SUMMARY:
The Government Finance Officers Association of the United States and Canada (GFOA) awarded a Certificate of
Achievement for Excellence in Financial Reporting to the City of Edgewater for its comprehensive annual financial report
for the fiscal year ended September 30, 2013. This was the thirtieth consecutive year that the City of Edgewater has
achieved this prestigious award. In order to be awarded a Certificate of Achievement, a government must publish an
easily readable and efficiently organized comprehensive annual financial report. This report must satisfy both generally
accepted accounting principles and applicable legal requirements.
A Certificate of Achievement is valid for a period of one year only. We believe that our current comprehensive annual
financial report continues to meet the Certificate of Achievement Program's requirements and we are submitting it to the
GFOA to determine its eligibility of another certificate.

Authorization for the City Manager to execute a contract with Estep Construction, Inc for construction of the SR 5
sidewalk from Volco Road to North city limits

SUMMARY:
The City of Edgewater issued an Invitation to Bid (ITB 14 -LS -020) on August 28, 2014 for the construction of
approximately 17,600 linear feet of concrete sidewalk along with related stormwater, grading, signage, pavement
markings, signalization, utility, ADA ramp, sodding, and other work.
This is a federally assisted project and is subject to the Fair Labor Standards Act, which include Davis -Bacon
(Certified Payroll), 24 CFR 85.36 (bonding requirements, Section 3 & M /WBE and related acts. In addition, it
required the submitting firms to be Pre - qualified with FDOT.
Six firms submitted, five of which were FDOT prequalified. The Engineers Construction Estimate for this project
was $1,045,792.17. The lowest qualified bidder, Estep Construction, Inc, submitted a bid of $990,152.00. The
City's Engineering Consultant, Kinley -Horn, recommended the contract be awarded to the low bidder, Estep
Construction, Inc. The Evaluation Committee concurred.
Construction of the sidewalk project is 100% funded by grant dollars via the Federally funded Local Agency
Program (LAP) through the State of Florida Department of Transportation. Additional underground work to
move Florida Power and Light (FPL) lines, poles and lights at the cemetery area will cost the city an additional
$15,770.00 (budgeted in FY15). The estimated construction time is 211 calendar days to achieve substantial
completion with 30 additional calendar days for final completion from date of commencement.

Per the Future Land Use Element of the Comprehensive Plan, the City shall "...maintain regulations for land use
categories within the City and a Future Land Use Map (FLUM) to ensure the coordination of future land uses with
existing and adjacent land uses."

In reviewing rezoning requests, the specific density will depend on locational factors, particularly compatibility with

family type housing, e.g., single family detached and attached, cluster and zero lot line. This designation will allow
existing agricultural zoning and uses to continue. The ULI designation is primarily a residential designation but may
also allow neighborhood convenience uses (see Shopping Center definition in Chapter 20) and individual office
buildings as transitional uses that meet the Comprehensive Plan's location criteria. The commercial intensity shall
be limited to no more than a fifty percent Floor Area Ratio (0.50 FAR) and in a manner to be compatible with the
allowable residential density. In order to be considered compatible, the commercial development should be
oriented to serve adjacent neighborhoods, reflect comparable traffic generation, similar traffic patterns, building
scale, landscaping and open space and buffers. Due to the nature of some of the commercial uses, additional
landscaping and visual screening shall be provided through the BPUD process when adjacent to low density
residential in order to preserve the character of the neighborhood. More intensive neighborhood commercial use
shall be reserved to areas designated for Commercial. All requests for nonresidential uses within one - quarter (1/4)
mile of another jurisdiction shall require notification to that jurisdiction.

