan provided pictures that she had taken two
weeks prior, for the board to view and see how well behaved and lovable
"Torque" is. Animal Control Officer Castetter asked Ms. Nolan why she was in
contact with Torque. Ms. Nolan advised that she lives in the same house with
Mr. Teidemann as his girlfriend. Animal Control Officer Castetter advised Ms.
Nolan that the quidelines state she is not to have any contact with "Torque"
because she was the victim of the dog attack. Ms. Nolan stated that the dog
was being protective of Mr. Teidemann when they were having a disagreement
and that the dog would not hurt her. Animal Control Officer Castetter inquired,
while holding up a picture taken of "Torque" in the back yard, why the dog was
not in a non escapable roofed enclosure as stipulated in the requirements. Ms.
Nolan advised that they have not complied to the guide lines stipulated due to
financial difficulties.
Robin Matusick advised Ms. Nolan and Mr. Teidemann that Robin Hendricks is
not an active participant on the board right now. Ms. Matusick also advised that

Ms. Nolan could not appeal on the dogs behave being the victim and not an
owner of the animal. Ms. Matusick stated that Mr. Teidemann, the owner, was
notified by letter that they could appear in front of the board at the special
meeting held to deem "Torque" dangerous to discuss his views. Ms. Matusick
stated that they were also advised that they had ten days after the boards
decision to appeal with the county court. Mr. Teidemann advised that he just
recently went to the county court house and was advised he needed to see the
Animal Control Board for the City of Edgewater.
Robin Matusick advised that according to our records they had ten days from the
date the letter was hand delivered by Animal Control Officer David Castetter on
August 4th, 2001 to appeal the decision through the county court.
Mr. Teidemann left the meeting without further discussion.
MISCELLANEOUS
Chairoerson
Robin Matusick advised the board members that she had spoke to Robin
Hendricks and was advised that after a doctors appointment on todays date she
would know if she was going to return to the board. Robin Matusick advised that
if Ms. Hendricks did not return to the board they would have to review
applications to fill the empty position. Ms. Matusick also advised that the board
members were to re-elect chairperson and co-chairperson at todays meeting
according to the ordinance. Ms. Matusick was asked by Donna Wagner if they
should wait until Ms. Hendricks returns to nominate and vote. Ms. Matusick
advised that if Ms. Hendricks decided not to return then at the next meeting the
board would have to select a new member wait for councils approval and at the
following meeting in October they could then choose the positions by vote.
Animal Control Board Secretary Sue Griffiths also advised that she had copies of
the most recent applicants interested in being on the board so they may review
for the next meeting. After all members reviewed the applications, the board
members selected three candidates for the board secretary to contact in the
event that Robin Hendricks decides not to return. After a brief discussion
among members regarding the election the following motions were made.
Motions:
Motion made by Dr. Vanis to nominate Donna Wagner for Chairperson, seconded
by Debrah Brazzell. Motion Unanimous. Donna Wagner not voting.
Motion made by Donna Wagner to nominate Debrah Brazzell for Co-Chairperson,
seconded by Liz Scavarda. Motion Unanimous. Debrah Brazzell not voting.

Appreciation
Councilman Brown stated that he would like to thank Animal Control Officer
David Castetter for taking care of a dog barking situation. He stated that he was
contacted by the complainant several times and that after speaking to Officer
Castetter the situation was taken care of and there have been no further
problems.
ADJOURNMENT
Motion to adjourn the meeting was made by Debrah Brazzell, seconded by Dr. D.
Vanis. Motion carried unanimous. The meeting was adjourned at 8:29 P.M.
