COMMUNI,TY CENTER MINUTES CALL TO ORDER Mayor Allman called the Workshop to order at 6:04 p.m. in the Community Center. ROLL CALL Mayor Randy Allman Councilman James Gornto Councilman Myron Hammond Councilman Gary Roberts Councilwoman Judith Lichter City Attorney Nikki Clayton City Manager Kenneth Hooper city Clerk Susan Wadsworth Police Chief Lawrence Schumaker Present Excused Present Present Present Present Present Present Present MEETING PURPOSE The purpose of the workshop is to present Council staff's recommendation on the Charter Review Committee report and to discuss the Police Pension/Retirement Plan. City Manager Hooper presented opening remarks to Council. City Manager Hooper went over the proposed changes to the Charter. There was a brief discussion regarding Section 2.02 - Limitations on Annexations. There was a brief discussion regarding section 3.09(d) Filling of Vacancies. City Manager Hooper continued with his presentation of the proposed changes to the Charter. There was a brief discussion regarding section 3.13(f) (3) - withdrawal of petitions. City Attorney Clayton asked City Clerk Wadsworth the latest date, prior to the vote, they could withdraw a petition. City Clerk Wadsworth hadn't had a referendum in front of her in ten years. City Attorney Clayton explained the biggest expense is printing the ballots. City Manager Hooper stated the cost for an election in Edgewater is about $8,000. City Manager Hooper continued his presentation. City Manager Hooper commented on the minority report issue of staggered terms. There was further discussion regarding staggered terms. Ferdinand Heeb, 115 N. Riverside Drive, concurs with staff's recommendation on most of the Charter Review Committee's recommendations. He has the most concern with section 2.02 - Limitations of Annexation. They were trying to give the citizens more voice in the direction the City would take relative to growth. Mr. Heeb spoke about the limitation on borrowing. .... ..,., Mr. Heeb also spoke about problems he has with staggered terms. He feels this wouldn't work unless they went with four-year term. Michael Nattress, member, Charter Review Committee, spoke about the Initiative and Referendum Section. He feels the percentage of the number of voters that would qualify for a petition should be looked at closer. Mr. Nattress feels staggered terms are not a good idea. Sandy Jones, member, Charter Review Committee, agrees with all of staff recommendations. She commented on section 2.02 and feels there are enough Florida Statutes to support the annexation and growth. Ms. Jones explained she is for staggered terms. She feels in staggering the terms, you have the opportunity to vote the people in or out if they aren't doing what you want them to do. For the continuity of the City and the long-range goal for planning, she feels the City is far better off with staggered terms. George Ewing, 2923 Royal Palm Drive, feels they followed all mandates that were given to the Committee by the Council when the Committee was formed. Mr. Ewing went over the mandates given by Council. Mr. Ewing went on to speak about the residency requirement. He doesn't feel the City should have any waiver on Department Heads. He feels the City should have two-term limits and voting by districts. He feels the citizens don't really want staff to decide the Charter and should be on a referendum. Mayor Allman thanked the Charter Review Committee. He also complimented staff for helping the Council understand and see what would be the best for the City. Dick Jones, 1530 Sabal Palm Drive, commented on the frequency of elections. He feels they should have some kind of variation in the way they have been doing it. He proposed everyone from a district be voted for every two years, with the Mayor being a four year election. He agreed with Mr. Ewing with regards to voting within districts. Dick Martinez, 317 Schooner Ave., commented on staggered terms. He has served on boards with two-year staggered terms and he found it worked well because new members benefited by the continuity and got a faster start because of the old members remaining on the board. Dominic Capria, 606 Topside Circle, doesn't think a ~ hour is long enough for this important subject. There are too many things that should be gone over line by line. He congratulated the Charter Review Committee. He agreed with Mr. Ewing on the district voting. He feels there should be no waiver on the residency requirement. It doesn't make any sense to have it if the City Council has the authority to waive it. Mr. Capria referred to Section 3.13 on pages 7 through 10, which he feels is very confusing. He would like to go over this step by step so he knows what this is all about. City Attorney Clayton agreed to call Mr. Capria tomorrow to discuss this with him. Page -2- Council Workshop March 1, 1999 ~ City Manager Hooper stated the purpose of tonight was to explain the Charter recommendations and for Council to direct staff on public hearings. The request from staff tonight is direction. He asked Council if they wanted to put this on an upcoming agenda for a public hearing before an ordinance is drafted and have public input on what has been