2002-R-08 (/&- t . !. ~ "w' ~ RESOLUTION 2002-R-08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, AUTHORIZING SUBMISSION OF A FLORIDA INLAND NAVIGATION DISTRICT WATERWAYS ASSISTANCE PROGRAM GRANT APPLICATION TO THE FLORIDA INLAND NAVIGATION DISTRICT, ASSURING DEDICATION AND AVAILABILITY OF THE REQUIRED 50 PERCENT MATCHING FUNDS, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO ENTER INTO A PROJECT AGREEMENT; PROVIDING FOR TRANSMITTAL OF THE FLORIDA INLAND NAVIGATION DISTRICT WATERWAYS ASSISTANCE PROGRAM GRANT APPLICATION AND CERTIFICATION TO FLORIDA INLAND NAVIGATION DISTRICT; PROVIDING SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Edgewater, is interested in carrying out the following described Project for the enjoyment of the citizenry of Edgewater and the State of Florida . WHEREAS, the Project will be known as the Kennedy Park Pier, which is located in the Indian River North on the Intracoastal Waterway within the City of Edgewater. WHEREAS, the estimated cost of the Project is one hundred thirty-five thousand three hundred and noll 00 ($135,300) dollars, which will include construction of a 10' x 126' fishing pier, with a 2,250 square foot octagon shaped platform that will include a 28 foot in diameter octagon shaped gazebo. WHEREAS, the City of Edgewater is requesting financial assistance for the program mentioned above from the Florida Inland Navigation District for the Project. WHEREAS, a copy of the Florida Inland Navigation District Waterways Assistance Program application is attached as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED by the City Council of The City of Edge water, Florida Section 1. The City Council hereby authorizes submission of a Florida Inland Navigation District Waterways Assistance Program application to the Florida Inland Navigation District. Section 2. The project name for which the grant is requested will be known as Kennedy Park Pier. 2002-R-08 1 ....,., ,..." ~ Section 3. The total cost of the project is estimated to be one hundred thirty-five thousand three hundred and nollOO ($135,300) dollars. Section 4. The City is requesting a grant in the amount of sixty thousand eight hundred eighty- five and no/IOO ($60,885) dollars or 45 percent of the actual cost of the project. Section 5. The City hereby assures dedication and availability of matching funds, in the amount of seventy-four thousand four hundred fifteen and no/IOO ($74,415) dollars upon receipt of the grant award funding notification which exceeds the required 50 percent match. Section 6. The City Council hereby authorizes the appropriate City Officials to enter into a Project Agreement. Section 7. The City of Edgewater will accept the terms and conditions set forth in FIND Rule 66B-2 F.A.C. and which will be a part ofthe Project Agreement for any assistance awarded under the attached proposal. Section 8. The City of Edge water is in complete accord with the attached proposal and that the City will carry out the Program in the manner described in the proposal and any plans and specifications attached thereto unless prior approval for any change has been received from the District. Section 9. The City has the ability and intention to finance its share of the cost of the project and that the project will be operated and maintained at the expense of the City of Edgewater for public use. Section 10. The City will not discriminate against any person on the basis of race, color or national origin in the use of the property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and the intent ofthe Title VI of the Civil Rights Act of I 964,P.L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by handicapped persons as well as other federal, state and local laws, rules and requirements. Section 11. The City will maintain adequate financial records on the proposed project to substantiate claims for reimbursement. Section 12. The City will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 10% of the funding agreed to by FIND. Section 13. The City Council hereby designates Jack Corder, Director of Parks and Recreation, to transmit a copy of this resolution, certification and the original grant application and one copy to the Florida Inland Navigation District. 2002-R-08 2 o Section 14. An official, adopted and certified resolution of the City of Edgewater, shall be included with the application. Section 15. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 16. This resolution shall take effect upon adoption.
