03-18-2004 ---- ....., CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, March 18, 2004 5:30 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 5:37 PM in the Community Center. ROLL CALL Members present: Chairperson Linda Johnson, Joy Brindley, Glenn Barnhill, Ed Corn, Gene Mirabella and Ben Wagner. Also present were Code Supervisor Angela DeSue, Code Officer Mike McGrath, Chief Tracey Barlow and Board Secretary Shontella Jackson. Absent: Code Board Attorney Glenn Storch and Vice Chairman Ben Delnigro who notified the Board Secretary of his absence. APPROVAL OF MINUTES The Minutes for the regular meeting of February 19, 2004 were presented to the Board for approval. MOnON by loy Brindley. SECOND by Ben Waaner to adoDt the minutes of Reaular Citizen Colle Enforcement Board on Februarv 19,2004. MOnON CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Jerald Lenik, Code Officer Mike McGrath, and Code Supervisor Angela DeSue were sworn in for testimony. Chief Tracey Barlow was also sworn in for testimony. NEW BUSINESS: None. OLD BUSINESS: Case # 2004-CE-1013 (A), 1800 S. Riverside Dr.. Edgewater, Florida: Jerald Lenik and Cheryl Seiter. Violation of Section 1015 of the Florida Building Code- Guardrails. Angela DeSue presented the case summary to the Board. Current photographs were provided for the Board's review. This case had been tabled during last months Board meeting. Angela DeSue presented staff's recommendation to find '-" ,..." Mr. lenik in violation of Section 1015 of the Florida Building Code and assess the citation fine of $53, with an additional fine of $50 per day for each day the guardrails violation exists past March 19, 2004, and for a lien to be placed on the property if not satisfied by March 22, 2004. Mr. lenik testified that he has not closed on his loan and has another lender if the existing loan does not close. Mr. lenik stated that Mr. Fisher gave him a 30- day extension due to the lock and seal on property. Mr. McGrath stated that he could not enter on the property without permission from the owner to verify that the home is secure. The Board suggested that Mr. lenik request or subpoena Mr. Fisher be present for testimony on his behalf on the case. Mr. lenik submitted a copy of his loan application to the Board as evidence. The Board reviewed the loan application. Current photographs were provided for the Board's review. The loan application was entered into the case as Exhibit "A". MOnON bv Ed Corn. Note should Mr. lenik or the nronertv owner annear before the Board with a reneat vi()lation of t:his section there will be a substantial fine assessed. MOTION CARRIED 6 to o. Case # 2004-CE-1013 (B). 1800 S. Riverside Dr.. Edgewater. Florida: Jerald lenik and Cheryl Seiter. Violation of Section 7-325 - Enclosures. Angela DeSue presented a staff report to the Board regarding Board Orders on Case #2004-CE-1013 (B). Angela DeSue stated on February 19, 2004 the City of Edgewater Code Enforcement Board issued an order imposing a fine of $53.00 and a lien of a $100.00 a day if the violation continued past February 23, 2004. On February 22, 2004 Code Officer McGrath witnessed the completion of the fence. On February 23, 2004 the Edgewater Building Official approved the final inspection on the fence. No further recommendation for the Board. CODE COMPLIANCE REPORT: Angela DeSue briefed the Board on Bike Week noise readings. Currently the Code Enforcement Division has been given the task regarding commercial sign ordinance. As of today, 15 commercial signs are in compliance, 10 have been issued a notice of violation and the remainder are currently negotiating agreements with the City. PUBLIC COMMENTS: Mrs. Brindley announced that she would not be seeking a second term on the Code Enforcement Board due to family and work commitments. Mrs. Brindley ~ ...., expressed her gratitude and would like to be considered to serve again in the future. ADJOURNMENT Chairnerson lohnson adjourned the meetina at 6:42 om.