discussed tonight. Then after you take that vote on some direction and create the ordinance and then hold public hearings too on those ordinances. Councilwoman Lichter spoke about the residency requirement. She thinks the intent of the people is that they reside in different areas but are at large in their decisions. She thinks this needs some interpretation before they make decisions. Councilman Roberts agreed with Councilwoman Lichter. He also feels they should serve at large. City Attorney Clayton stated the recommendation is an at large, you live in the district. The minority report had not prevailed with the majority of the Charter so the minority report was to have single member districts. City Manager Hooper asked Council if it was their direction to conduct a public hearing first on just the subject matter. After that they would create the ordinance and hold the public hearings on that ordinance and if so would they like the first week in April. It was the consensus of Council to hold the first public hearing for public discussion on the Charter at the first meeting in April. City Manager Hooper spoke about police pension plans, how they work and how they are funded. The Police Pension Board has requested there be considerable changes to the plan. He has provided Council a summary of those changes and his recommendations and also a summary from the League of cities of plan benefits which includes all cities in any Charter counties that have elected to have a local or non-chapter plan. City Manager Hooper went over the current benefit, proposed changes and staff comments to the police pension. He also answered questions from Council during his presentation. Mayor Allman commented on why he does not support staff comments under number two under disability. City Manager Hooper elaborated on comments made by Mayor Allman. Mayor Allman feels if an officer or firefighter is hurt in the line-of-duty we owe it to them to keep their value of life the same as it was when they started their shift. He doesn't know how anyone could feel differently and still maintain a good conscience. Councilwoman Lichter asked if they are voting on this tonight for the final or one vote. City Manager Hooper explained tonight on the agenda he would be asking Council what they want him to put in the ordinance. He will draft an ordinance and bring it back with one or all of the conditions. Then a public hearing will be held on that ordinance. Once you vote on it the first time, it goes to the State for their approval. Then it will come back to Council as the second reading of an ordinance. Page -3- Council Workshop March 1, 1999 "WI' ,.. Councilwoman Lichter asked how the firefighters set in terms of disability. City Manager Hooper informed her they are 25% and 42%. City Manager Hooper continued his presentation. Gary Conroy, Chairman, Police Pension Board, presented background information on how this came about. He spoke about being able to take care of a family while on disability. The core issues they would like to focus on are disability and changing the multiplier. Councilman Hammond asked about the 42% on the disability. City Manager Hooper stated the City is currently at 25%. Mr. Conroy asked about the disability policy having limitations for how long it would last. City Manager Hooper explained what has been described. Councilwoman Lichter asked if the Pension Board should look at the insurance policy. Councilman Hammond stated he would think they would be looking at it. City Manager Hooper stated sure. There was further discussion regarding disability and re- evaluating after five years or asking for a second opinion. Mr. Conroy spoke about early retirement. Bill Bennett, Fraternal Order of Police Representative, spoke about how he got involved with the Police Pension. All they want as police officers is to be treated fairly. We don't think this pension we have right now is fair. Mr. Bennett spoke about three areas of concern being disability, 3% multiplier retroactive to 1987 and 20 years and out. He also expressed concern with the expiration of the insurance policy. Is it going to be renewed by the City after a period of time? He thanked Mr. Hooper for being fair and professional. Ron Prekup, 1829 Lime Tree Drive, member, Police Pension Board, stated the pension board voted unanimously for the 66 2/3%. He feels as far as the insurance policy, any way we get to the 66 2/3% would be beneficial to the officer but he is questioning an insurance policy for all the City employees. He feels this should only be for police officers, not all employees. Mr. Prekup spoke about social security and cost of living adjustments and the cost of everything going up. Mr. Prekup feels the bottom line is Edgewater is a good place to live. He feels if the City offered good benefits, it would keep officers in Edgewater. He thanked Mr. Hooper and the Mayor for their help. City Manager Hooper informed Council this is on the agenda later for Council to vote on. The meeting adjourned at 7:42 p.m. Minutes submitted by Lisa Kruckmeyer Page -4- Council Workshop March 1, 1999 `,, y r MINORITY REPORT ISSUES • City Council have authority to override (by a unanimous