The majority of commercial development within the City of Edgewater is located along US 1 in a strip pattern. The
area contains restaurants, convenience goods stores and neighborhood centers. Another corridor of commercial
development which has emerged is adjacent to the FEC Railroad within the Florida Shores Subdivision.
OTHER MATTERS:
City Council approved first reading of this Ordinance on July 21, 2014. The proposed amendment was
subsequently submitted to the Volusia Growth Management Commission (VGMC) and all other applicable
agencies. The VGMC deemed the application certified without the need for a public hearing on August 26, 2014.
No comments were received by any of the other applicable agencies.

WHEREAS, the City Council feels it is in the best interests of the citizens of the City of
Edgewater to amend its 2011 Comprehensive Plan as more particularly set forth hereinafter.
NOW, THEREFORE, BE IT ENACTED BY THE CITY
COUNCIL OF THE CITY OF EDGEWATER, FLORIDA:
PART A. AMENDMENT.
Article I, Section 21 -04 of the City of Edgewater's Land Development Code, as amended
and supplemented, adopting the Comprehensive Plan of the City of Edgewater, Florida,
regulating and restricting the use of lands located within the City of Edgewater, Florida, shall be
amended by this plan map amendment to: Amend the Official Future Land Use Map to include
property as Commercial (1.12± acres) and Low Density Residential (1.19 + acres) for property
described in Exhibits "A ".
PART B. PUBLICATION.
Notice of this proposed change of the Edgewater Comprehensive Plan shall be published
in the manner prescribed by 163.3184 (11), Fla. Stat. (2012). The City Council shall hold at least
ONE (1) advertised Public Hearing on the proposed Comprehensive Plan Amendment. The
publication shall appear at least FIVE (5) days before the second Public Hearing (Adoption
Hearing). The advertisement shall be placed in a newspaper of general paid circulation in the
City of Edgewater, and of general interest and readership in the municipality, not one of limited
subject matter, pursuant to Chapter 50 of the Florida Statutes. Whenever possible, the
advertisement shall appear in the newspaper that is published at least FIVE (5) days a week,
unless the only newspaper in the municipality is published less than FIVE (5) days a week. The

PART C. PUBLIC HEARINGS.
As a condition precedent to the adoption of this ordinance amending the City's 2011
Comprehensive Plan, the City Council shall hold at least one advertised public hearing on the
proposed comprehensive plan or plan amendment as follows: The first public hearing shall be
held at the transmittal stage pursuant to subsection 163.3184 (11), Fla. Stat. (2012). The second
public hearing shall be held at the adoption stage. It shall be held on a weekday at least 5 days
after the day that the advertisement is published. The Adoption Hearing shall be held within 180
days of the Department of Economic Opportunity having issued its Objections, Comments, and

PART D. TRANSMITTAL OF AMENDMENTS TO PLAN.
Immediately following the Transmittal Hearing, the City Manager or his designee shall
send ONE (1) paper copy and TWO (2) electronic copies of the proposed Plan Amendment to
the Florida Department of Economic Opportunity, Division of Community Planning, and all
other items specified to be transmitted in accordance with Chapter 163, Fla. Stat. (2012). The
City Manager or his designee shall also, immediately following the Transmittal Hearing, transmit
a copy of the proposed Plan Amendment to the Volusia Growth Management Commission,
Volusia County, Regional Planning Council, the St. Johns River Water Management District,
(Water Management District), Florida Department of Transportation, Department of
Environmental Protection and to any other unit of local government or governmental agency in
the State that has filed a written request with the City of Edgewater for a copy of such plan
amendment. Within TEN (10) working days following the Adoption Hearing, the City Manager

