09-18-2003 ~ ...., CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, September 18, 2003 5:30 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Co-Chairperson George Ann Keller called to order the regular meeting of the Citizen Code Enforcement Board at 5:32 PM in the Community Center. ROLL CALL Members present were: Co-Chairperson George Ann Keller, Linda Johnson, Joy Brindley, Ben Delnigro, Glenn Barnhill and Ed Corn. Also present were: City Manager Ken Hooper, Captain Jill Danigel, Code Compliance Officer Angela DeSue and Board Secretary Shontella Jackson. Absent were: Chairman Anthony Fowler notified the City Clerk of his resignation. A copy of the letter of resignation was presented to all the Board Members. APPROVAL OF MINUTES The minutes for the regular meeting of August 28, 2003 were presented to the Board for approval. There being no corrections or changes a motion was made for approval. MOTION by Ed Corn, SECONDED by Linda Johnson to aDDrOye the minutes of the Auqust 28, 2003 meetinq. MOnON CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Co-Chairman George Ann Keller requested that anyone with statements or comments pertaining to any of the cases, stand and be sworn in. Mr. Kenneth Schultz was sworn in for testimony. Code Compliance Officer Angela DeSue and Captain Jill Danigel were sworn in for testimony as well. NEW BUSINESS: Case # 2003-CE-5040, 3100 block of India Palm Dr.. Edaewater, Florida 32141: Kenneth and Peaav Schultz. Violation of Otv Ordinance ChaDter 21 Section 36.03 - Outdoor storape and disDlav: commercial/industrial. . . ....... """" Capt. Jill Danigel presented the Board with a case summary. Code Compliance Officer Angela DeSue gave a brief timelinefbackground on the Schultz case. The only issue brought forth on this case is that it does not comply with the outdoor storage ordinance. Photos were shown to the Board to provide insight of violation on the property. Mr. Schultz took the stand to present his case. He asked the Board for four month to obtain financing to do the building but he has no other place to go. He presented the Board with photos he took of the property as well. Capt. Jill Danigel presented staff recommendation that the Board find Mr. Schultz in violation of Section 21-36.03 of the City's Land Development Code and would like for the Board to make a motion to impose a fine of $53 for the violation of Section 21-36.03 as well as an additional fine of $50 per day for each day the violation continues to exist past September 18, 2003. Mr. Schultz acknowledged the violation before the Board Members. MOTION by Ben Delniqro, SECONDED by Ed Corn to acceDt the staff recommendations of $53 fine ~50 a day for continued violation. Motion carried 4 - 2. OLD BUSINESS: Co-Chairperson George Ann Keller addressed the extension of terms for George Ann Keller and Linda Johnson. Mr. Hooper explained the extension of terms of George Ann Keller and Linda Johnson to January 5, 2004 was approved by City Council. After January 5, 2004 you will have a list of applicants to review for your recommendation to City Council. Mr. Hooper explained that the removal of a Board Member from office is listed in all the Boards' bylaws. Mr. Hooper also addressed the issue in regards to meeting time. Mr. Hooper stated it is the Boards' call. City Council has not indicated a day or night. He encouraged the Board Members to think about and talk about Board meeting time fairly frequent, eventually it will probably move into a daytime issue, particularly with the citations. MOTION by JOY Brindley, SECONDED by Ben Delniqro to acceDt the bylaws. Motion CARRIED UNAMIOUSLY. Co-Chairperson George Ann Keller signed the bylaws with the Board approval. CODE ACTIVITY REPORT: Capt. Danigel stated that Chairman Fowler has resigned. Next month the Board will review applications for vacant position and vote for chairperson. In November, the Board will review applicants for the potential openings of the terms, which are going to expire in January. Ms. Keller and Ms. Johnson will not .. , '-" ..""" have to reapply after their terms expire. Code Enforcement has received the notice of violation and citation books. Code Officers have issued 13 notices of violations and no citations. Letters of interest would be accepted until October 16, 2003 for Board attorney and will be advertised September 28, 2003.