vote) any action or inaction City Manager regarding issues of organization and policy (not issues of personnel). • Staggered terms • residency of city manager, city attorney & department heads - waivers should be excluded • two term limits for council • vote by districts • give council the authority (by majority vote) to hire and fire department heads only ( CharterReviewCommittee- MinorityReports) WORK SESSION CONCERNING PROPOSED CHARTER REVISIONS ARTICLE I - POWERS Section 1.01 - General Powers Section 1.02 - Construction ARTICLE II - CORPORATE LIMITS Section 2.01 - Description of corporate limits Section 2.02 - Limitations on Annexation The corporate limits of the City of Edgewater may not be increased more than two hundred fifty (250) acres in any one (1) year unless such annexation is approved by a referendum of the eligible voters of the city in a general election. COMMENTS: Florida Statutes describe conditions under which annexations may occur. These conditions are very stringent and require one (1) or two (2) referendums (the second referendum required within City if area or residents exceed 5% of City totals), adoption - ordinance, two (2) public hearings and a plan by the City describing in detail how urban sources will be provided in the annexed area. Individuals may also petition for voluntary annexation of their property. All statutory conditions except the requirement for a referendum apply. ( CharterReviewCommittee /CharterReviewForm) 1 Now Annexations require comprehensive plan amendments resulting in two (2) public hearings and a thorough review by appropriate state agencies including the Florida Department of Community Affairs (FDCA). The comprehensive plan amendment process requires an analysis to describe the financial impact to the City's existing residents. The proposed 250 acre limitation on annexation could limit the City in negotiating expansion of its urban services. This limitation would restrict major annexation to even years (general elections). This limitation could place Edgewater at an economic competitive disadvantage relative to adjacent Cities and unincorporated Volusia County. RECOMMENDATION: City Council not limit actions concerning annexations that are defined by state statutes and have existing formal public hearing procedures for public review and scrutiny. ARTICLE III - CITY COUNCIL Section 3.01 - Composition Section 3.02 - Districts Section 3.03 - Qualifications (a) The mayor must be a qualified elector of the city and shall have resided within the city for no less than one (1) year on the date that person qualifies to run for office. The mayor shall continuously reside within the city limits during the mayor's term of office. (b) Each council member must be a qualified elector of the city and shall have resided within the city for no less than one (1) year and shall be wheis a resident of the district from which the ( CharterReviewCommittee /CharterReviewForm) 2 Now Nur person seeks to be elected on the date that person qualifies to run for office. Each council member elected from a district shall continuously reside in the district during the council member's term of office, except that any council member who is removed from a district by redistricting may continue to serve during the remainder of the council member's term of office. COMMENTS: Residency requirement is a valid concern and staff recommends approval. Section 3.04 - Elections and terms Section 3.05 - Compensation Council members shall receive as compensation the sum of four thousand eight hundred dollars ($4,800.00) annually, payable monthly. The mayor shall receive as compensation the sum of six thousand dollars ($6,000.00), annually, payable monthly. The city council is authorized to adjust the annual salary for the mayor and council members by ordinance, but he no ordinance shall DM become effective until the date of commencement of the term of those members of the city council elected at the next regular election, provided that such election follows the adoption of the ordinance by at least six (6) months. COMMENTS: Clarification of language only, no opposition by staff. Section 3.06 - Mayor The mayor shall be a member of the city council and preside at meetings of the council. The mayor shall be recognized as head of the city government for all ceremonial purposes, by the governor for purposes of military - law; -3r service of process, and execution of contracts, deeds and other documents, but shall have - no administrative duties. Any additional powers -and duties of the mayor shall be such as are conferred upon the mayor by the council. At the first council meeting after each regular city election, the council shall elect one of its members as vice mayor. The vice mayor shall act as mayor during the absence or disability of the mayor. COMMENTS: Clarification of language only, no opposition by Staff. ( CharterReviewCornmittee /CharterReviewForm) 3 Section 3.07 - General powers and duties Section 3.08 - Prohibitions (a) Holding other office (b) Appointments and removals (c) Interference with administration ( Limitations on borrowing. The City of Edgewater shall not incur additional debt of more than 0.75% of the moments net taxable value duringny forward moving five (5) year period unless such debt is approved by a referendum of the eligible voters of the city in a general election. 