CALL TO ORDER,ROLL CALL,PLEDGE OF ALLEGIANCE,INVOCATION Present: 5- Mayor Michael Thomas,Councilwoman Christine Power,Councilwoman Gigi Bennington,Councilman Mike Ignasiak,and Councilman Gene Emter Also Present: 3- City Clerk Bonnie Wenzel,City Manager Tracey Barlow,and City Attorney Aaron Wolfe 2. APPROVAL OF MINUTES This was approved. Yes: 5- Mayor Thomas,Councilwoman Power,Councilwoman Bennington,Councilman Ignasiak and Councilman Emter a. AR-2014-368 Regular Meeting- September 8, 2014 A motion was made by Councilman Ignasiak, second by Councilman Emter, to approve the minutes of September 8,2014. The MOTION was APPROVED by the following vote: Yes: 5- Mayor Thomas,Councilwoman Power,Councilwoman Bennington,Councilman Ignasiak and Councilman Emter 3. PRESENTATIONS/PROCLAMATIONS/PLAQUES/CERTIFICATES/DONATIONS a. AR-2014-330 The Volusia Manufacturing Alliance presentation on the State of Manufacturing in the local area. Peter Truslow, President of Edgewater Power Boats, and member of the Volusia Manufacturing Alliance (VMA) gave a presentation on the State of Manufacturing in the local area. He asked for the support of manufacturing activities by the community and government; stated that he is particularly impressed with the quality of the manufacturing employees, most of which live in the City of Edgewater; and that all members of the VMA appreciate Edgewater's support, past, present, and in the future. Mayor Thomas stated that he was recently watching a show where they were discussing the best 24 foot Class of boats and that two (2) of the three (3) manufacturers (Edgewater and Everglades) were from Edgewater, and that it makes him very proud that Edgewater is rated as being the best in the business. b. AR-2014-372 Certificate of Achievement Award Presentation to the Finance Department City of Edgewater Page 1 Printed on 10/29/2014 City Council Meeting Minutes October 6,2014 William Rotella, President of the Volusia-Flagler Chapter of the Florida Government Finance Officers Association presented Finance Director John McKinney and the Finance Department with a Government Finance Officers Association of the United States and Canada (GFOA) Certificate of Achievement for "Excellence in Financial Reporting" for the City of Edgewater's comprehensive annual financial report for Fiscal Year ending September 30, 2013. 4. CITIZEN COMMENTS None at this time. 5. APPROVAL OR CHANGES/MODIFICATIONS TO THE AGENDA None at this time: 6. CITY COUNCIL REPORTS Councilwoman Power discussed the upcoming School Scholarship Committee meeting; they will be discussing the Princess Ball and other possible ways to raise more scholarship funds; stated that the City of Edgewater SCC gave out four (4) $1,250 scholarships this past school year; scholarship award funds are made up of all donations; and that donations are made through the water billing system, and fund raisers. Councilwoman Bennington discussed Council members wearing pink in recognition and support of October being Breast Cancer Awareness month• that October 18th is the Haunted Forest and Fall O g , festival; the "Haunted Forest" for the older children has about 50 high school kids participating this year; this year's theme for the Haunted Forest is "Twisted Fairy Tales"; admission to the event is one (1) non-perishable canned food per person which the City then donates to food pantries in Edgewater; the event is sponsored by Citizens Assisting Police, the YMCA and the City; and stated that the event starts at 6:00 p.m. on October 18th. Councilman Ignasiak stated that he completed the Southeast Volusia Chamber (SEVC) survey; hoped everyone else that received it via e-mail also took it; since Edgewater took the SEVC's main sparkplug out by hiring Samantha Bishop from they are reaching out, trying to develop a new sense of direction and asking for help; he attended the Edgefest at Hawks Park; Edgefest is what Edgewater is all about, there was a sense of community, a sense of family, and everybody had a good time. He attended the SEVC luncheon at New Smyrna Yacht Club along with Councilwoman Power; attended the Department of Transportation's (DOT) Bike Lane presentation he, along with other members of the Council were concerned with the portion of the plan to get rid of the bike lane; however, fortunately somebody had better sense and proposed a better option that seemed to remove a lot of the obstacles. Councilman Emter discussed attending a Facebook presentation that was given by the SEVC which was very well done; encouraged the City and SEVC to partner on those types of seminars; and he attended the economic development meeting where they heard reports from a number of different entities and components on economic development. Mayor Thomas stated that he did not attend the last Volusia Council of Governments (VCOG) City of Edgewater Page 2 Printed on 10/29/2014 City Council Meeting Minutes October 6,2014 meeting because it was held on the same night as the City's Council meeting; that he read in the paper that VCOG is dissolved and asked City Manager Barlow if that was correct. Mr. Barlow replied "yes" and that VCOG is in the process of consolidating a lot of their processes and functions with the Volusia League of Cities (VLC). Mayor Thomas stated that it is very important for the 16 cities that were a part of VCOG to get together with the County and discuss issues that the cities stood together on. 7. CONSENT AGENDA a. AR-2014-360 Authorization for the City Manager to execute a contract with Estep Construction, Inc for construction of the SR 5 sidewalk from Volco Road to North city limits A motion was made by Councilman Emter, second by