COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson George Ann Keller called the regular meeting of the Citizen Code Enforcement Board to order at 5:31 PM in the Community Center. ROLL CALL Members present: Chairperson George Ann Keller, Linda Johnson, Joy Brindley, Glenn Barnhill, Ed Corn and Gene Mirabella. Also present were Chief Tracey Barlow, City Attorney Scott Cookson, Councilman Jim Brown, Code Officer Mike McGrath and Board Secretary Shontella Jackson. A welcome was extended to new Board Member, Gene Mirabella. Absent: Ben Delnigro. APPROVAL OF MINUTES The Minutes for the regular meeting of October 16, 2003 were presented to the Board for approval. NEW BUSINESS: Case # 2003-CE-1103L 236 N. Old County Rd.. Edgewater. Florida: Beverly Hinshaw. Violation of City Ordinance Chapter 21 Section 35.04 (a) - Neglected premises. This item was pulled from the agenda due to the violation being corrected and the citation being satisfied. Case # 2003-CE-6036 (A). 435 Perdita St.. Edgewater. Florida; Harris W. Roton Jr. Violation of City Ordinance Chapter 21 Section 35.04 (a) - Neglected premises. Chief Barlow presented the case summary to the Board. Current photographs were provided for the Board's review. Chief Barlow presented staff's recommendation to find Mr. Roton in violation of Section 21-35.04a of the Land Development Code and assess the citation fine of $53, with an additional fine of $50 per day for each day the violation exists past December 21, 2003. Chief Barlow presented the case summary to the Board for the second violation. Current photographs were displayed for the Board's review. Chief Barlow presented staff's recommendation to find Mr. Roton in violation of Section 21- 34.04 of the Land Development Code and assess the citation fine of $53, with an additional fine of $50 per day for each day the violation exists past December 21, 2003. MOTION by Ed Corn. SECOND by JOY Brindley on yiolation of Section 21-34.04 that staff recommendation be accented as recommended: a $53 citation fine and assess $50 ner day. Chief Barlow presented the case summary to the Board. Current photographs were displayed for the Board's review. It is also the recommendation that the Board issue a Board Order requesting the City Manager approve the cutting of the grass by City Staff and for a lien to be placed on the property. Violation of City Ordinance Chapter 21 Section 56.03b, Maintenance of improved residential lots. Chief Barlow presented the case summary to the Board. Photographs of the property were displayed for the Board's review. City Attorney, Scott Cookson requested this item be tabled due to timeline conflicts. The Board agreed to withdraw this case. Code Officer Mike McGrath will revisit the property and issue a new citation, if the property is not in compliance. Case #2003-CE-8057, 3303 Woodland, Edaewater, Florida: U S Bank Trustee. Violation of City Ordinance Chapter 21 Section 35.04, Neglected premises. Chief Barlow presented the case summary to the Board. Photographs of the property were displayed for the Board's review. Chief Barlow presented staff's recommendation that the Board issue an Order acknowledging the violation has been corrected and request the City file a lien against the property for the cost of the citation and any additional administrative costs associated with the filing. Chief Barlow presented the case summary to the Board. Photographs of the property were displayed for the Board's review. Chief Barlow presented staff's recommendation that the Board find Mr. Herbert L. Kochis Life Estate in violation of Section 21-56.03b of the Land Development Code and assess the citation fine of $53, with an additional fine of $50 per day for each day the violation exists past December 21, 2003. Me;: R I. OLD BUSINESS: Chairperson George Ann Keller addressed the issue of two vacant positions on the Board. The vacant positions relate to Chairperson George Ann Keller and Co- Chairperson Linda Johnson. Chairperson George Ann Keller stated that she would be moving to Hacienda, which is outside the city limits and requested removal of her name for consideration of reappointment. Chairperson George Ann Keller expressed her gratitude for the support that the town and Board has given her. The Board reviewed the applicants and made recommendation for City Council. Linda Johnson announced that she is interested in continuing her service with the Board and submitted her application for reappointment. CODE COMPLIANCE REPORT: Chief Barlow briefed the Board on the status of Code Enforcement Attorney with staff recommending Glenn Storch. City Council will consider an agreement for Glenn Storch of Storch and Morris during their next Council agenda. The Code Supervisor position status will also be listed on the next Council agenda. Chief Barlow discussed the Code Enforcement Workshop in New Smyrna Beach on January 13, 2004 from 1 pm to 5 pm. The City of Edgewater will be hosting the Sunshine Law session on January 14, 2004 at 5 pm encourage all Board members to attend both events. PUBLIC COMMENTS: None.