14 Reserves. The city is required to maintain reserves g a minimum of fifteen percent (15 %) with a maximum of twenty -five percent (25 %) of the general fund. COMMENTS: (d) Limitation on borrowing is a popular method to control governmental spending by having City Council explain /educate the voters concerning the need to borrow money. The method to determine the additional debt threshold is very cumbersome. A fixed value of any borrowing over may be easier to understand and the value of the annual debt threshold can be reviewed at the next charter reviewer€Council should clarify that this does not pertain to refinancing as long as no "new money" is borrowed. The term general election to define the timing of the referendum should be deleted. A referendum to determine borrowing should be conducted at the time of need but not necessarily at a general election. ( CharterReviewCommittee /CharterReviewForm) 4 (e) The 15 -25 percent range for unrestricted general fund reserves is good management practice and is consistent with the criteria used (by Standard & Poors, Moody and Insurers) to review the financial strength by bond/insurance rating agencies. The section needs to be clarified by adding the following "... maintain unrestricted general fund reserves at a minimum of 15% and a maximum of 25% of the annual operating (non - capital) general fund Section 3.09 Vacancies; forfeiture of office; recall; filling of vacancies (a) Vacancies (b) Forfeiture of office (c) Recall (d) Filling of vacancies. Except as otherwise prescribed by law, a vacancy on the city council shall be filled as follows: (1) In the case of a vacancy in the office of mayor, if less than six (6) months remain in the unexpired term or until the next regular city election. the council by a vote of three (3) or more members shall appoint a successor who is eligible for the office under Section 3.03 of this charter. Such successor shall serve until the next regular city election at which time a mayor shall be elected in the manner prescribed in Article V o €-thisw€harter • . - - _ -- -- • (2) In the case of a vacancy in the office of mayor. if more than six (6) months remain in the unexpired term or until the next regular city election. a special election shall be called to fill such vacancy. The special election shall be scheduled not sooner than sixty (60) days. nor more than ninety (90) days following the occurrence of the vacancy and if a primary is necessary it shall bgheld as required by the election laws of the State of Florida. The person elected to fill the vacancy must be eligible for the ( CharterReviewCommittee /CharterReviewForm) 5 `.. .,.0 office of mayor under Section 3.03 of this charter and shall serve until the next regular city election at which time a mayor shall be elected in the manner prescribed in Article V of this Charter. The city council shall determine its own rules and order of business except that the agenda for regular council meetings shall include "Citizen Comments" (not to include agenda items) at the beginning of the meeting and directly prior to adjournment of the meeting and council shall include an opportunity for citizen comments relating to an agenda matter at the time the matter is before council. The city council shall provide for the keeping of a journal of its proceedings. This journal shall be a public record. (c) Voting COMMENTS: Staff concurs. Commencement of proceedings. (I) Nuer of signatures. Initiative and referendum petitions must be signed by qualified voters of the city equal in number to at least twenty percent (20 %) of the "---'- total number of qualified voters registered to vote at the last regular city election. (2) Form and content. All papers of a petition shall be uniform in size and style and shall be assembled as one instrument for filing. Each signature shall be executed in ink or indelible pencil and shall be followed by the address of the person signing. Petitions shall contain or have attached thereto throughout their circulation the full text of the ordinance proposed or sough to be reconsidered. (3) 4 ?davit of circulator. Each paper of a petition shall have attached to it when filed an affidavit executed by the circulator thereof stating that he personally circulated the ( CharterReviewCommittee /CharterReviewForm) 7 ti paper. the number of signatures thereon. that all the signatures were affixed in his presence. that he believes them to be the genuine signature of the persons whose names they purport to be and that each signer had an opportunity before signing to read the full text of the ordinance proposed or sought to be reconsidered. (4) Time for filing referendum petitions. Referendum petitions must be filed within thirty (30) days after adoption by the council of the ordinance sought to be reconsidered. (d) Procedure for filing. (.1) Certificate of clerk.: amendment, Within twenty (20) days after the initiative petition is filed and five (5) days for a reference petition. the city clerk or other official designated