or his designee shall transmit FIVE (5) copies of the Plan Amendment and a copy of this
ordinance to the Florida Department of Economic Opportunity. The City Manager or his
designee shall also transmit within TEN (10) working days a copy of the adopted Amendment to
the Comprehensive Plan to the Volusia Growth Management Commission, Volusia County,
Regional Planning Council, the St. Johns River Water Management District (Water Management
District), Florida Department of Transportation, and Department of Environmental Protection.
PART E. CONFLICTING PROVISIONS.
All ordinances and resolutions, or parts thereof that are in conflict with this ordinance, are
hereby superseded by this ordinance to the extent of such conflict.
PART F. EFFECTIVE DATE.
The effective date of this plan amendment, if the amendment is not timely challenged,
shall be 31 days after the state land planning agency notifies the local government that the plan
amendment package is complete. If timely challenged, this amendment shall become effective
on the date the state land planning agency or the Administration Commission enters a final order
determining this adopted amendment to be in compliance. No development orders, development
permits, or land uses dependent on this amendment may be issued or commence before it has
become effective. If a final order of noncompliance is issued by the Administration Commission,
this amendment may nevertheless be made effective by adoption of a resolution affirming its
effective status, a copy of which resolution shall be sent to the state land planning agency.
PART G. SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If

AN ORDINANCE GRANTING A CHANGE IN ZONING
CLASSIFICATION FROM COUNTY B -4W (GENERAL
COMMERCIAL) AND COUNTY R -3W (URBAN SINGLE -
FAMILY RESIDENTIAL) TO CITY B -3 (HIGHWAY
COMMERCIAL) FOR 1.12± ACRES AND R -1 (SINGLE -

REAL PROPERTY LOCATED AT 2203 S. RIDGEWOOD
AVENUE, EDGEWATER, FLORIDA; AMENDING THE
OFFICIAL ZONING MAP OF THE CITY OF
EDGEWATER; PROVIDING FOR CONFLICTING
PROVISIONS, SEVERABILITY AND APPLICABILITY;

WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. Frank Payton is the agent/applicant on behalf of Turf, LLC, owners of the
property located at 2203 S. Ridgewood Avenue, Edgewater, Florida. Subject property contains
approximately 2.31± acres.
2. The owner /applicant has submitted an application for a change in zoning
classification from County B -4W (General Commercial) and County R -3W (Urban Single-
Family Residential) to City B -3 (Highway Commercial) and R -1 (Single Family Residential) for
the property described herein.
3. On June 11, 2014 the Local Planning Agency (Planning and Zoning Board)
considered the application for change in zoning classification.
4. The proposed change in zoning classification is consistent with all elements of the
Edgewater Comprehensive Plan.
5. The proposed change in zoning classification is not contrary to the established
land use pattern.
6. The proposed change in zoning classification will not adversely impact public

7. The proposed change in zoning classification will not have an adverse effect on
the natural environment.

NOW, THEREFORE, BE IT ENACTED by the People of the City of Edgewater,
Florida:
PART A. CHANGE IN ZONING CLASSIFICATION OF CERTAIN REAL
PROPERTY WITHIN THE CITY OF EDGEWATER, FLORIDA.
The zoning classification for the following described property is hereby changed from County 134W
(General Commercial) and County R -3W (Urban Single - Family Residential) to City B- 3(Highway
Commercial) [1.12 ± acres] and R -1 (Single Family Residential) [1.19± acres] for the property described
in Exhibit "A ".
PART B. AMENDMENT OF THE OFFICIAL ZONING MAP OF THE CITY OF
EDGEWATER, FLORIDA.
The Development Services Director is hereby authorized and directed to amend the Official Zoning Map
of the City of Edgewater, Florida, to reflect the change in zoning classification for the above described
property.

Ordinance 2014 -0 -21, amending Plan provisions regarding the composition of the Board of
Trustees, and have determined that adoption of these changes will have no impact on the
assumptions used in determining the funding requirements of the program.
Because the changes do not result in a change in the valuation results, it is our opinion that a
formal Actuarial Impact Statement is not required in support of its adoption. However, since the
Division of Retirement must be aware of the current provisions of all public pension programs, it

General Employees' Retirement Plan, Section 13 -40 (Board of trustees for general employees
pension trust fund) should be amended.

pension trust fund. The board of trustees shall be solely responsible for administering the

shall be a legal entity with the powers and responsibility enumerated herein and as may
be amended from time to time by the city council.

