09-30-2004 CITY OF EDGEWATER CITIZEN CODE ENFORCEMENT BOARD Thursday, September 30, 2004 5:30 P.M. COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 5:37 PM in the Community Center. ROLL CALL Members present: Chairperson Linda Johnson, Ed Corn, Gene Mirabella and Ben Wagner. Also present were Code Officer Mike McGrath, Code Supervisor Angela DeSue, Code Board Attorney Glenn Storch and Board Secretary Shontella Jackson. Jean Kayat arrived at 5:40 pm. Absent and excused: Vice Chairman Ben Delnigro and Glenn Barnhill. APPROVAL OF MINUTES The Minutes for the regular meeting of August 26, 2004 were presented to the Board for approval. MOTION bv Ed Corn. SECOND bv Gene Mirabella to adoDt the minutes of Reaular Citizen Code Enforcement Board on Auaust 26. 2004. MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Code Officer Mike McGrath, Code Supervisor Angela DeSue, Stormwater Supervisor Calvin Ayers, Vickie Mahan and Tommy Donatti were sworn in for testimony. NEW BUSINESS: Case #2004-CE-7016, 109 Hotel Ave., Edgewater, Florida; Tommy Donatti Violation of Section 21-53.02 (9) - Permit authority. Angela DeSue presented the case summary to the Board. Angela DeSue presented Stormwater Supervisor, Calvin Ayers to the Board for testimony and clarification to the violation. Angela DeSue presented staff's recommendation to find Tommy Donatti in violation of Section 21-53.02 (g) of the Land Development Code and assess the citation fine of $53.00, with an additional fine of $50 per day for each day the violation exists past October 1, 2004, and for placement of a lien if not satisfied by October 4, 2004. MOTION CARRIED 4 to 1. Case #2004-CE-7054, 3107 Juniper Dr., Edgewater. Florida: James Stevenson. Violation of Section 21-53.02 (9) - Permit authority. Mike McGrath presented the case summary to the Board. Current photographs were provided for the Board's review. Stormwater Supervisor, Calvin Ayers gave a brief testimony and presented pictures to the Board. The pictures are entered as exhibit A, Band C. Mike McGrath presented staff's recommendation to find James Stevenson in violation of Section 21-53.02 (g) of the Land Development Code and assess the citation fine of $53, with an additional fine of $50 per day for each day the violation exists past October 1, 2004, and for placement of a lien if not satisfied by October 4, 2004. MOTION CARRIED 5 to O. Case #2004-CE-9005, 2711 Vista Palm Dr., Edgewater. Florida: Kimberlv Lotsev. Violation of Section 21-56.03 (b) - Property maintenance/repeat violator. Angela DeSue presented the case summary to the Board. Current photographs were provided for the Board's review. Angela DeSue presented staWs recommendation to find Kimberly Lotsey in violation of Section 21-56.03 (b) of the City of Edgewater Land Development Code as a repeat violator and assess the citation fine of $108.00 and an additional fine of $100.00 per day for each day the violation exists past October 1, 2004. In addition, for a lien to be placed on the property if not satisfied by October 4, 2004. MOTION CARRIED UNANIMOUSLY. Case #2004-CE-7090, 1802 Pine Tree Dr.. Edgewater, Florida; Gary & Margaret Lindsey. Violation of Section 21-56.03 (b) - Property maintenance. Mike McGrath presented the case summary to the Board. Current photographs were provided for the Board's review. Mike McGrath presented staff's recommendation to find Gary & Margaret Lindsey in violation of Section 21-56.03 (b) of the Land Development Code and assess a citation fine of $53.00 and an additional fine of $50.00 per day for each day the property maintenance violation exists past October 1, 2004. In addition, for a lien to be placed on the property if not satisfied by October 4, 2004. It is also recommended that the Board issue a Board Order requesting the City Manager approve the cutting of the grass by City Staff if the violation is not corrected by October 4, 2004. MOTION CARRIED UNANIMOUSLY. OLD BUSINESS: The Board had a brief discussion on changing the Citizen Code Enforcement Board meeting to daytime starting in January. The Board approved and agreeded on the second Thursday of each month starting January 13, 2005 at 2:30 pm. CODE COMPLIANCE REPORT: Code Supervisor Angela DeSue updated and informed the Board that she made contact with the property owner at 2722 Mango Tree as requested by the Board. Vickie Mahan stated that she had made contact with the leasee and notified the leasee with a certified letter for eviction. ADJOURNMENT ChairDerson Johnson adjourned the meetinG at 7:02 Dm.
