3. APPROVAL OF MINUTES
A motion was made by Board Member Haldeman, second by Board Member Corn, to
approve the minutes of the Citizen Code Enforcement Board meeting of September 11,
2014.The MOTION was APPROVED by the following vote:

5. NEW BUSINESS -PUBLIC HEARING
The Board approved an amendment to the agenda to move the following cases to the beginning: M

Code Officer Dan Koehler presented the case to the Board. Code Officer Dan Koehler recommended
that the Board finds Karla Simpkins in violation of Sec. 21-36.10(swimming pool) and Sec. 10-234
(doors) of the Code of Ordinances assessing the citation fine of $150.00 and an additional fine of
$150.00 per day each day the violation exists past October 10, 2014 and for a lien to be placed on

the property if not satisfied by October 15, 2014.
Karla Simpkins of 2903 Tamarind Drive was present and stated that she is a single parent of four
children, who is currently employed. She stated that she painted her home and removed all the
debris around the home. She stated she has removed the ladder from the pool and the pool is
draining at this time. Once the pool has completely drained she will dismantle and store it inside her
garage. Ms. Simpkins stated that she can't financially replace the garage door at this time.
Code Supervisor Jeff Lariscy suggested that Ms. Simpkins talk with the building official and contact
some garage door companies to find out her options. Also work with the code officers and keep them
up to date with her progress.
A motion was made by Board Member Corn, second by Board Member Lester to find
Karla Simpkins in violation of Sec. 21-36.01 (swimming pool) assessing the citation fine of
$75.00 and allow the correction of the pool by dismantlement or pull a permit by October
12, 2014. If the violation exist past October 12, 2014 an additional fine of $100.00 per day
for each day the violation exist and for a lien to be placed on the property by October 20,
2014.

Chairman Ben Wagner read the following cases and concluded that it appears after reviewing the
cases no one was present for any of the cases mentioned above. Pursuant to Section 10-348&
10-345 subparagraph C 11 of the Code of Ordinance and the statement that appears on the respected
citation issued that failure to appear at this hearing means that alleged violator has waived any
rights to contest the violation and that an order can be made against them for the maximum

applicable penalties that include but not limited to the administrative cost, fines, daily fines and liens
however we have the benefit of the staff recommendations, motions and actions to be taken by the
Board.
A motion was made by Board Member Corn, Second by Board Member Barnhill to
accept the findings and follow the staff recommendations.

7. CODE COMPLIANCE REPORT
Code Supervisor Jeff Lariscy stated for the month of September a total of 202 code cases were
