Parks and Recreation Director Jack Corder made a presentation on the Recreation Complex. Mark Veenstra and Dana Smith informed Council of the steps they need to take and where they are at with the project. The meeting was recessed and reconvened at 5:40 p.m. At this time, City Manager Hooper went over the Budget Issues that needed to be addressed for the Fiscal Year 2000 Budget and presented the Budget Schedule. NO.: 99-054 DATE: June 7, 1999 SUBJECT: Accessory Buildings and Uses DEFINITIONS IN CURRENT CITY CODE: A subordinate building or structure which is located on the same lot as the principal building. The use of which building is clearly incidental to the use of the principal building. ACCESSORY A use customarily incidental and subordinate to the principal use or building and located on the same lot with such principal use or building. Accessory uses shall include patios or porches enclosed by screening and swimming pools. The total of area taken or a horizontal place at the main grade level of the principal building and all accessory buildings exclusive of uncovered porches and steps. That percentage of the lot area covered or occupied by buildings or roofed portions of structures. BUH,DING. HEIGHT: The vertical distance from the average finish grade of elevation at the building line to the highest point of the roof. The sum of the gross horizontal areas of the several floors of a building excluding cellar and basement floor area not devoted to residential use, porches, patios, breezeways, carports, srm porches or other similar structural additions that are unenclosed or enclosed with mesh screen. Excluding Florida Shores Maximum building coverage = 35% Maximum building coverage = 35% R-6 Multi -Family Maximum building coverage = 35% REVISED DEFINITIONS IN PROPOSED LAND DEVELOPMENT CODE: Means a structure, the use of which is customarily incidental and subordinate to that of the main building on the same lot, including but not limited to detached garages, or carport, hams, greenhouse, woodshed, tool shed, gazebos, docks, boathouses and similar uses that is used to shelter and/or protect equipment, supplies, chemicals, goods, fimuture and the like for use by the principal occupant. Means a use that is incidental, related, appropriate and clearly subordinate to the main use of the building, lot or parcel and is under the direct control or ownership of any person who occupies or operates the principal use of the same building, lot or parcel. Means the sum of the gross horizontal area of the several floors of a building, except that in structures used as a residence, cellar, basement, garage, carport, patio, porch and attic floor area not devoted to living use shall be excluded. All dimensions shall be measures between exterior faces of walls. Means the gross floor area of a building or structure divided by the gross area of the parcel Means a building used for the off-street storage of motor vehicles, the provision of incidental gasoline service, the sale and/or installation of accessories and the repair ofmotor vehicles excluding body work. GARAGE. PRIVATE: Means and accessory building incidental to a dwelling unit which is intended for the off-street storage of motor vehicles belonging to the inhabitants of the dwelling unit on the parcel on which the garage is located; and is not used for any business purpose. HEIGIT I The vertical distance of a structure measured parallel to the walls from the average elevation of the finished grade to the highest elevation of the structure. For the purpose of sign regulations, the height of the building shall be computed to the upper deck of the highest floor. H"ER-WOUS SURFACE AREA (ICA): Means the area of a lot or parcel of land covered by any pan of a building street, parking lot, or any other structure, improvement, facility or material, except roof overhang which restricts natural percolation by rain water. This includes swimming pools, all asphalt and brick surfaces and areas devoted to any outdoor storage and/or display of materials and merchandise. Wetlands and wet retention or detention shall be considered impervious surfaces. Dry retention or detention ponds and unpaved parking shall be considered pervious surfaces. Means the gross impervious surface area divided by the gross area of the parcel. LOT AREA: Means the total horizontal area within the boundaries of a parcel of land. LOT COVERAGE Means that portion of the area of a lot expressed as a percentage, occupied by all buildings, structures, which are covered by impervious surfaces. PRINCIPAL USE, Means the primary or predominant use of any lot or parcel. STORAGE BUILDING: Means any structure used to shelter and/or protect equipment, supplies, chemicals, goods, furniture and the like for use by the principal occupant of the site. STORAGE. OUTDOOR, Means the safekeeping of any goods, products, equipment or vehicles which are customarily incidental to the principal use, or is the principal use, in an uncovered outdoor space and which is screened from view by the general public and neighboring properties. The term other accessory buildings shall include, but not be limited to such structures as greenhouses, gazebos, storage buildings, garages, carports and the like. 21-35.02 - General Regulations a. All accessory uses, buildings and structures shall be located on the same lot as the principal or main use. b. No accessory use, building or structure shall exceed the height limit shown in that district. C. Accessory buildings shall not be rented or otherwise used as a dwelling unit. d. No accessory structure may locate within a public right-of- way or public easement. Structures located within utility right-of-way do so at their own risk. e. All accessory structures are required to obtain a building permit in compliance with the requirements of Chapter 7 of the City Code. f. No accessory structure may he located in any front yard in any zoning district. g. Accessory buildings shall conform to the setback requirements described in Table V-1. h. No accessory building may be located within any required parking area, landscape area or stormwater facility area. i. The total area of accessory buildings shall be limited to 2 percent of the parcel area on which the accessory use is located. J. Fences shall be required around swimming pools in conformance with the requirements of Section 21-34. k. Razor wire and barbed wire on fences or walls shall be prohibited, except for telecommunication tower and utility substation site fences.