Councilman Ignasiak, to approve the Consent Agenda. PUBLIC HEARINGS,ORDINANCES AND RESOLUTIONS a. 2014-0-13 2nd Reading Ordinance No. 2014-0-13 - Amendment to the Comprehensive Plan Future Land Use Map to include property located at 2203 S. Ridgewood Avenue City Attorney Wolfe read Ordinance No. 2014-0-13 into the record. City Manager Barlow made a staff presentation. Mayor Thomas opened the public hearing. Councilwoman Bennington stated that the Council received a couple e-mails from neighbors voicing concerns about the development of the property. There was discussion regarding future commercial development; and about the property owner having the right to reasonable use of the land. The Council also discussed letting the owner have the opportunity to come to the Council with his plan and variance requests, and then discussing any issues that may arise. Mayor Thomas closed the public hearing. A motion was made by Councilman Ignasiak, second by Councilwoman Power, to approve Ordinance No. 2014-0-13. City Manager Barlow made a staff presentation. City Clerk Bonnie Wenzel read two (2) e-mails discussing concerns and reservations with the request (attached). Mayor Thomas opened and closed the public hearing. A motion was made by Councilman Ignasiak, second by Councilwoman Power, to approve Ordinance No. 2014-0-14. The MOTION was APPROVED by the following vote: Yes: 5- Mayor Thomas,Councilman Emter,Councilman Ignasiak,Councilwoman Bennington and Councilwoman Power c. 2014-0-21 First reading for proposed Ordinance 2014-0-21 - Amending the Plan to align with the Operating Rules and Procedures for General Employee Pension Plan. The Council concurred to discuss Agenda item 8.c after Agenda item 8.d City Attorney Wolfe read Ordinance No. 2014-0-21 into the record. City Manager Barlow made a staff presentation. City Manager Barlow stated that the applicant has requested a continuance for date certain to the November 10, 2014 Council meeting. This Ordinance was continued to the November 10,2014 meeting. 9. AR-2014-358 Councilman Emter's appointment to the Citizen Code Enforcement Board to fill the vacancy created by Gail Anderson. Councilman Emter stated that on several occasions he has had the opportunity to speak with Mr. Russell Baugher, and he seems to be a very competent individual and clearly recommends his appointment. A motion was made by Councilman Emter, second by Councilwoman Power, to appoint Russell Baugher to the Code Enforcement Board. AR-2014-364 City Council's ratification of appointment of fifth member to the Firefighters' Pension Board of Trustees. City Manager Barlow stated that the Council is just confirming the appointment made by the Board of Trustees. A motion was made by Councilwoman Bennington, second by Councilman Emter, to re-appoint Gary Butt to the Firefighters Pension Board. AR-2014-369 Request to close on vacant church property at 127 E.Park Ave. City Manager Barlow made a staff presentation. A motion was made by Councilman Emter, second by Councilwoman Power, to authorize the closing on vacant church property at 127 E. Park Avenue and the Budget Amendment. City Clerk City Clerk Bonnie Wenzel stated that she had nothing at this time. Councilwoman Bennington discussed the fact that the City Clerk now has a Deputy City Clerk and recommended that the Council meeting minutes go back to a more condensed version. The City Council concurred for the minutes to be transcribed in a more condensed version. b. City Attorney City of Edgewater Page 5 Printed on 10/29/2014 City Council Meeting Minutes October 6, 2014 City Attorney Aaron Wolfe stated that he had nothing at this time. c. City Manager City Manager Tracey Barlow discussed power line failure over the weekend at the waste water treatment plan; the lowest quote to repair the lines so far is $100,364.00; he will exercise emergency powers to authorize the repair and come back before the Council at a later date to request a budget amendment; and commended the waste water treatment crew for reacting so quickly to a true emergency situation. He discussed the upcoming 3rd Annual Economic Summit on November 1, 2014; evaluations being distributed from the HR Director for the City Manager and City Clerk; and reminded the Council about the phone call tomorrow morning at 7:40 a.m. from Skip of WFBB radio to discuss an after action review of the Council meeting. The Council concurred that Councilwoman Power will take the phone call from WFBB radio. Also discussed was he and new employee Samantha Bishop being part of a Daytona State College Summit designed to identify what the growing needs are in as far as trades are concerned, such as health care and manufacturing; and ways being looked at by members of the Summit to assist businesses and perspective employees. 12. It regards the division of the property. We realize that the property along Hwy 1 is reasonable to be zoned commercial. To set commercial zoning back as far as is being requested (Lots 22/23 - the Moore mobile) seem inappropriate with regards to public accessibility and set-backs requirements. This is a very narrow piece of land at that point. We have requested that our park attorney look into this matter and send you a letter with his legal and professional opinion. Would like the council to review that the lot at 2203 ridgewood is to small to allow 1 /2 the lot to be commercial and 1 /2 residential Allowing this to be commercial 1 /2 of it would go in back yard of residential homes and mobile homes. I think it would be better if council would allow 1 /3 commercial 2/3 residential . That would save a lot of problems of future projects. Thank you Les Ferris 1
