159 ORDINANCE NO. 3' AN ORDII ACE REGULATING AND PROHIBITING `.- WITHIN THE TOWN OF EDGEWATER, VOLTUSIA COUNTY, FLORIDA, THE SOLICITING OF BUSINESS FOR HOTELS, RESTAURANTS, APART2Ifl NT HOUSES, TOURISTS HOMES, TOURISTS CAMPS, MOTOR COURTS,PARKS OR OTHER LODGING FACILITIES. "'' , BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF EDGEWATER, FLORIDA: SECTION 1. It is unlawful for any person on a public street, roadway, highway or sidewalk, in the Town of Edgewater, Volusia County, Florida, to throw in, or attempt to throw in any motor vehicle, or offer, or attempt to offer to any occupant of any motor vehicle, whether standing or moving, or to place or throw in any motor vehicle, any advertising matter relating to hotels, restaurants, apartment houses, tourist homes, tourist camps, motor courts, trailer ,;arks, or other lodging facilities, or the rates in connection therewith, or upon such Public street, road- way, highway or sidewalk, to solicit or attempt to solicit by folder or other printed matter patronage for any such place or places from any occupant of any motor vehicle whether standing or moving or to cause or secure any person or Jersons to do any one of such unlawful acts. SECTION 2. It is unlawful to throw or place, or cause to throw in, or place in any motor vehicle while the same is moving along any public street, roadway or highway in said Town of Edgewater, Volusia County, Florida, or is stopped on any public street, roadway or highway within said town for the purpose of observing traffic rules, /�9 NO, warnings or regulations, any pamphlet, booklet, literature or other advertising information or matter relating to hotels, restaurants, apartment houses, tourist camps, motor courts, trailer parks and other lodging and eating facilities in said Town of Edgewater, Volusia County, Florida, or the accomodetion_ to be had thereat or the rates in connection therewith; or to solicit any occupant of said motor vehicle to become a guest of any hotel, restaurant, apartment house, tourist camp, motor court, trailer park, inn, or other lodging or eating place in said Town of Edge- water, Volusia County, Florida; excepting therefrom, however, the right of any owner of any such place of business or his bona fide employee to solicit such business from the occupant or occupants of any automobile or vehicle parked within one hundred feet of his said place of business. SECTION 3. It is hereby declared to be an offense against the Town of Edgewater, Volusia County, Florida, for any Person to violate any of the .provisions of Section 1 or Section 2 thereof. Any person convicted in the municipal court of Edgewater, Volusia County, Florida, of such violation shall be fined in the sun of OoT t/ 6 3-f-1.4d / Q, OD dollars, or imprisoned for a period not exceeding �S days, or both such fine and imprison- ment in the discretion of the court. SECTION 4. All ordinances or Parts of ordinances in con=_'i.-i ct herewith be and the same are hereby repealed. SECTION 5. This ordinance shall take effect immediately upon its passage and approval by the Mayor. The above ordinance was read in full and passed by the unanimous vote of the Town Council of the Town of Edgewater, Florida at a regular meeting on the 8th day cf September, A.D. 1948. Upon motion duly made, seconded and unanimously carried, the recuirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage.