by the council shall complete a certificate as to its sufficiency. specifying, if it is insufficient. the particulars wherein it is defective and shall promptly send a copy of the certificate to the petitioner's committee by certified mail, return receipt requested. Grounds for insufficiency are only those specified in subsection (c). A petition certified insufficient for lack of the required number of valid signatures may be amended once if the petitioners' committee files a notice of intention to amend it with the clerk or other official designated by the council within two (2) days after receiving the copy of the certificate and files a supplementary petition upon Additional papers within ten (10) days after receiving the copy of such certificate. Such supplementary petition shall comply with the requirements of subsections (c)(2) and (c)(3) of section 3.13. and within five (5) days after it is filed, the clerk or other official designated by the council shall complete a certificate as to the sufficiency of the petition as amended and promptly send a copy of such certificate to the petitioners committee by certified mail. return receipt requested as in the case of an original petition. If a petition or amended petition is certified sufficient. or if a petition or amended petition is certified insufficient and the petitioners' committee does not elect to amend or request council review under subsection (2) of this section within the time required. the clerk or other officiajdesignated by the council shall promptly present his certificate [which] shall then be a final determination as to the Sufficiency of .the petition. (�)2 Council review. If a petition has been certified insufficient and the petitioners' committee does not file notice of intention to amend it or if an amended petition has been certified insufficient. the committee may. within two (2) days after receiving the copy of such certificate. file a request that it be reviewed by the council. The council shall review the certificate at its next meeting following the filing of such request and approve or disapprove it. and the council's determination shall then be a final determination as to the sufficiency of the petition. ( CharterReviewCommittee /CharterReviewForm) 8 (e) Referendum petitions: suspension of e ect of ordinance. When a referendum petition is filed with the city clerk or other official designated by the council, the ordinance sought to be reconsidered shall be suspended from taking effect. Such a suspension shall terminate when: W There is a final determination of insufficiency of the petition; or (22) The petitioners' commit withdra t e p ion; o (3) The council repeals the ordinance; or ( After a vote of the city on the ordinance has been certified. (L Action on petitions. (1) Action by council. When an initiative or referendum petition has been finally determined sufficient. the council shall promptly consider the proposed initiative ordinance in the manner provided in Article III or reconsider the referred ordinance by voting its repeal. If the council fails to adopt a proposed initjative ordinance without any change in substance within sixty (60) days or fails to repeal the referred ordin. ce within thirty (30) days, it shall submit the proposed or referred ordinance to the voters of the city. (2) Submission to voters. The vote of the city on a proposed or referred ordinance shall be held not less than thirty (30) days and not later than sixty (60) days from the date the petition was determined sufficient. If no regular city election is to be held within the period described in this subsection. the council shall provide for a special election. except that the council may, in its discretion. provide for a special election at an earlier date within the described period. Copies of the proposed or referred ordinance shall be made available at the polls. (3) Withdrawal ofpetitions, An initiative or referendum petition may be withdrawn at any time prior to the fifteenth (15 day precedina_the day scheduled for a vote of the city by filing with the city clerk or other official designated by the council a request for withdrawal signed by at least four (4) members of the petitioners' committee •., __ - fi ',_• of _ • - e - - . - ' i. • , .11 1 _ - n. _ h ore .r -ffe an. all proceedings thereon shall be terminated. (g) Results of election. (1) Initiative. If a majority of the qualified electors voting on a proposed initiative ordinance vote in its favor, it shall be considered adopted upon certification of the election results and shall be treated in all respects in the same manner as ordinances of the same kind adopted by the council. If conflicting ordinances are approved at the same election, the one receiving the greatest number of affirmative votes shall prevail to the extent of such conflict. (b) Consistent with all applicable federal and state laws, the city council shall provide for the establishment, regulation, and maintenance of a personnel system COMMENTS: Language change only, staff concurs. This section shall not apply to any department head or city officer hired prior to the effective date of this section unless the residency requirement