AN ORDINANCE PROVIDING FOR ISSUANCE OF
OCCUPATIONAL LICENSE: TIM AND E:PIRATION
THEREOF; OATH REQUIRED; PROVIDING FOR
r PENALTY FOR THE FAILURE TO TAKE OUT LICENSE;
PROVIDING FOR RECORDATION, TRANSFER, AND
POSTING; FORM THEREOF AND FEES TO BE CHARGED:
Ig IT ORDAINED BY THE TO',7N COUNCIL OF THE TOUN OF
EDGMiATER, FIARIDA:
Section 1. Licenses required: No parson., firm or
corporation within the corporate limits of the Two of Edgewater shall
engage in, manage, carry on or conduct any business, profession,
occupation or calling hereinafter mentioned or generally described
without having first procured a tovm license therefor from the town
clerk and hawing paid the amount hereinafter provided. Each license
shall be signed by the town clerk and be registered by him and shall bear
the seal of the Tam! of Edgewater.
Section 2. Time of Issuance and of Expiration: No lic-
=so shall to issued for more than one year, and all licenses shall
expire on the 31st day of December in each year, except as otberwise

provided for is this ordinance. All licenses aha!1 to payable or. or
before the first day of February of each year, and no license shall be
issued for any fractional portion of a year, except that any license not
gtherwise specified in this chapter may be issued afterthe first day
of July, same to expire December 31st following, upon payment by the
applicant of one-half the amount fixed as the price of such license for
we year.
Section 3. Oath: It shall be the duty of the
to•,:n clerk, before issuing s license based on property valuation, amount
of capital stock, capacity of production, or other contingency, to re-
quire the party applying for said License to file under oath, duly
authenticated, a statement of the valuation of the property or amount
of the capital stock or capacity of production or other contingency.
The town clerk may administer the said oath ae specified herein.
Section 4. Penalty for4ailure to Take Out
Licenses: Any person, firm or corporation, or association that
shall carry on or conduct any busin ea or profession, occupation or
calling for which a license is required by this ordinance, Without first
obtaining such license, shall be deemed guilty of a misdemeanor and upon
conviction thereof in the mayor's court, shall be punished by a fire not
exceeding two hundred ($200.00) dollars, or by imprisonment not exceeding
sixty days, or by both such fine and impriedmment, in the discretior of the
court, and each ay's continuance of such violation after notice from the
town marahall to take out a license, shall constitute a new offense and
subject the offender to like penalty.
Section 5. Record: `the toan clerk shall keep
a record showing the names of all parties to whom licensee have been issued
the date of such issue, the busines permitted to be carried on, and the
amount paid for such license.
Section 6. Transfer of License: Any license may
be transferred, with the approwal of the town council, with the buatness
for which it was tekn out, when there is a bona fide sale and transfer of
the property used and employed in the business as stock in trade.
Section 7. Showing License to Officer: It shall
be the duty of any party holding a license under this ordinance to exhibit
the same to the chief of police or any police officer on request of such
of ficerm and refusal to comply with such request shall be puruihod by a
fine not exceeding five ($5.00) dollars end costs.
Section 8. License to be Posted: Any license
issued to a party having a local place of business, that is to my, an
office, a store, shop, tent or -stand" of any definite location, shall be
posted in a conspicuous position in such office or place of business by
the holder of such license and stall at all times during office hours be
subject to inspection by any city officer. Any violation of this section
shall be punished by a fine not exceeding five ($5.00) dollars and coats
of prosecution.
Section 9. Occupations Requiring Special rermit:
It shall be unlawful for the town clerk to issue a license to any person,
firm or corporation to conduct any business or calling designated in this
section unless such party shall first present to him a written permit to
do so, which permit shall be signed by the mayor, to -wit;- Amusement
park, acution shops, bowling alleys, boxing exhibitions, circuses, clair-
voyants, concert hall, dance halls, dealers in deadly weapons, dealers in
junk, dog shows, exhibitors of wild animals on streets, gypsy canpe,
hypnotists, mental Feelers, merry-go-rounds, motion picture shows, organ
grinders, palm gardens, palmists, pawn brokers, peanut venders, peddlers,
pony shows, roof gardens, second-hand clothing dealers, a scond-hurl dealers
of any kind, shooting galleries, skatirg rinks, street carnivals, street
doctors, street shows, tent above ad any kind, wrestling matches.
Section -10. License Form and Schedule of Licensee;
The following license taxes shall be paid to the town clerk by the person
or persons, firm or corporation aWC.ed ia,managing, transacting or carrying
on any of theseveral occupations, professions, callings or kinds of business
erumerated or described in this section; and the form of all town licences

Definition: The w ordseitinerant vendors", as used in
this section, are to be construed to mean end include all persons

Penalty
(a) Any person found selling or o`fcriug for Bale any food, ice cream,
or drinks, described or provided for in this section., without having first
taken out the required lic;nee, orwho shall refuse to permit his stock
to be examined by the marsivall, shell be punished for each such offense
by a fine of not more than twenty five ($25.00) dollars, or by imprisonment
for not more than ten (10) days, or by both such fire and L.1also m.ent in
the deaeretion of the court.

Failure to take out License; Every business, occupation, pro-
fession or exhibition substantially fixed or temporarily engaged in by
person or persons, firm or corporation, whether in ak building, tent
booth, or upon the street, vacant lot, or anywhere in the open air within
the town and not specifically designated in section 10 of this ordinance,
shell pay a license tax of ten ($10.00) dollars. Any person violation
the provisions of this section shall, upon conviction thereof, be punished

by a fire not exceeding ten ($10.00) dollars, or by imprisonmert not
exceeding ten days, or by bath fine and inprisoament, in the discretion of
the court. The mayor shell have the authority to refuse the issuance of
such license and may at his discretion revoke any such license, ar.dmay
order the refunding of any part or all of the moneys paid for such license
vher. the same is revoked, and any person conducting any such business after
such action by the mayor shall be liable to penalties as specified herein.
Section 12. Officers of 0orporations Liable,. It
s&ll be the duty of all officers and agents of my corporation required by
this chapter to be licensed, to see that such corporation complies herewith,
and any violation of the foregoing provisions concerning licensee by any such
corporation shall subject the officers and agents of the same to the penalty
imposed by the paaeseding section.
Section 13. Repcal of Conflicting Ordinances. All
ordinances, and parts of ordinances, in conflict herewith be and the same
are hereby repealed.
Section 14. This ordinance shall be effective after
being passed by the Tovn Council, approved by the Mayor, and poatedin
three public places in the town of Edgewater, Florida.
By unaniamus consent of the Two Council of the Town of
Edeevater, Florida, this Ordinance was passed to it's third and final
reading at a regular meeting of thesaid council on February 4th, 1927.
