2014-R-14 RESOLUTION NO.2014-R-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF .EDGEWATER, FLORIDA; SUPPORTING THE SCHOOL BOARD OF VOLUSIA COUNTY'S REFERENDUM TO EXTEND THE ONE-HALF CENT SALES SURTAX FOR SPECIFIED PURPOSES FROM 2017 THROUGH 2031; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on October 9, 2001, the electors of Volusia County approved a sales surtax levy of 0.5 percent (one-half percent/one-half cent) pursuant to sections 212.54 and 212.055(6), Florida Statutes, for a fifteen (15) year period for the limited purposes of capital expenditures or fixed capital costs, associated construction-related costs, technology implementation at schools and bond indebtedness financing costs;and WHEREAS, this levy will expire on December 31, 2016 unless extended by the electors of Volusia County; and WHEREAS, on January 28, 2014, the Volusia County School Board approved the recommendation of the Citizens' Capital Needs Committee capital projects list("New Capital Project Needs Plan" which is attached hereto and incorporated herein as Exhibit "A") that identified new - project needs for an additional fifteen(15)year period; and WHEREAS, the City of Edgewater hereby supports the School Board of Volusia County's referendum question for extension of the one-half cent sales surtax from 2017 through 2031. NOW,THEREFORE,be it resolved by the City Council of Edgewater,Florida: 2014-R-14 1 I Section 1. The City of Edgewater hereby supports the School Board of Volusia County's referendum question for extension of the one-half cent sales surtax from 2017 through 2031 to fund the Citizens' Capital Needs Committee capital projects list("New Capital Project Needs Plan"which is attached hereto and incorporated herein as Exhibit"A"). Section 2. If any section, subsection, sentence, clause, phrase, or portion of this Resolution, or application hereof, is for any reason held invalid or unconstitutional by any Court, such portion or application shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions or applications hereof. Section 3. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 4. This Resolution shall become effective immediately upon passage and adoption.