found in Chapter 27532, Laws of Florida, Special Acts of 1951, as amended, was applicable to such department head or officer. The term of office shall be for two (2) years, beginning at the next regular council meeting after the election. The regular election of the City Council shall be held each year on the date that would be established by the Florida Election Code. Elections for City Council members representing district two (2), and four (4) and the Mayor shall be conducted in even years. COMMENTS: The consistency of City Council action can only be accomplished if there is some continuity of elected officials. Also included are the City Manager's recommended comments for Council consideration. :ejm Attachments c:\rnemos\pension.wk9 CITY MANAGER'S OFFICE 104 NORTH RIVERSIDE DRIVE (904)424 -2404 FAX - (904)424 -2409 POLICE PENSION WORK SESSION MARCH 1, 1999 CURRENT BENEFIT 1 2 Sec. 4.01- Accrued Retirement Benefit: An active participant's monthly accrued benefit will be equal to 2% of average compensation times accrued service on such date. Example: An employee retires after 23 years of service and is eligible for (2%x23) 46% of pay. Sec. 4.03 - Amount of Benefit at Retirement: At attained age 50 with 5 years of plan participation, the officer may retire early with the benefit reduced 6 2/3% for each year the early retirement date precedes normal retirement date. PROPOSED Accrued Retirement Benefit: An active participant's monthly accrued benefit will be equal to 3% of average compensation times accrued service on such date. Example: An employee retires after 23 years of service and is eligible for (3 %x23) 69% of pay. Amount of Benefit at Retirement: At the earlier of attained age 55 or 20 years of service, the officer may retire with full retirement benefits. COST Accrued Retirement Benefit: The annual cost increase to the City for this proposal from this date forward is $103,052 if retroactive to 10/01/87. If not made retroactive, then the annual cost increase to the City for this proposal from this date forward is $18,000. Currently City pays $173,000± for annual payment to pension fund. If City approves 3% change retroactive for 10 years, the annual cost will be $276,000+. If the City changes the multiplier to 3% but does not make the change retroactive, the annual cost will be $191,000. Amount of Benefit at Retirement: No costs involved. STAFF COMMENTS Recommend changing accrued retirement benefit from 2% to 3% based on: The membership (employees) now contribute 1 of their salaries and are willing to increase their contributions to 6% to help offset this cost. ($50,000 from employee, $50,000 from City) Retroactive changes for retired employees impacts 3 employees: L. Westfall - $860.00 /month (9 -1 -97) N. McCall - $137.00 /month (2 -1 -82) E. Bough - $ 82.00 /month (6 -1 -94) e6 Recommend the proposed change based on: In future years, this proposal will result in lower annual payroll cost. This change will also have the potential to maintain a younger police force and avoid "burn -out" that can accompany years of law enforcement service. POLICE PENSION WORK SESSION MARCH 1. 1999 CURRENT BENEFIT 3 F, 1 Sec. 5.03 - Disability: Participant is eligible for and receives a disability under Title R of the Federal Social Security Act. Disability is determined by Social Security. Total and permanent disability benefit is not less than 25% of average compensation as of such date. No current language concerning COLA for disabled retirees. PROPOSED Board of Trustees will determine the disability of participant. If disability is service incurred (in -line of duty), the benefit amount will be the accrued benefit as of the date of determination (multiplier times years of service), but not less than 66 2/3% of average annual compensation. If disability is non - service incurred, the benefit will be the accrued benefit as of the date of determination, but not less than 25% of average annual compensation. COLA for retired or disabled police officers that equals amount of annual pay increase for all police personnel. COST The initial cost to the City is relatively low at $5,000± /year. Future cost to the City cannot be determined based on unknown number of disability claims. The initial cost to the City is anticipated to be $1,000 ± / year. As the number of employees who reach retirement increases, the annual amount will increase to approximately $25,000± /year. STAFF COMMENTS 1. Recommend Pension Board make disability determination with appropriate formal guidelines and medical technical assistance. 2. Do not support 66 2/3% for disability for in -line of duty injury. The amount will encourage seeking of disability classifications. Florida statutes require 42 %. If the City desires to increase disability contribution, an insurance policy for all employees related to disability should be obtained. (Annual cost of $20,000 ±). 4 ""� 3. Maintain current policy of 25% disability for not in- line -of -duty injuries. Not recommended due to: 1. This would result in current employees paying a portion of retired COLA paymentsout of increased employee contribution. 2. This is not included in Chapter Plans or most non - chapter plans. 3.