(b) Membersh62. The board of trustees shall consist of five members appointed as
(1) Two of whom, unless otherwise prohibited by law, must be legal residents
of the municipality and must be appointed by the governing body of the
municipality
(2) Two of whom are current or retired members of the plan who are currently
employ edby the City who are elected by a majority of current and retired
members who are currently employed by the City.
(3) The fifth member shall be a union representative for the General
Employees as appointed by the union. The fifth member shall have the
same rights as each of the other four members.
(4) If the majority of the members of the plan fails to elect a member as a
Trustee, the city manager shall appoint either a resident or an employee
that is a resident of the City.
(5) Two un excused absences, as determined by the Board, within a twelve
month period shall be a deemed resignation.
C) Term. Election to the board of trustees shall be for a term of three vears. unless a
trustee shall sooner leave office. Council appointed members shall serve an initial term of two
years followed by a three year term. The Union appointed member shall serve as a trustee as
long as he or she is appointed. A vacancy shall be filled in the same manner as originally seated
for the remainder of the expired term. Trustees pray succeed themselves in office.
d) Officers. The board shall select from their members a chairman. vice chairman
and a secretary by a majority vote of the trustees annually. The secretary of the board shall keep
a complete minute book of the actions. Proceedings or hearings of the board, all
correspondence, documents and records shall be public records subject to the same requirements
and exemptions as other public records of the City.
(e) Meetings.
Regular meetings shall be held at least
quarterly. The hour and place
of each meeting Wray be determined by the members of the board.
Special meetings may
be held
at the request of the
chairman, providing proper notice is given.
The secretary shall

notices of all meetings
to all members of the board and to all

All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance,
are hereby superseded by this ordinance to the extent of such conflict.
PART D. SEVERABILITY AND APPLICABILITY
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If
this ordinance or any provisions thereof shall be held to be inapplicable to any person, property,
or circurnstances, such holding shall not affect its applicability to any other person, property, or
circumstance.

The current owner purchased the property in 2010. A FLUM was approved in 2012 which essentially placed 16.78± total more acres

Land Use Compatibility:
The proposed future land use is compatible with the surrounding area, i.e. the Restoration D.R.I. and the Gateway development
project (Farmton Local Plan).
Adequate Public Facilities:
Adequate capacities exist (water, sewer, roads, solid waste, recreation & open space, etc.) for this proposed amendment as available
capacities were reserved for the previous proposed development of the property (Reflections).
Comprehensive Plan Consistency:
Per the Future Land Use Element of the Comprehensive Plan, the City shall "...maintain regulations for land use categories within the
City and a Future Land Use Map (FLUM) to ensure the coordination of future land uses with existing and adjacent land uses."
Mixed Use: the purpose for the Mixed Use land use category and its corresponding zoning districts is to provide for a variety of land
uses and intensities within a development site to preserve conservation areas, to reduce public investment in provision of services, to
encourage flexible and creative site design and to provide public amenities which provide an area wide benefit to the community.

The Mixed Use land use category permits low, medium and high density residential, commercial uses (retail and office), light
industrial, educational facilities, recreation facilities and compatible public facilities.
Conservation: the Conservation designation includes public lands that have been acquired and private land areas that have been
reserved by mutual agreement with the property owner for the preservation and protection of Edgewater's natural resources.
Conservation Overlay: the Conservation Overlay area shown on the City's FL UM is intended to protect areas that may potentially
contain protected wildlife habitat areas, hydric soils /wetlands, mangrove swamps, estuarine marsh ecotone, freshwater marshes or
special vegetative communities. Included within the Conservation Overlay definition are areas within a public water well radius of
500 feet, within the 100 -year floodplain, and other areas subject to environmental or topographic constraints. The area designated as
Conservation Overlay on the FL UM is not intended to prevent development, but rather identify sensitive areas that need to be
reviewed carefully during the review process to determine whether development should be permitted or if some form of mitigation
may be necessary. If the areas are determined not to be sensitive, than the underlying land use development density and/or intensity
will be applicable.

