'- ..."., RESOLUTION NO. 2002-R-31 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA, REPEALING RESOLUTION NUMBERED 96-R-03 IN ITS ENTIRETY AND ESTABLISHING A FEE FOR LIEN INQUIRY/REPORT PURSUANT TO SECTION 10-97 (LIEN AGAINST PROPERTY), ARTICLE V (WEEDS, GRASS, AND BRUSH; STANDARDS FOR PROPERTY MAINTENANCE) OF CHAPTER 10 (HEALTH AND SANITATION); PROVIDING FOR SEVERABILITY; REPEALING RESOLUTIONS IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: WHEREAS, the City of Edgewater has adopted Ordinance No. 2002-0-19 which provides for the establishment of a fee for producing a lien inquiry/report; and WHEREAS, the City of Edge water is authorized to impose user charges or fees authorized by ordinance for the verification process pursuant to Section 166.201, Florida Statutes (2000); and WHEREAS, the City has enacted the authority pursuant to Ordinance No. 2002-0-19 to establish fees for lien inquiries/reports and with approval of this resolution shall establish the fee for producing said inquiry/report. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. Pursuant to the authority contained in Ordinance No. 2002-0-19 and enacted upon adoption by City Council. The fee established in Section 1 0-97( d) for lien inquiry/reports shall be in an amount of$25.00 per parcel of property. Section 2. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent 2002-R-31 1 w ..". jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 3. upon adoption. Section 4. Effective Date. This Resolution shall become effective immediately Adoption.
