BE IT ORDAINED BY THE TO-dII COUiYCIL OF THE TOIAI OF EDGEWATER, /" VOLUSIA COUNTY, FLORIDA: .Section 1. That a volunteer fire department of the Town of N Edgewater, Florida is hereby created. Section 2. That the fire department of the Town of Edgewater, Florida shall consist of: A. A Fire Chief of the Fire Department who shall have full charge of the fires, fire department and all fire equiptment owned by said Town and said Fire Chief shall be appointed by the Town Council and shall hold office at their pleasure. B. An Assistant Fire Chief who shall in theabsence of the Chief and until the Chief shall arrive at a. fire, act as Chief of the Fire Department, whose power and auth- ority shall at all times be subordinate to that of the Fire Chiefs said Assistant Fire Chief to be appointed by the Town Council and shall hold office at their pleasure. C. Twelve (12) volunteer firemen or callmen who shall be selected by the fire chief subject to the approval of the Town Council of the Town of Edr,ewater and who shall hold membership as members of the Volunteer Fire Depart- ment subject to the pleasure of the Town Council, and. whose ,duty it shall be to res,ond to every alarm of :ire and to 6:) every call for *ire drill or practice; as volun- teer firemen they shall at each and every alarm of fire or call to drill or practice immediately report to the fire chief, if he be present and in his absence to the assistant fire chief; the r fire chief or in his absence the assistant fire chief is hereby Zranted the authority to select the personnel and number of volunteer firemen who report for each fire7 fire drill or practice t3at are actually used in said fire, fire drill or practice and only those volunteer firemen selected by the Chief or the Assistant Fire Chief to actually serve in the extinguishment of any fire or to take part in any fire drill or practice small receive the compensation hereinafter provided for. Section 3. Compensation of Volunteer Firemen. That the Chief, Assistant Chief and each Volunteer Fireman or cal Lnan who is actually selected by the Fire Ciiief or the Assistant Fire Chief in the absence of the Chief to participate in the extinguishment of any fire or to take part in any fire drill or practice shall receive as compensation therefor the sum of one ('1.00) dollar for each such actual fire call or fire drill pr practice in which the said volunteer fireman or calLnan, if selected by the Fire Chief or Assistant Fire Chief, may take part. Section 4. Fire Drill for the Fire Depart;aent shall be called by the order of the Fire Chief only but no one volunteer fireman or call:man shall be called or paid for a fire drill or practice more often than once in two weeks. 2. That the Fire Department of the Town of Edgewater, Florida may adopt such rules and regulations for the governiient of said Fire Department as may be deemed for the best interest of said Fire Department, subject however, to the approval of the Town Council; the said Fire Department shall from time to time meet and make such recommendations to the said Town Council with re- gard to the betterment of said Fire Department and fire pro- tN tecticn cf the Town of Edgewater as they deem necessary. Section 6. That in the event of any alarm of fire or fire drill or practice being given that the apparatus of the fire department shall be given the right ofwayin and upon the streets, lanes, alleys, squares and railroad crossings in going to any fire upon such streets, lanes, alleys, squares and rail- road crossings, and it shall be unlawful for any person to ob- struct or neglect or refuse to make way for any such apparatus being thus in or upon any of said streets, lanes, alleys, squares or railroad crossings. Section 7. It shall be unlawful for any person or persons whom- soever to ride or drive a vehicle through the streets and lanes in which the fire department is assembled for the purpose of ex- tin_'uishing a fire, and should any person or )eraons attempt to ride or drive a vehicle through the streets and lanes in which the fire department is assembled for the :purpose aforesaid, he or '� they shall'be liable to arrest. 3. i (335 Section 8. That no person or persons, except fireman, police, owners of property, their agents or agents of insurance companies shall be allovweu within the limits of any safety zone that may be established by the fire department at any tine withoutbeing order- ed thereby by the officer in command of the fire department. It Section S. That e,11 members of the fire uepartment of said Town are vested with the power of a police officer of the Town to the extent that they may while in the actual discharge of their duties at any fire or while going to the same may order such traffict as may be necessary halted, may block such streats, highways or lands as necessary to the proper c.,nduct of t:-eir duties and may enforce the rules and regulations and provisions of Sections 6, 7 and 8 of this Ordinance. Section 10. That any person or peosaus violatii, any of the pro- visions of Section 61 7 or 8 of this ordinance si:all be liable to arrest b.; any police of the said Town or by any authorized member of the Fire Department and on conviction before the Lunicipal Court of the saiu Town shai.l be subject to a fine not to exceed One Hundred ($100.00) dollars or to imprisonment in the Town Jail not to exceed thirty (30) days or by ,both fine and imprisonment. Section 11. That all ordinances or parts of ordinances in con- flict herewith be and the same are hereby repealed. Section 12. That this ordinance shall become a law upon being pass- ed by the Town Council of the Town of Edgewater, Florida, a.)proved by the LIayor or becoming a law without such approval, and posted a at the V. 1. A. Hail and three public places in the Town of Edge- water, Florida, and shall become effective irvaedi:. tely u.,en becom- ing a law.