OF CONSISTENCY; PROVIDING FOR FILING WITH THE

WHEREAS, from time to time it becomes necessary to amend the City of Edgewater
Comprehensive Plan, and
WHEREAS, a Public Hearing on the question of designating a future land use
classification of the property hereinafter described has been duly held in the City of Edgewater,
Florida and at such hearing, interested parties and citizens for and /or against the proposed
designation of the future land use classification was heard; and

WHEREAS, such amendments are permitted subject to the provisions of Chapter 163,
WHEREAS, the Planning and Zoning Board, sitting as the City's Local Planning Agency,
held an advertised Public Hearing pursuant to 163.3164(30) & 163.3174(4) (a), Fla. Stat. (2011), on
Wednesday, September 10, 2014, on the proposed Plan Amendment and following that Public
Hearing voted and recommended that the City Council approve the aforesaid Amendment to the
City's 2011 Comprehensive Plan;

WHEREAS, the City Council feels it is in the best interests of the citizens of the City of
Edgewater to amend its 2011 Comprehensive Plan as more particularly set forth hereinafter.
NOW, THEREFORE, BE IT ENACTED BY THE CITY
COUNCIL OF THE CITY OF EDGEWATER, FLORIDA:
PART A. AMENDMENT.
Article I, Section 21 -04 of the City of Edgewater's Land Development Code, as amended
and supplemented, adopting the Comprehensive Plan of the City of Edgewater, Florida, and
regulating and restricting the use of lands located within the City of Edgewater, Florida, shall be
amended by this plan map amendment to: Amend the Official Future Land Use Map to
redesignate property as Mixed Use with Conservation Overlay (7.237 + acres) for property
described in Exhibits "A ", `B" and "C ".
PART B. PUBLICATION.
Notice of this proposed change of the Edgewater Comprehensive Plan shall be published
in the manner prescribed by 163.3184 (11), Fla. Stat. (2011). The City Council shall hold at least
TWO (2) advertised Public Hearings on the proposed Comprehensive Plan Amendment. The
first publication shall appear at least SEVEN (7) days before the first Public Hearing
(Transmittal Hearing). 163.3184 (11), Fla. Stat. (2011). The second publication shall appear at
least FIVE (5) days before the second Public Hearing (Adoption Hearing). The required
advertisement shall be no less than two columns wide by TEN inches (10 ") long in a standard-
size or tabloid -size newspaper, and the headline in the advertisement shall be no smaller than
EIGHTEEN (18) point. The advertisement shall not be placed in a portion of the newspaper
where legal notices and classified advertisements appear. The advertisement shall be placed in a
newspaper of general paid circulation in the City of Edgewater, and of general interest and

readership in the municipality, not one of limited subject matter, pursuant to Chapter 50 of the
Florida Statutes. Whenever possible, the advertisement shall appear in the newspaper that is
published at least FIVE (5) days a week, unless the only newspaper in the municipality is
published less than FIVE (5) days a week. The advertisement shall substantially be in the
following form:

A public hearing (transmittal stage) on the ordinance changing the Future Land Use Map will be
held on October 6, 2014 at 6:00 p.m. at the Community Center, 102 N. Riverside Drive,
Edgewater, Florida 32132.

