2014-R-22 RESOLUTION#2014-R-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, SUPPORTING THE VOLUSIA COUNTY COUNCIL ACTION PLAN FOR IMPROVING THE WATER QUALITY WITHIN VOLUSIA COUNTY; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the County Council of Volusia County approved Resolution #2014-132 during their meeting on September 18, 2014 which sets forth goals to improve the water quality in Volusia County; and WHEREAS,the quality of our rivers, estuaries, streams, lakes and the offshore waters of the Atlantic Ocean is critical to the health, safety, and welfare of the Citizens of Volusia County and the City of Edgewater; and WHEREAS, the County of Volusia has invested in a stormwater management program to reduce non-point source pollution, a surface water quality monitoring program to track and respond to changes in nutrient and other pollution levels, and has eliminated surface wate discharge of treated wastewater; and WHEREAS, the City of Edgewater also recognizes the importance of the water quality of our rivers, estuaries, streams, lakes and the offshore waters of the Atlantic Ocean is critical to the health, safety, and welfare of its citizens; and WHEREAS, the City has made long-term investments and future commitments in stormwater and wastewater management programs and infrastructure to reduce nutrients and other pollution; and 2014-R-22 1 WHEREAS, on July 15, 2013 the City Council adopted Resolution 2013-R-13, The Stormwater Master Plan identifies future initiatives that will enhance the quality of stormwater; and WHEREAS, water quality is a multi jurisdictional issue of regional significance that requires the cooperation of the county, municipalities, state and federal agencies to realize measureable and sustainable improvements in our water quality. NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater, Florida as follows: Section 1. The City of Edgewater hereby resolves to work together in good faith with all local, regional, state and. federal governments, educational institutions, and non-profit agencies to improve the water quality within the City of Edgewater and surrounding areas for all citizens to enjoy. Section 2. Pursuant to approval and adoption of Resolution#2014-132 by the County Council on September 18, 2014 in which the County established the following goals and associated actions to improve water quality in Volusia County: a. j Promote clean water initiatives within all priority surface waters in the county, including the Tomoka River, Halifax River, Spruce Creek, Indian River/Mosquito Lagoons, St. Johns River, Blue Springs and Gemini Springs. b. Eliminate the discharge of all treated wastewater to surface water bodies. c. Identify water quality capital projects and commit funding. d. Develop and implement Reasonable Assurance Plans for priority surface waters that have not been declared impaired. e. Aggressively promote springs water quality restoration. f. Adopt policies to support and implement the elimination of septic;systems within priority watersheds. 2014-R-22 2 . g. Improve stormwater conveyance and treatment systems to reduce nutrient pollution. Section 3. The City of Edgewater hereby supports the actions to work cooperatively with the County of Volusia to improve water quality by: a. Actively lobby at the state and federal levels for funding for the above actions. b. Partnering on agency or other grant and funding opportunities. c. Continue initiatives in eliminating the discharge of all treated wastewater to surface water bodies citywide. d. Continue pursuing projects and initiatives regarding water quality capital projects and committing funding/matching funds. e. Developing and implementing Reasonable Assurance Plans for priority surface waters that have not been declared impaired. f Adopting policies to support and implement the elimination of septic • systems within priority watersheds. h. Consider adoption and implementation of a strict fertilizer ordinance, which includes a seasonal ban on application of nitrogen and phosphorus. j. Fully supporting and participating in meaningful education and outreach programs to inform citizens about water quality. k. Engaging area colleges, universities, and non-profit organizations in advancing the state of our knowledge through research and analysis. _ Section 4. If any section, subsection, sentence, clause, phrase, or portion of_this `- Resolution, or application hereof, is for any reason held invalid or unconstitutional by any Court, such portion or application shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions or applications hereof. Section 5. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. 2014-R-22 3 Section 6. This resolution shall take effect immediately upon its adoption. Section 7.
