07-28-1998 , ~ ....., City of Edgewater Construction Regulation Board Regular Meeting July 28, 1998 CALL TO ORDER: Vice Chairman Bosse called to order the regular meeting of the Construction Regulation Board (CRB) on Tuesday, July 28, 1998 at 7:12 p.m. in the Community Development Conference Room. ROLL CALL: Members present were Vice Chairman Michael Bosse, Woody Tindall, Charlie Cobb and Ed Fahey. Chairman Sid Corhem and Bob Howard were excused. Gary Madole was recorded absent. Also present were Councilman Gary Roberts; Dennis I. Fischer, Building Official; Lt. Jill S. Landerville, Life Safety Division Supervisor; and Tonya L. Elliott, Board Coordinator. APPROVAL OF MINUTES: Vice Chairman Bosse entertained a motion to accept or reject the minutes of January 29, 1998. Mr. Tindall moved to accept the minutes of January 29, 1998. Seconded by Mr. Cobb. Motion CARRIED 4-0. Vice Chairman Bosse entertained a motion to accept or reject the minutes of May 26, 1998. Mr. Cobb moved to approve the minutes of May 26, 1998. Seconded by Mr. Fahey. Motion CARRIED 4-0. UNFINISHED BUSINESS: 1) Reappointment of Gary Madole whose term expired May 01, 1998, or review applications for appointment of a new member (held over from May 26, 1998). Vice Chairman Bosse asked if there had been any contact with Gary Madole. The Board Coordinator said no. Vice Chairman Bosse said there were two (2) applicants interested in filling the position; Thomas B. Allen, 1887 S. Pinedale Rd.; and Gregory D. Moore, 1401 S. Ridgewood Ave., unit 7. Mr. Tindall said based on Mr. Allen's his credentials he made a good prospect. Mr. Fischer said Mr. Allen is the current plans examiner for the City of Maitland and extremely qualified. Vice Chairman Bosse agreed Mr. Alllen was the most qualified but did not appear to be a resident of the City of Edgewater. Mr. Fischer confirmed that Mr. Allen's residence is about 50 yards outside of the city limits, however, he said the Board is just making a recommendation to City Council. Vice Chairman Bosse asked if there were any recommendation from the Board. Mr. Tindall recommended Thomas Allen fill the position. Seconded by Mr. Cobb. Vice Chairman Bosse asked if there was any discussion. Mr. Fahey asked what City Council would say if the Board recommended Mr. Allen over Mr. Moore who is a resident of the City. Vice Chairman Bosse said that was one of the ..,. ..""", Construction Regulation Board July 28, 1998 Page -02- questions everyone was concerned about. Mr. Fischer reiterated Mr. Allen's qualifications. Councilman Roberts said there are other Boards that the City has allowed outside residents to serve on. He said it is possible that Council would be more than willing to go along with the recommendation of the CRB but said the By-laws would need to be checked. A copy of the Land Development Code Section 304.02 (B) Construction Regulation Board was handed out to the Board which states that "Each member of the CRB shall be a resident of the City unless no qualified candidate applies." Mr. Fischer said the key word is "shall" meaning will. He asked the Board Coordinator to check the phone book and utility billing to verify that Mr. Moore is still a resident of the City. Vice Chairman Bosse asked if Mr. Tindall or Mr. Cobb wanted to rescind their motion. Mr. Tindall rescinded his motion because he felt it wasn't right for the Board to go against it's By-laws and recommend someone who is not a resident of the City. After further discussion on the issue, Mr. Tindall made a motion to recommend that Mr. Greg Moore be appointed pending verification of residency. Seconded by Mr. Fahey. Motion CARRIED 4-0. 2) Review Uniform Building Code (UBC). Vice Chairman Bosse asked if everyone had reviewed the UBC and the memorandum from the Fire Department. He said at the January 1998 meeting the Board had requested the Fire Department comment on sections 101.6, Exception A and B; and section 104.15 of the UBC. Lt. Landerville said the Fire Department agrees that section 101.6 should remain in the Code. However, Exception A could potentially put firefighters at risk by requiring them to enter a building on fire in order to disconnect the power. Both Exceptions mention the use of rapid entry security boxes, which would present a deterrent to entry in mutual aid situations because there is no universal key system. A Brief discussion followed on the universal key system. Vice Chairman Bosse said the other issue raised at the January meeting was section 104.15, Multi-plug adapters. He said multi-plug adapters are technically in violation of the code but are allowed as long as they are not daisy chained, overloaded or located someplace they are subject to damage. He said his big concern is they can be used as long as the Electrical Inspector approves them. However, if the Fire Inspector comes in at a later date and says they are being used improperly it could put the inspectors at odds. Therefore, he feels section 104.15 should say, "These permitted uses will be up to the discretion of both the Electrical Inspector and Fire Official." Lt. Landerville said it should be "and/or" because if you link them together with "and" you have another level of bureaucracy. Mr. Fischer said the recommended changes the Electrical Code ~ ...., Construction Regulation Board July 28, 1998 Page -03- Committee (ECC) wants will help address these issues. He said one of the things they are requesting is that surge protection arrestors be installed in the meter can at the time of installation. There was a lengthy discussion on multi outlet extensions. Vice Chairman Bosse reiterated that his main concern is in the wording. Mr. Fischer said the Board could modify the UBC by adding language for this municipality. He said they could also make it known to the Uniform Code Committee that the Fire Inspector should be added along with the Electrical Inspector regarding the allowing of temporary power connections. Discussion continued on this issue. The Board finally agreed to change the wording in section 104.15 to "These permitted uses will be up to the discretion of the Electrical Inspector or Fire Official." Vice Chairman Bosse said that section 1 01.6 Main disconnects, was the only other section the Board had questions about. He said there wasn't a problem with the main section just the Exceptions A, Band C as discussed previously. There was further discussion on why the exceptions need to be eliminated, and the ECC's role. Vice Chairman Bosse said if there were no more areas of concern he would entertain a motion. Mr. Tindall moved to recommend adoption with the exception of adding "or Fire Official" to section 104.15, and eliminate Exceptions A Band C from section 101.6. Seconded by Mr. Cobb. Motion CARRIED 4-0. 3) Electrical Uniform Code Committee 1999 Code Update Recommendation. Vice Chairman Bosse said they had already discussed some of the ECC recommendation with agenda item 2. Mr. Fischer briefly talked about the other proposed recommendations and addressed a couple of questions from the Board. NEW BUSINESS: None at this time.
