RESOLUTION NO. 2002-R-34 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA, REPEALING RESOLUTION NUMBER 96-R-20 IN ITS ENTIRETY AND ESTABLISHING AN UPDATED SCHEDULE OF RATES FOR THE COLLECTION AND DISPOSAL OF GARBAGE AND TRASH PURSUANT TO SECTION 19-63 (SERVICE CHARGES AND RATES), ARTICLE VI (SOLID WASTE DISPOSAL) OF CHAPTER 19 (UTILITIES AND SERVICES); PROVIDING FOR SEVERABILITY; REPEALING RESOLUTIONS IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: WHEREAS, Ordinance No. 96-0-06 was adopted July 15, 1996 amending Section 19-63 (Service Charges and Rates) of the Code of Ordinances to provide for the establishment of rates for the collection and disposal of garbage and trash; and WHEREAS, the Refuse Fund is a proprietary enterprise fund where the intent of the City Council is that the cost of providing collection and disposal service is financed or recovered through user fees; and WHEREAS, the schedule of rates for garbage and trash collection and disposal has not been increased since July 15, 1996; and WHEREAS, due to the increase in expenses of the collection and disposal of garbage and trash it is necessary to increase the rates for collection and disposal of garbage and trash. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. Service Description. Basic collection service is to include all household 2002-R-34 1 garbage, bundled or cont<lt!ferized yard trash, household appliancl! and recyclable materials. Bundled yard trash will not exceed a dimension of four feet (4') long, four feet (4') high or four feet (4') wide and shall not contain tree limbs in excess of four feet (4') in length or six inches (6") in diameter. Loose trash piles or large trash piles will require a "special pickup". Section 2. Service Charges and Rates. The City may charge a service charge and rate/user fee for services provided to all residential (single and multi-family), multiple dwellings, business or commercial, professional, trailer park and mobile home park. In addition to the above stated fees, for the purpose of financing equipment used in the collection and disposal of garbage and trash within the city, each account shall be charged an additional fee per month as established by resolution with said funds to be placed in a separate equipment reserve fund. The schedule of rates/user fees for the collection and disposal of garbage and trash are hereby established as stipulated in Exhibit "A" and shall become effective on January I, 2003. For the period January 1,2004 through January 1,2008 the implementation of the schedule of rates/user fees shall be reviewed on an annual basis during the normal budgetary process. Section 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
