07-21-1975 - Workshop ~ ~ WORKSHOP JULY 21, 1975 The regular workshop meeting was called to order Monday, July 21, 1975, by Vice Mayor Lodico. The Council spoke with Mr. Lyle B. Quick, whom they are interested in interviewing for the Judge's position. Mr. Quick answered several questions from the eouncil. Mr. William P. Spencer spoke to the Council of his qualifications for the Judge's position, and also answered questions from the Council. The City Clerk began reading the bills and accounts. Councilman Dietz questioned the bill from Diversified Electronics. City Manager Bryant stated that this was for putting the radio in Mr. Christy's car. Councilman Dietz questioned the bill from Southern Paint. City Manager Bryant stated that this was the concrete sealer used on the floor of the garage before any equipment was moved on it. Councilman Dietz questioned the bill from Brown's Air Conditioning for the library, stating that this air conditioning in the library is getting to be expensive. There was some discussion about this, and Councilman Dietz asked if the City Clerk could have some kind of report as to how much money has been spent on the air conditioner in the past year. Councilman Cairnie questioned the Bill from Magnolia Motor Co., stating that since we have the garage now he thought we were going to be doing this work ourselves. City Manager Bryant stated that for the most part this bill is for parts which the City does not have. Councilman Dietz questioned the bill from National Chemsearch which was charged to the Street Dept. City Manager Bryant explained that this is for chemicals for the weed killing, and such. Councilman Dietz questioned the bill from Rotundo. The City Clerk explained that this was the back room in City Hall. The City Clerk explained that she has three sets of minutes for the regular meeting, and a second reading on Ordinance 934; adopting the County Codes. City Manager Bryant stated that some people are here in regard to soliciting and their request which was ~ade at the last meeting. A gentlemen spoke to the Council on Behalf of the Jehovah's Witnesses being allowed to do their door to door preaching, and about the Ordinances not applying to them. ...... ..." City Attorney Weaver spoke in regard to this on a legal standpoint. Stating that tt would be unlawful to deny the Jehovah Witnesses this permission. There was discussion about changing this Ordinance. Councilman Dietz stated that this should go on the agenda for the regular meeting. Mr. Armstrong spoke to the Council about the Ordinance which came into effect while he was in office. City Manager Bryant stated that he also has a request from a lady to sell Blair products in the City of Edgewater. He read from the present Ordinance. City Attorney Weaver suggested that the Council could make a motion to direct the City Manager to handle this in accordance with the Ordinance, until certain amendments are made. City Manager Bryant read a letter from ~Jill iam L. Ross, Jr., who is representing Mr. and Mrs. Rotundo in connection to some lots which they loan in Silver Ridge. City Attorney Weaver spoke to the Council about this, stating that he talked with Attorney Ross. He stated that the Council could ask for some kind of recommendation from the Zoning and Planning Board on this and put this on a Public Hearing agenda, so that some change could be made in the Ordinance and keep this problem from coming up again. City Manager Bryant stated that he has a request from the First Baptist Church for the City to cut the curb across the street from the church for a driveway so that they can handle more parking. Councilman Dietz questioned whether this should be handled as a private individual would. Councilman Sikes stated that he is the Secretary/Treasurer for the Board of Trustees and he doesn't think that it has been determined exactly what is going to be done with this property, so he suggested that this be tabled for another meeting. City Manager Bryant stated that he has a request from Mr. Cartee con- cerning a building permit on a lot in Florida Shores. City Attorney Weaver stated that he has talked with Mr. Knock about this and he will get a plat to Mr. Weaver and he will look this over before the regular meeting. Mr. Cartee spoke to the Council about this. Mr. Armstrong spoke to the Council about this. There was quite a bit of discussion about this property, and the drainage problem concerned. City Manager Bryant stated that he has a letter from the chairman of the Bicentenial Committee reguesting a bicycle path for the City of Edge\'/ater. Mr. Bryant read a communication from Mr. Bruce Briggs in regard to the landfill project, stating that the city should appoint a represen- tative to keep up on the progress of the project and keep the City in- formed. Councilman Sikes stated that he feel this should be a City employee at the landfill site. Mr. Bryant spoke to the Council about this. -2- '-" ...., City Manager Bryant read a letter from