64ORDINANCE NO. 64. AN ORDINANCE DECLARING CERTAI:, EXCESSIVE GROWTH OF GRASS, WEEDS AND NOXIOUS PLANTS A PUBLIC NUISAKCS AND FIRE HAZARD; AND PROVIDING FOR THE REMOVAL THEREOF FROM CERTAIN .LANDS WITHIN THE TOWN OF EDGEWATER, FLORIDAS AND PROVIDING FOR SAID TOWN OF EDGEWATER TO REMOVE SAID EXCESSIVE GROWTH. OF GRASS, WEEDS AND OTHER NOXIOUS PLANTS AND TO CHARGE AGAINST THEPROPERTYFROM WHICH SAID EX- CESSIVE GROWTH OF GRASS AND WEEDS AND NOXIOUS PLANTS ARE REMOVED THE COST OF SUCH REMOVALS AND FOR THE CREATION OF A LIEN UPON SAID PROPERTY FOR THE COST OF SUCH REMOVAL. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF EDGEWATER, VOLUSIA COUNTY, FLORIDAt Section 1. That the excessive growth of grass„ weeds and noxious plants and the accumulation of trash or filth on pro- perty within the corporate limits of the Town of Edgewater, F1ar- ida be and the same is hereby declared to be a menance to the public health of the citizens and inhabitants of the Town of Edgewater, Florida and that the said excessive growth of grasa, weeds and other noxious plants and accumulation of trash and fil- th does breed disease and pestilence and provide a breeding place for mosquitos, flies and other noxious insects injurious to the public health of the inhabitants of said Town of Edgewater. Section 2. That the aforesaid excessive growth of weeds, grass and noxious plants and the accumulation of trash and filth do constitute a fire hazard which greatly endangers the safety and well being of the property of the inhabitants of the Town of 1 Edgewater, Florida. Section 3. That such excessive growth of grass, weeds or other i noxious plants and the accumulation of trash and filth as set forth in the two preceding sections is hereby declared a public nuisance and shall be abated forthwith. Section 4. That the owners or occupants of lots or parcels of land within the corporate boundaries of the Town of Edgewater, Florida shall at all times hereafter keep the said lots or parcels of land free from filth, trash, excessive growth of I grass, weeds or noxious plants. 1 Section 5. That upon the failure of the said owners or occu- pants of the aforesaid lots or parcels of land to keep the same free from excessive growth of grass, weeds and other noxious plants, filth and trash, the said Town of Edgewater, acting by and through its Town Council, shall give written notice to the owner or occupant of said lot or parcel of land, where such owner or occupant is within the city limits of the Town ofEdgewater, Florida, to remove within ten days from the date of the service of said notice all excessive growth of grass, weeds or other noxious plants or the accumulations of trash or filtli from said lands; where the owner of any unoccupied lot or parcel of land is unknown or is not within the city limits such written notice shall be posted on the most conspicuous part of such lot, which said notice shall require the owner of said lot to remove from the same all excessive growth of weeds, grass and other noxious plants or accumulations of filth or trash within tendays from the date of the posting of said notice. Section 6. In the event of the failure of any person, firm or corporation to comply with such notice, whether such notice be ser- ved personally or posted upon said lot or parcel of land, the said Town of Edgewater may at the expiration of ten days after the date of the said service of said notice or posting of the same, cause such lot or parcel of land to be cleaned of all accumu- lati,,ns of trash or filth or cause such excessive growth of grass, weeds or other noxious plants to be cut and removed from said lot or parcel of landq and the said Town of Edgewater shall have a lien upon said lot or parcel of land for the cost of re- moving such excessive growth of grass, weeds or other noxious plants which said lien shall be enforced against said property as provided by the laws of the State of Florida governing the same. Section 7. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 8. That this Ordinance shall become a law upon being passed by the Town Council of the Town of Edgewater, Florida, approved by the Mayor or becoming a law without such agproval, and posted at the V. I. A. Hall and three public places in the Town of Edgewater, Florida, and shall become effective immediate- ly upon becoming a law. This Ordinance was read and passed upon its first reading; and upon motion duly made, seconded and unanimously carried the re- quirement of reading this Ordinance upon second reading was wai- ved, and this ordinance was ordered put upon its final passage. 4 IL'L Passed upon final passage with the unanimous vote of the Torn Council of the Town of Edgewater, Florida, and approved as pro- vided by law this /1" day oA.
