'WI CITY OF EDGEW A TER POLICE PENSION BOARD Regular Meeting Wednesday, October 27,2004 Planning Department Conference Room 2:00 p.m. Minutes CALL TO ORDER: The Police Pension Board Regular Meeting was called to order on Wednesday, October 27,2004 at 2:00 p.m. in the Planning Department Conference Room. ROLL CALL: Members present were Bill Lenz, Ferd Heeb, Rena Green, Kimberly Rash and Brett Tanner. Also present was Attorney Ken Harrison, Sugarman & Susskind, Deborah Sigler, Personnel Director and Donna Looney, Personnel Administrative Assistant and Kathy Miller, Recording Secretary. APPROVAL OF MINUTES: MOTION Ferd Heeb moved to Defer readin2 of the minutes until they are available. seconded by Rena Green. MOTION CARRIED 5-0 OLD BUSINESS: The Board members discussed the Investment Policy with Attorney Harrison. Attorney Harrison explained that the statute is very specific on what must be included. MOTION Ferd Heeb made a motion that the Board en2a2es the firm SU2arman & Susskind. specifically Ken Harrison. to draft a new Investment Policy to conform to our contractual relationship with Principal Mutual. seconded by Officer Rash. MOTION CARRIED 5-0 Sgt. Lenz said that in the last meeting the legal question of Robin Bell requesting her pension from Principal was discussed. Sgt. Lenz said that this didn't go on the agenda but was referred to the attorney. MOTION Ferd Heeb made a motion to have Attorney Ken Harrison review Robin Bell's pension with Principal and for Attorney Harrison to direct the Board on how to act on it. seconded by Brett Tanner. MOTION CARRIED 5 - 0 ~ ...., Officer Rash reminded the Board of the issue where there was a divorce decree where some payments were issued inappropriately before the worker retired. Mr. Harrison stated that those payments have been stopped and he is dealing with Principal on this matter. MOTION Ferd Heeb made a motion to ratify the action taken bv the attorney concernin2 determination of premature payments for the third party. seconded bv Officer Rash. MOTION CARRIED 4 - 0 Bill Lenz Abstained NEW BUSINESS: Attorney Ken Harrison of Sugarman & Susskind was introduced and reviewed the duties and responsibilities of the Board. The following subjects were included in his conversation with the Board: 1. The Board of Trustees responsibilities to attend educational seminars at least once a year. 2. The Board of Trustees must meet at least four times a year. A quorum is three (3) members. 3. There must be a written investment policy including seventeen (17) specific items. 4. Employee retirements must be approved by the Board. This can be delegated but should be placed on the Board's agenda for ratification. 5. Contracts entered into with Principal Mutual and/or the City. Attorney Harrison requested copies. 6. Written meeting procedures. Attorney Harrison will provide guidelines to the membership for adopting. 7. A new retainer agreement to be prepared by the law firm with Attorney Harrison as the Attorney of record for this board. MISCELLANEOUS: The next meeting for the Police Pension Board was set for December 1, 2004 at 2:00 p.m. ADJOURNMENT: With no further business to discuss, Ferd Heeb moved to adjourn, seconded by Brett Tanner. Ken Harrison a University of Miami School of Law graduate also holds a Masters of Science Degree in Management from Biscayne College, (Saint Thomas University) and a Bachelor of Business Degree accounting major from the University of Miami. He received the Roger Sorino Award as the outstanding senior of his law school graduating class. Ken, a Certified Public Pension Trustee (CPPT), is a founding member of the Florida Public Pension Trustees Association, (FPPT A), and currently serves as Director Emeritus for that organization. Ken entered law school after completing a 26-year law enforcement career, retiring from the City of Miami (Florida) Police Department as Assistant Chief For 16 years during his career in law enforcement Ken served as a trustee for Miami's Police and Fire Pension Funds. Additionally, for 10 of his years in law enforcement Ken was active in police labor organizations at the local, state and national levels. Mr. Harrison is also retired from the United States Coast Guard Reserve (USCGR) as a Captain (Colonel) after a 34-year career. Among his many assignments with the USCGR he served as senior attorney in the Seventh District Legal Office; Project Officer for the U.S. Army's Southern Command move from Panama to Miami; Deputy Chairperson of Coast Guard Olympic Security Coordinating Committee; Director of Coast Guard Relief Activities for Hurricanes Andrew and Georges and Senior Coast Guard Officer for Desert Storm Victory Celebrations in Washington DC and New York. Ken is active in the Miami Law School Alumni Association, serving on its board of directors and has acted as class agent for his graduating class. He is also active in the Coral Gables Bar Association, as a member of its board of directors and the Dade County Bar Association, serving on its Professionalism Committee. Mr. Harrison has been associated with the Coral Gables Law Firm of Sugarman & Susskind since being admitted to Florida Bar, and became a shareholder in January of 2004. He practices in the area of employment and labor law focusing on union side issues that include employee benefits and pension law. Ken and his spouse of 41 years, the former Carol Ann Greth of Reading Pa. raised three sons and enjoy two granddaughters and two grandsons.