incorporated herein as Exhibit "B')
The advertisement shall contain a geographical- location map which clearly indicates the area

covered by the proposed ordinance. The map shall also include major street names as a means of
identification of the general area.
PART C. PUBLIC HEARINGS.
As a condition precedent to the adoption of this ordinance amending the City's 2011
Comprehensive Plan, the City Council shall hold at least two advertised public hearings on the
proposed comprehensive plan or plan amendment as follows: The first public hearing shall be
held at the transmittal stage pursuant to subsection 163.3184 (11), Fla. Stat. (2011). It shall be
held on a weekday at least 7 days after the day that the first advertisement is published. The
second public hearing shall be held at the adoption stage. It shall be held on a weekday at least 5
days after the day that the second advertisement is published. The Adoption Hearing shall be
held within 180 days of the Department of Economic Opportunity having issued its Objections,
Comments, and Recommendations Report to the City.
PART D. TRANSMITTAL OF AMENDMENTS TO PLAN.
Immediately following the Transmittal Hearing, the City Manager or his designee shall
send ONE (1) paper copy and TWO (2) electronic copies of the proposed Plan Amendment to
the Florida Department of Economic Opportunity, Division of Community Planning, and all
other items specified to be transmitted in accordance with Chapter 163, Fla. Stat. (2011). The
City Manager or his designee shall also, immediately following the Transmittal Hearing, transmit
a copy of the proposed Plan Amendment to the Volusia Growth Management Commission,
Volusia County, Regional Planning Council, the St. Johns River Water Management District,
(Water Management District), Florida Department of Transportation, Department of
Environmental Protection and to any other unit of local government or governmental agency in
the State that has filed a written request with the City of Edgewater for a copy of such plan

amendment. Within TEN (10) working days following the Adoption Hearing, the City Manager
or his designee shall transmit FIVE (5) copies of the Plan Amendment and a copy of this
ordinance to the Department of Community Affairs. The City Manager or his designee shall also
transmit within TEN (10) working days a copy of the adopted Amendment to the Comprehensive
Plan to the Volusia Growth Management Commission, Volusia County, Regional Planning
Council, the St. Johns River Water Management District (Water Management District), Florida
Department of Transportation, and Department of Environmental Protection.
PART E. SCHOOL CONCURRENCY.
On or before the development and construction of 600 residential units, and based upon
anticipated future development of residential units, the Volusia County School District shall
determine whether it will need to construct an additional school to serve the Deering Park Center
area, and upon such determination, Swallowtail, LLC, its successors and /or assigns, agrees to
coordinate with the school district and city to provide and deed a twenty (20) acre developable
site in a mutually agreeable location to the School Board for such school site contribution.
PART F. CONFLICTING PROVISIONS.
All ordinances and resolutions, or parts thereof that are in conflict with this ordinance, are
hereby superseded by this ordinance to the extent of such conflict.
PART G. EFFECTIVE DATE.
This ordinance shall become effective upon its final adoption; and either the Department
of Economic Opportunity entering a final order finding this Comprehensive Plan Amendment in
compliance, or the Administration Commission entering a final order finding that this
Comprehensive Plan Amendment has been brought into compliance and certification of
consistency from the Volusia Growth Management Commission.

The Edgewater Citizen Code Enforcement Board has one open position for a Board member. The term of Gail
Anderson has expired on April 14, 2014. Russell Baugher has expressed an interest in serving on the Board.
Membership of the Edgewater Citizen Code Enforcement Board consists of seven (7) members appointed by
Council.

City Council's ratification of appointment of fifth member to the Firefighters' Pension Board of Trustees.

SUMMARY:
The City of Edgewater has a fifth trustee, appointed by the Board of Trustees and ratified by the City Council as a
ministerial duty, on the Firefighters' Pension Board of Trustees, as outlined in F.S. 175. Mr. Gary Butt is currently
serving a two -year term which ended on August 18, 2014. The Board of Trustees, at its September 15, 2014
meeting, reappointed Mr. Butt as the fifth member for an additional two -year term until August 18, 2016.

The property is included in the proposed CRA area and will expand the existing parking for our City Hall Complex
and additional parking for the George R. Kennedy Memorial Park.
Two appraisals were completed by the City and the Church, coming in at $62,000 and $74,500. Both parties have
agreed to the average purchase price of $68,250.
It is recommended that we utilize a portion of the 2015 City Hall allocation of $100,000 to purchase this parcel of
land.