Vo1usia Council of Governments stating that their regular meeting is July 30th, an agenda was enclosed. He also read a notice of a semiRar in August, which all Councilmen should try to attend because there will be a discussionin regard to water and sewer programs on a long range bases. Mr. Bry~nt read a notice of the Florida League of Cities meeting- conventlon on October 23, 24, and 25, in Orlando, Florida. City Attorney stated that he has a Resolution on the assistant city attorneys, whicR the Council can look over. Attorney Weaver spoke to the Council in regard to this, stating that if he can not make it to a certain meeting, and the assistant attorney has to step in, he can come to the workshop to get direction on what he is to do for the following Thursday night, and Mr. Weaver will re- imburse the attorney for this. Any work that the City Council directs City Attorney Weaver to turn over to the assistant will be billed by them at the rate of $40.00 an hour. The Council discussed the brief in regard to the Florida Power and Light Company franchise agreement. City Manager Bryant stated that in accordance with instructions from theCity Council he set up a meeting with the Building Code Review Committee and Mr. Westberry, the Vo1usia County Building Dept. in connection to go over the fees in the building code. He stated that this has been advertised in the event two or more Councilmen will be able to attend. Councilman Cairnie stated that theCounci1 has not set any such meeting. Mr. Bryant explained why this meeting was set up. Councilman Lodico stated that he spoke with Mr. Leoff1er in regard to the County Codes. Councilman Dietz stated that he doesn't feel that if we adopt our own codes that a County inspector would inspect for us, and if we are going to adopt our own codes we should have our own inspector. Councilman Lodico explained that all of these questions can be answered by Mr. Westberry at the meeting tomorrow night. The City Clerk stated that the only thing she has was that Mr. Cairnie asked her to remind him about the Clerk's Cash Statement. Councilman Dietz questioned the City Attorney why is it that anything that is taken care of at a regular meeting has to be put on the agenda at the workshop or it can not be taken care of. Attorney Weaver stated that there are two laws which he is talking about. One is the Public Records Law, which is public notice and the Sunshine Law. The agenda is published. Councilman Lodico asked the City Attorney if the Council could legally act on anything Thursday night that is not discussed at this workshop City Attorney Weaver stated that technically not, unless it is handled on an emergency bases. It could be discussed, however you should not act upon it, without public notice beforeband. IF you vote beforehand to treat it as an emergency,then you can act on the subject matter. -3- ~ ~ Councilman Dietz asked if you could set up a special meeting to handle a certain item at a regular Council meeting? City Attorney Weaver stated that this could be done. Councilman Lodico asked, how can you declare a certain Ordinance an emergency before it is read and we don't know what is read. City Attorney Weaver stated that you should know the subject of the Ordinance, and voting on handling it as an emergency is not voting yes or no on the actual Ordinance, just whether you are going to handle the matter. Councilman Cairnie stated that since there is not enough time to get the Clerk1s Cash Statement in by the first workshop of themonth, he asked theCity Cler.k if it would be possible to get this report ready by the second workshop of the month so thatthe Council could review it for the second regular meeting? The City Clerk answered that she could get it to the eouncil between the first and second meeting, however it is always going to entail overtime to ~et this report ready for the first meeting of the month. Councilman Dietz stated that the Charter will have to be changed. The City Clerk asked if along with appointing the City Manager, or City Clerk to sign permits for soliciting, could they also do some- thing about the garage sales also. The City Attorney spoke to the Council about this. Mr. Wharton spoke to the Council complaining about the trash which is being thrown on this vacant lot, which is next to Hardin Place. He stated that the City cuts the lot next to his because it is on Hardin Place, and the trash is being left there. Councilman Sikes stated that Hardin Place was extended due to a request of the residents. however perhaps a trash can could be put down there and regular pick up made. There was a discussion in regard to the speed limit in Florida Shores, and there being no signs out there. City Manager Bryant explained that it costs approximately $16.00 to $18.00 just for the material for one street sign. There was much discussion in regard to the signs in that area and what exactly the speea limit should be. There being no further business, this meeting adjourned. 4
