// BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF EDGEWAT ER, FLORIDA:

' SECTION 1. All liquors, wines and beers containing more than

SECTION 2. No intoxicating 1i,,;uor_s, wines or beers shall be

sold within the Town of Edgewater except by persons holding
y licenses permitting such sales issued by the Town of Edgewater.

17s SECTION 3. Any person before engaging in the business of
manufacturing, selling, chartering or exchanging or in anywise
dealing in liquors, wines, beers or other alcoholic beverages
shall, before engaging in such business, file with the Town
Clerk a written application for license to conduct such busi-
1 ness, said application to be made on forms to be :rovided by
said Town Clerk. The application shall state the character
and location of the business to be engaged in and the kind
i of license as hereinafter defined whicn the applicant desires.
1 Applicant for such license shall give the names of five business
or professional men as references who may be called upon by
the Town of Edgewater should it deem same advisable for
1 information as to the character, business integrity and past

history of the person applying for a license.

SECTION 4. Each vendor authorized to do business under the
laws of the State of Florida pertaining to alcoholic beverages
and having a place of business within the corporate limits of
the Town of Edgewater shall pay an annual license tax as
follows:
(a) Vendors of beverages containing alcohol of more than
one -)ercent by weight and not more than fourteen percent by
wi\tight and wines regardless of alcoholic content 150.00.
(b) Vendors operating places of business where beverages
are sold only in sealed containers for consumption off the
premises where sold $375.00.
( c) Vendors operating places of business where consumption
on the aremises is permitted $500.00
( d) Persons associated together as a chartered or incorpor-
ated club, including social clubs incorporated by orders of
Circuit Judges after their charters have been found to be for
objects authorized by law and approved by said Judges as
organized for lawful purposes and not for the purpose of evading
licenses taxes on dealers in beverages defined herein, which
said organizations are bona fide clubs, and at the time of
application for licenses hereunder shall have been in continuous
active existence and operation for a Deriod of not less than
two years in the county where they exist, shall before serving
or distributing to their members or non-resident guests
the beverages defined herein whether such services or distribution

be made upon contribution to the club of money or by check
or other device, ?ay annual license tax of E%1 X5.00.
SECTION 5. each license shall describe the location
of the place of business where such bevera.re shall be sold
and no such beverage shall be =permitted to be sold except
at such Place of business.
SECTION 6. No licenses under this ordinance shall be
granted to the vendor if his Place of business is within
500 feet of an established church or
school v,.ithin the cor>orete limits of the to-n or is within
1000 feet of an existing licensee under
this ordinance.
S^CTION 7. Licensees by the acceptance of their licenses,
agree that their places of business during business hours

SECTION S. The sale, service and distribution of intoxicating
li,)uor•s and beverages by .persons duly licensed under this
ordinance shall be .'emitted until 2 o' clock A.M.
daily; Provided however t-~_ t no such beverage shall be
sold, served or distributed from 2 o' clock A.M.
Sunday until o' clock A.M. on Mond:y
SEC-ION 9. No intoxicating or alcoholic beverage may be
sold, consumed or served or Permitted to be sold, served or
consumed in any place holdin.F, a lic �r_: e to any minor or
intoxi ca:t ed person.

SECTION 10. No person holding; a license from the Town of
Edgewater to sell alcoholic or intoxicating beverages shall
allow, permit or suffer any drunkenness, rowdyish or immoral
conduct to take Place in such licensee' s piece of business
and it shall be the duty of such licensee to notify the
Town Marshall immediately upon the happening of such improper
conduct.
SECTION 11. Upon the conviction of any violation of this
ordinance in the Municipal Court of the Town of Edgewater,
Florida the Torn license of such licensee shall be automatically
revoked and repealed.
SECTION 12. It is hereby declared to be an offense against
the Town of Edgewater, Volusi.a County, Florida for any person
to violate any of the provisions of this ordinance. Any
person convicted in the Municipal Court of Edgewater, Florida
of such violation shall be fined in the sum of 500
Dollars or imprisoned for a neriod not exceeding 30 _
days or both such fine and imnri sonrer_t in the discretion
of the Court.
SECTION 13. All ordinances or _arts of ordinances in conflict
herewith be and the same are hereby repealed, including
Sections 9 and 12 of Article 15 of Ordinance No. 75.
The above ordinance was reed in full and passed by the unanimous
vote of the Town Council of the Town of Edgewater, Florida at a

regular meeting on the 22nd day of Dacambor , A. D. 1948 •
Upon motion duly made, seconded and unanimously carried, the
recuirement of reading said ordinance upon second reading was
waived and the ordinance was ordered put uon final passage.
Passed by the unanimous vote of the To,n Council of the Town
of Edgewater, Florida at a regular meeting of said council
held on the 22nd day of Deccrtbor , A.D. 1948 , and
approved as provided by law, the vote of said council on roll
call being as follows:
