05-08-2000 - WorkshopCITY COUNCIL OF EDGEWATER WORKSHOP MAY S, 2000 5:30 P.M. COMMUNITY CENTER CALL TO ORDER Mayor Schmidt called the Workshop to order at 5:30 p.m. in the Community Center. ROLL CALL Mayor Donald Schmidt Present Councilman James Brown Present Councilman Dennis Vincenzi Present Councilwoman Harriet Rhodes Present Councilwoman Judith Lichter Present City Manager Kenneth Hooper Present City Clerk Susan Wadsworth Present Legal Assistant Robin Matusick Excused Police Chief Lawrence Schumaker MEETING PURPOSE Present The purpose of the meeting was to discuss the new proposed Land Development Code. City Manager Hooper presented background information with regard to the proposed Land Development Code. This is Council's time to ask questions of staff. Councilwoman Lichter asked about the process and if Code Enforcement was involved. City Manager Hooper stated the Code Enforcement Attorney stressed their role as more of a judicial role. He informed Council the Board looked it over to be aware of what was underway. City Manager Hooper made Council aware of the new presentation equipment. Planning Director Lynne Plaskett made a staff presentation regarding proposed revisions to the new proposed Code. She went over the existing and proposed Zoning Maps and the zoning districts within the City. She further explained they will be merging some of the zoning classifications to make them more cohesive. There was a brief discussion regarding annexations and County zoning classifications being changed to City zoning classifications when an annexation occurs. "W .r Ms. Plaskett listed the zoning classifications that will be merged. She spoke about the process they used to merge the classifications and the classifications that were created. They tried to combine the Comprehensive Plan, the Zoning Ordinance and the Code of Ordinances into one and make them all compatible. City Manager Hooper informed Council what will occur next. Ms. Plaskett commented on some properties having split zoning. Ms. Plaskett went over the recommendations of the Planning & Zoning Board with regard to Article II through Article Vi. City Manager Hooper asked Ms. Plaskett to stop, since they are about half way through, so they could answer any questions that Council may have. There were no questions of Council with regard to Article I. City Manager Hooper spoke about creating a glitch committee to make a list'of problem areas that are brought up. They will make a list and readdress it in a six-month period. Councilwoman Lichter spoke about vehicles abandoned verses vehicles inoperable. City Manager Hooper explained they are looking for no current tag and no known owner. They will be doing additional work with regard to this item. City Manager Hooper and Ms. Plaskett briefly went over the recommended changes of the Planning & Zoning Board to Article II - Definitions. City Manager Hooper commented on where some of the definitions came from. There were no questions with regard to Article II. City Manager Hooper explained that Article III defines the zoning categories, the districts, the Official Zoning Map. This has to be consistent with the Comprehensive Plan. City Manager Hooper spoke about residential P.U.D.'s. Councilwoman Lichter spoke about Pelican Cove West. City Manager Hooper would like to see the area out by I-95 to the west developed as P.U.D. This gives Council the maximum flexibility to negotiate what they want out there. He went on to speak about commercial P.U.D. and industrial P.U.D., which is for the F.I.H.D. project. City Manager Hooper explained the zoning categories and zoning districts and permissible, conditional and special uses. Page -2- Council Workshop May 8, 2000 v �w City Manager Hooper went on to speak about home occupational uses. Councilwoman Lichter feels they seem not to be allowing cottage industry or service. Ms. Plaskett explained the purpose of the home occupational license is for something that is incidental to the residence. They are trying to make sure they aren't issuing home occupational licenses for a bona fide commercial use. Councilwoman Lichter suggested spelling this out under the definition for home occupation. Ms. Plaskett explained typically most of your home occupations are offices. There was a brief discussion regarding home occupations not being able to advertise. City Manager Hooper stated that is the proposal. Council can make it more flexible so they can do some of that. This is written very strict to prohibit constant traffic to a residence. Councilwoman Lichter and Councilwoman Rhodes both felt the definition for home occupation needs more clarification. city Manager Hooper agreed to look at this. There was further discussion regarding home occupations and enforcement. City Manager Hooper continued his discussion with regard to what can be stored at your home. This defines 26' in length, less than 6' high, with regard to storing boats, recreational vehicles, campers or trailers. There will be a lot of input at the public hearing pertaining to this matter. Councilwoman Lichter spoke about a call she received from a lady who owns a boat. She feels the fence requirement is the toughest issue. She spoke about natural screenings. City Manager Hooper explained the idea is that it is not visible, be it a fence or natural vegetation. He asked Council if they wanted him to do additional research and find out what other cities are doing. The next step is the public hearing to get public input. Councilwoman Rhodes is interested to hear what the public has to say. Councilwoman Lichter asked how the proposal is different from what they have now. Building Official Dennis Fischer explained boats must be parked in the side or rear and are banned from the front as well as motor homes up to 35' feet. There was further discussion regarding keeping boats on the driveway or in the front of the house. Councilwoman Lichter spoke about the safety factor and people pulling out of their driveway and not being able to see around it. Page -3- Council Workshop May 8, 2000 City Manager Hooper explained Florida Shores does not have deeds, restrictions and so forth that are consistent. He spoke about other cities having new subdivisions coming in and homeowner associations having deed restrictions and covenants. That is usually where it is taken care of. City Manager Hooper went over tents and temporary carports. These do not meet any type of wind loading or criteria to make them safe during a storm. He spoke of this being a-safety issue. This is the second largest issue as to how to do these. Councilwoman Rhodes asked if there are any numbers with regard to damage done by any of these canopies. City Manager Hooper stated not that he knows of but he agreed to do some research. Councilwoman Rhodes spoke about using these tents at the church for certain functions and a storm coming and knocking them over but it has never blown the structure into anything. There was a brief discussion regarding some of the things the canopies are used for. Councilman Brown asked if anyone inspects these or if they are permitted. Mr. Fischer explained they are not permitted because they are a tent. City Manager Hooper spoke of areas of compromise but the building code does not require anything right now to be inspected. Councilwoman Lichter asked for more information with regard to these tents and canopies. City Manager Hooper agreed to look into this.
