05-26-1998 '-" ......, City of Edgewater Construction Regulation Board Regular Meeting May 26, 1998 CALL TO ORDER: Vice Chairman Bosse called to order the regular meeting of the Construction Regulation Board (CRB) on Tuesday, May 26, 1998 at 7:00 p.m. in the Community Development conference room. ROLL CALL: Members present were Vice Chairman Michael Bosse, Bob Howard, Woody Tindall (arrived at 7:45 p.m.), Charlie Cobb, and Ed Fahey. Chairman Sid Corhern was excused, and Gary Madole was recorded absent. Also present were J. Kevin Grace, City Manager; Gary Roberts, Councilman; Dennis I. Fischer, Building Official; Lt. Jill Landerville, Life Safety Division Supervisor; and Tonya Elliott, Board Coordinator. Vice Chairman Bosse welcomed new members Ed Fahey and Charlie Cobb. APPROVAL OF MINUTES: Vice Chairman Bosse asked for a motion to approve the minutes of January 29, 1998. Mr. Howard moved to approve the minutes. Since there was no member able to second the motion, the approval of minutes was postponed until the next meeting. UNFINISHED BUSINESS: Vice Chairman Bosse said according to the agenda there was no new business. However, he said at the last meeting the Board requested the Fire Department review some proposed amendments to the Uniform Building Code (UBC). A memorandum from the Fire Department was distributed to the members for their review. Mr. Fischer said he was in the process of preparing the Ordinance and Agenda Request to adopt the UBC and that he needed clarification on which amendments to omit. Vice Chairman Bosse said Item 101.6 Exception A and B, and Item 104.15. Mr. Howard said according to the minutes only Exception A was omitted. After some discussion, they asked the Board Coordinator to review the tapes again for clarification. Mr. Grace asked if there was a time frame. Mr. Fischer said no. Councilman Roberts suggested the UBC is looked at again since there is a new Building Official and new Board members. Everyone was in agreement and decided to schedule a special meeting. NEW BUSINESS: 1) Introduction of J. Kevin Grace, City Manager; and Dennis I. Fischer, Building Official. Vice Chairman Bosse welcomed Mr. Grace and Mr. Fischer. Mr. Grace said he wanted everyone to be able to put a face with a name and let the Board know he appreciates the work they do. He also said he has an open door policy. If there are any problems contact Mr. Fischer, he is a good problem solver. '-" """'" Construction Regulation Board May 26, 1998 Page -02- 2) Board members Woody Tindall and Gary Madole term's expired May 01, 1998. Both request re-appointment for another term. Vice Chairman Bosse said that only Mr. Tindall had requested to be re-appointed. The Board Coordinator said Mr. Madole had been contacted on several occasions and had not responded. Mr. Howard moved that Gary Madole due to his lack of communication to the Board Coordinator no longer be considered as a member to the CRE. Motion FAILED due to lack of a second. Mr. Fahey said he wasn't familiar with Mr. Madole, therefore didn't want to offer a second. There was some discussion on Mr. Madole's lack of response. Vice Chairman Bosse asked for a motion on Mr. Tindall's request. Mr. Howard moved to accept Mr. Tindall's request to be re-appointed. Seconded by Mr. Fahey. Motion CARRIED 4-0. Vice Chairman Bosse said since there was no second to Mr. Howard's motion to not consider Mr. Madole for re-appointment, he assumed the decision would be left up to Council. Mr. Howard said he didn't want to put the burden on Council. He asked if the Board could function with six (6) members until a special meeting could be held. Councilman Roberts said yes. Mr. Fischer said maybe by the next meeting a few potential applicants could be solicited. There being no further discussion, Vice chairman Bosse asked for a motion. Mr. Howard moved to hold off filling Mr. Madole's position until the next meeting. Seconded by Mr. Cobb. Motion CARRIED 4-0. 3) Review of "Minor Construction Variance" Proposed code modification to Section 1011.01 of the Land Development Code. Mr. Fischer began by giving background information that has brought about the need for this code modification. He said that in the past the City had zero tolerance on setback encroachments. He eXplained that during construction if a slab was poured even %" in the setback, the contractor was told to stop construction and rectify the problem before further construction could continue. He said a "Minor Construction Variance" would allow the Building Official to review the circumstances, then deny or approve a setback encroachment not to exceed one (1) foot in dimension or 10% of the set back, whichever is less. He briefly explained the application procedure and associated fees. Mr. Fischer than asked if anyone had questions. Mr. Howard moved that the "Minor Construction Variance" be accepted and approved for discussion only at this time. Seconded by Mr. Fahey. Mr. Howard asked ifit was geared toward single family residences only. Mr. Fischer said yes. Mr. Howard said .., ~ ~_.. . '-' ..",.I Construction Regulation Board May 26, 1998 Page -03- clarification needed to be made because commercial developers will try to take advantage of such a variance. Councilman Roberts agreed saying once it is on the books it will apply to everyone. There was discussion on ways to make clarification such as limiting the lot size, type of construction or square footage. Mr. Fischer said when a contractor applies for this type of variance they don't want to build a larger structure than allowed. He said the building gets located in the setback during construction causing an encroachment. Mr. Howard moved to amend his motion for approval with the inclusion of the verbiage "Minor Residential Construction Variance". After further discussion on associate fees, habitual offenders and the criteria for granting a variance, Mr. Cobb seconded the motion. Motion CARRIED 4-0. Vice Chairman Bosse asked if anyone had a conflict with holding a meeting on Tuesday, June 30, 1998. There were no objections. Councilman Roberts inquired if the Board ever coordinated with other Building Trade Boards to stop unlicensed contractor activity. Mr. Fischer said the State wants the County to be the lead in the policing of unlicensed contractors and subcontractors. He said there is a "hot line" number with the county, or the City of Edgewater Building Department has a 24 hour answering machine. Mr. Howard asked if the City still issues competency cards to contractors. Mr. Fischer said no that the City issues registration cards, and explained the difference. Councilman Roberts suggested the Board write an article for the City news letter advising the public what to be on the lookout for when selecting a contractor. There was a brief discussion on unlicensed contractors abusing the worker's compensation exemption form, and also the qualifications required for journeyman electricians. The Board agreed to help educate the public on how to select a licensed contractor. ADJOURNMENT: There being no other business to come before the Board a motion to adjourn was made and seconded.
